Chapter I General Provisions Article 1 In order to establish a personnel management system suited to the socialist market economy and meet the needs of the common development of various ownership economies, these measures are formulated in accordance with the Provisional Regulations on the Administration of Talent Exchange in Jiangsu Province and its detailed rules for implementation, combined with the actual situation of this Municipality. Article 2 The term "personnel agency" as mentioned in these Measures refers to the socialized management and service of personnel affairs of employers and individuals by personnel service agencies entrusted by the personnel administrative department of the government. Article 3 Personnel agency services shall be standardized, thoughtful, high-quality and efficient, and the service contents shall be continuously improved and expanded according to the process of personnel system reform and the needs of economic and social development. Article 4 Nanjing Personnel Bureau is the administrative department in charge of personnel agency work within the administrative area of this Municipality, and the district and county personnel administrative departments are responsible for the management of personnel agency work within their respective jurisdictions. Fifth city, district and county personnel administrative departments of the talent service agencies entrusted by the personnel administrative department of the government at the same level, specifically responsible for the personnel agency business within their respective jurisdictions. Article 6 Personnel agencies shall implement the qualification system for employees. Personnel engaged in personnel agency work shall be qualified by the training and examination of the municipal personnel administrative department, and shall be engaged in personnel agency work only after the qualification is confirmed by the relevant departments. Chapter II Agency Article 7 Personnel service agencies affiliated to the personnel administrative departments of governments at all levels may handle personnel agency for the following units or individuals:

(a) professional and technical personnel and management personnel in foreign-invested enterprises, township enterprises, private technology enterprises, private enterprises, representative offices of foreign enterprises in Nanjing, offices of foreign enterprises in Nanjing, and non-state-controlled joint-stock enterprises;

(two) lawyers, accountants, auditors and other social intermediary institutions and social organizations in the professional and technical personnel and management personnel;

(3) Graduates from universities and technical secondary schools recruited by state-owned enterprises and institutions during the probation period, various professional and technical personnel and managers recruited through the talent market, and staff of newly-built institutions;

(4) On-the-job, on-the-job professional and technical personnel and management personnel that state-owned enterprises and institutions need to represent;

(5) State functionaries during the probation period;

(six) professional and technical personnel and management personnel who resign, dismiss or terminate the employment contract; Resignation and dismissal of government workers; Demobilized military cadres and demobilized soldiers who choose their own jobs; Self-employed and unemployed university and technical secondary school graduates;

(seven) other units and individuals that need personnel agency. Article 8 Personnel agents listed in Article 6 of these Measures may be represented by units or individuals. The agent can implement all or part of the agent. Chapter III Agency Contents Article 9 Personnel agency contents include management project agency and service project agency. Article 10 The personnel service institutions affiliated to the personnel administrative departments of governments at all levels may handle the following personnel agency projects with certain management functions for agency units and individuals:

(a) Keep the personnel files and personnel relations of the agent, calculate the length, approve and record the salary of the file, and issue documents according to the file, etc. ;

(2) Handling the preliminary examination and border pass procedures for the agent to go abroad or leave the country;

(three) to examine and determine the qualifications of professional and technical posts for the first time, and to declare and review the qualifications for promotion of professional and technical posts;

(four) responsible for the probation period management and employment grading of college graduates;

(five) responsible for the management of the probation period of the staff of state organs;

(six) professional and technical personnel and management personnel employed for this institution;

(seven) responsible for coordinating personnel disputes between institutions and individuals;

(8) Acting as an agent for social insurance and housing accumulation fund;

(nine) to assist the agency retirement procedures;

(ten) for the agent's household registration;

(eleven) to handle family accounts for agents with intermediate or above professional titles;

(twelve) the relevant awards of the reporting agent;

(thirteen) the agent's disability appraisal statement;

(fourteen) transfer and management of party member, Communist Youth League members and trade union members between agents. Article 11 The personnel service institutions affiliated to the personnel departments of governments at all levels may provide the following socialized services to employers and individuals as personnel agents.

(1) Acting as an agent for the introduction, recommendation and recruitment services of various professional and technical personnel and management personnel;

(2) Providing talent borrowing services;

(3) Providing supporting services for project construction talents;

(4) Providing guarantee agency business for high-level talents;

(5) Providing services such as personnel training and personnel evaluation;

(six) to provide human resources allocation planning, salary level survey and other personnel consulting services;

(seven) to provide talent information services;

(eight) to assist in recommending the employment of agents of units that have not yet been implemented;

(9) Organizing agents to participate in continuing education;

(ten) other services required by employers and individuals. Article 12 The content of personnel agency shall be determined by signing a contract between the agent and the talent service institution.
