Article 2 These Measures shall apply to the recycling operations and supervision and management of renewable resources within the urban area of ??this city. Article 3 The term "renewable resources" as mentioned in these Measures refers to various resources that are generated in the process of social production and daily consumption and have lost all or part of their original use value. After recycling, storage, and processing, they can regain their use value. kind of waste.

If there are other provisions in laws, regulations and rules regarding the recycling of scrapped cars, used electrical and electronic products, hazardous wastes and medical wastes, such provisions shall prevail. Article 4 The municipal and district commerce departments are responsible for the supervision and management of renewable resource recycling. Administrative departments such as planning and natural resources, public security, market supervision, urban management, ecological environment, and transportation shall, in accordance with their respective responsibilities, do a good job in the supervision and management of renewable resource recycling.

The township (town) people's government and sub-district offices should cooperate with the administrative departments such as commerce, public security, and market supervision to do a good job in the management of renewable resource recycling within their respective jurisdictions. Article 5 Renewable resources industry associations shall formulate industry self-regulatory norms and cooperate with the competent commerce departments in researching and formulating industry development plans, industrial policies and relevant technical specifications.

Renewable resources industry associations should accept the business guidance of the competent commercial departments and assist relevant administrative departments in supervising and managing the renewable resource recycling industry. Article 6 The municipal commerce department shall, in conjunction with the municipal planning and natural resources, economics, urban management and other administrative departments, follow the industrial development policies stipulated in the "Hangzhou Industrial Development Orientation Catalog" and based on the city's overall planning and the development status of the renewable resource recycling industry, Formulate the industrial layout and development plan for the renewable resource recycling industry and implement it after approval by the Municipal People's Government.

The people's governments of each district shall determine the setting of renewable resource recycling points within their jurisdiction based on the industrial layout and development plan of the renewable resource recycling industry. Article 7 The municipal and district people's governments encourage units and individuals to accumulate and sell renewable resources, encourage renewable resource recycling enterprises and individual industrial and commercial households to go deep into communities and rural areas to carry out recycling operations, and encourage renewable resource recycling enterprises and individual industrial and commercial households to carry out scientific recycling and processing of renewable resources. Article 8 If renewable resource recycling enterprises and individual industrial and commercial households meet the prescribed conditions for tax incentives, they will be granted tax incentives by the tax authorities after being identified in accordance with relevant regulations.

The identification of comprehensive utilization of resources by renewable resource recycling enterprises shall be carried out in accordance with relevant national and provincial regulations. Article 9 To establish a renewable resource recycling enterprise or individual industrial and commercial household, industrial and commercial registration must be carried out in accordance with the law. Article 10 Those engaged in recycling of renewable resources shall comply with management regulations on public security, fire protection, environmental protection, city appearance and sanitation, and production safety, and shall handle relevant administrative licensing procedures in accordance with the law. Article 11 Renewable resource recycling enterprises and individual industrial and commercial households are not allowed to recycle the following items:

(1) Stolen items notified by the public security organs for search;

(2) Items suspected of being stolen items ;

(3) Wasted municipal public facilities whose legal origin cannot be proven;

(4) Other items prohibited from recycling by laws, regulations and rules. Article 12 When a renewable resource recycling enterprise purchases productive scrap metal and scrap municipal public facilities, it shall check the certificates and lists issued by the selling unit and register them truthfully. The registration content includes the name of the selling unit, the name of the person in charge, the type and number of the identity document, the name, quantity, specifications, condition and purchase time of the items.

For the purchase of productive scrap metal and scrap municipal utility facilities picked up by individuals, the renewable resource recycling enterprise shall collect the name, address, identity document type and number of the seller, the name, quantity, specifications, newness and oldness of the items. The extent and time of acquisition shall be truthfully registered.

The retention period of recycling records shall not be less than 2 years. Municipal public security organs should establish a renewable resource acquisition information management system and gradually realize real-time monitoring of renewable resource recovery. Article 13: Mobile recycling personnel of renewable resources and their transportation vehicles shall be subject to unified labeling management. Specific measures shall be formulated by the municipal commerce department in conjunction with the municipal public security, urban management and other administrative departments, and shall be implemented after approval by the Municipal People's Government.

Article 14 The Renewable Resources Industry Association shall organize training for renewable resource recycling personnel. Mobile recycling personnel of renewable resources should participate in training and have the necessary knowledge on recycling of renewable resources. Article 15 Renewable resources generated by enterprises and institutions shall be sold to renewable resource recycling enterprises or individual industrial and commercial households.

If municipal public facilities construction, maintenance and management units need to dispose of scrapped municipal public facilities, they should sell them to enterprises engaged in recycling of used municipal public facilities. The list of companies engaged in recycling waste municipal public facilities shall be announced by the municipal commerce department in conjunction with the municipal public security, urban management and other administrative departments.

When selling renewable resources through auction, the auctioneer shall check the business license of the bidder. Those who have not gone through industrial and commercial registration are not allowed to participate in the bidding. Article 16 If a production enterprise needs to use renewable resources as raw materials in production, it shall purchase them from industrial and commercial registered renewable resource recovery enterprises and individual industrial and commercial households, and shall not illegally purchase them on its own.
