Regulations of Changchun Municipality on the Administration of Road Freight Transport Trading Market (revised in 2002)

Chapter I General Provisions Article 1 In order to strengthen the management of the road freight transport market, safeguard the legitimate rights and interests of both parties to the transaction and promote the healthy development of the road freight transport industry, these Regulations are formulated in accordance with the provisions of relevant national and provincial laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "road cargo transport trading market" as mentioned in these Regulations refers to the places (including various cargo loading stations) that provide trading services for road cargo carriers, shippers and freight forwarders. Article 3 These Regulations shall apply to the administration of the freight trading market within the administrative area of this Municipality. All units and individuals engaged in the construction, management and operation of freight trading market shall abide by these regulations. Article 4 The people's governments of cities and counties (cities) shall incorporate the establishment and development of the freight trading market into the overall planning of urban construction, and adhere to the principles of unified planning, rational layout and supervision and management according to law. Article 5 The traffic administrative departments of the people's governments of cities, counties (cities) and Shuangyang District are the competent departments of the freight trading market within their respective jurisdictions.

Industry and commerce, public security, taxation, price, urban construction and other departments shall, in accordance with their respective responsibilities, do a good job in the management of the freight trading market. Sixth city, county (city), Shuangyang District People's government traffic administrative departments of the road transport management institutions specifically responsible for the daily management of freight trading market, its main responsibilities are:

(a) to publicize and implement the laws, regulations and rules of the state on the management of freight trading market;

(2) Examining the business qualifications of the units and individuals that set up the freight trading market or enter the market to engage in freight trading, and going through the business procedures for entering the market;

(3) Examining the closure and other changes of business units in the freight trading market or units and individuals entering the market to engage in freight trading, and handling relevant procedures;

(four) to manage the business activities of the freight trading market according to law, protect the legitimate rights and interests of both parties to the transaction, and investigate and deal with illegal acts in business transactions;

(five) mediation of freight transaction disputes according to law;

(six) other work related to the freight trading market. Article 7 The business units of the freight trading market and the units and individuals that enter the market to engage in freight trading have the right to report the illegal acts of road transport management institutions and their law enforcement personnel and safeguard their legitimate rights and interests. Chapter II Planning and Construction Article 8 The planning for the construction of freight trading market prepared by the transportation department of the people's government of a city or county (city) shall conform to the overall urban planning and be implemented after being approved by the people's government at the same level. Ninth, in the main commodity distribution center, where large factories and mines are located, a large-scale freight trading market integrating transshipment, warehousing and tally, cargo transfer and other functions can be planned and built; In places where the supply of goods is small and relatively concentrated, a small freight trading market with certain service functions can be planned and built. Tenth freight trading market can be built by the state, collective and individual investment. The legitimate rights and interests of investors are protected by law. Article 11 The existing freight stations of transport enterprises can be opened to the public as freight trading markets. Twelfth planning, urban construction, land, public security and other departments shall, in accordance with their respective responsibilities, do a good job in the construction of freight trading market. Chapter III Establishment of Markets Article 13 A freight trading market shall meet the following conditions:

(1) Having a fixed freight trading place and corresponding parking, warehousing and other supporting facilities;

(2) Having a sound organizational structure and business articles of association;

(3) Having employees who are familiar with freight transaction business and freight transaction management regulations;

(4) Having working capital commensurate with the scale of the freight trading market;

(five) the ability to organize the supply of materials and vehicles and handle business accidents;

(6) Having perfect rules and regulations on freight transaction, safe transportation and financial settlement;

(seven) there are rain, fire, theft and other security measures;

(eight) other conditions stipulated by laws, regulations and rules. Article 14 To apply for opening a freight trading market, a written application shall be submitted to the traffic administrative department at or above the county level on the strength of the feasibility report of opening a freight trading market and the certificate of the people's government at or above the township level or the competent unit. Upon examination, those who meet the requirements for starting a business shall be issued with a freight trading market license, and the business license shall be issued by the administrative department for industry and commerce.

The following documents shall be submitted when going through the registration formalities with the administrative department for industry and commerce:

(1) Registration application report;

(two) the license issued by the administrative department of transportation for freight trading market;

(3) the articles of association of the market;

(four) the identity certificate of the legal representative of the market;

(5) Certificate of use of the business premises;

(6) The capital verification certificate of the corresponding amount issued by the capital verification institution. Fifteenth freight trading market closed, closed, merger, division, relocation, should apply to the original examination and approval department 30 days in advance, the original examination and approval department should handle the relevant formalities within 20 days. Chapter IV Transaction Management Article 16 Freight transactions shall abide by the provisions of relevant laws, regulations and rules, and follow the principles of voluntariness, equality, openness and compensation. Seventeenth units and individuals engaged in business in the freight market must apply to the local road transport management agencies for business licenses, and apply to the local administrative department for industry and commerce for business licenses with business licenses to operate in the designated freight market.
