Regulations of Qinghai Province on the Protection of Disabled Persons
The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the work of the disabled. Article 4 Disabled persons' federations at all levels represent the common interests of disabled persons, safeguard their legitimate rights and interests, unite to educate and serve disabled persons, carry out work for disabled persons, mobilize social forces and develop undertakings for disabled persons in accordance with laws, regulations, articles of association or government entrustment. Fifth people's governments at or above the county level shall include the funds for the disabled in the financial budget and establish a stable fund guarantee mechanism.
The lottery public welfare fund shall be used by the finance at the same level, and no less than 10% of the funds shall be set aside every year for the development of the cause of the disabled.
Finance, auditing and other departments should strengthen the management and supervision of the use of funds for the disabled and lottery public welfare funds. Article 6 People's governments at all levels encourage social organizations and individuals to care for and support the cause of the disabled and provide donations and services for the disabled. Article 7 People's governments at all levels shall formulate and implement disability prevention action plans, publicize and popularize disability prevention knowledge, establish and improve a three-level disability prevention system focusing on health promotion, early intervention and rehabilitation, and reduce the occurrence and degree of disability. Eighth people's governments at all levels should establish and improve the statistical investigation and reporting system for disabled people, strengthen information collection and dynamic monitoring, and announce the main situation to the society every year. Article 9 "People's Republic of China (PRC) Disabled Persons' Card" (hereinafter referred to as "Disabled Persons' Card") is the legal certificate for identifying disabled persons and their categories and grades, and the main certificate for disabled persons to enjoy preferential policies such as rehabilitation, education, employment, culture, sports and social security.
The disabled person's card shall be applied by the disabled person himself or his guardian to the disabled person's Federation where the account is located, and shall be handled free of charge. Chapter II Rehabilitation Services Article 10 People's governments at all levels and relevant departments shall establish and improve the rehabilitation service system for the disabled, organize and implement key rehabilitation projects, and carry out rehabilitation work for the disabled in a planned way.
The people's governments at or above the county level and relevant departments shall establish a socialized rehabilitation service system based on community rehabilitation, with rehabilitation institutions as the backbone and families of the disabled as the support, so as to provide rehabilitation services for the disabled. Eleventh people's governments at all levels and health administrative departments should set up rehabilitation medicine departments (rooms) in medical institutions in a planned way, organize and guide urban and rural communities to carry out rehabilitation services, and gradually establish and improve the rehabilitation service network with shared resources.
The people's governments of townships (ethnic townships and towns) shall provide rehabilitation services for the disabled by relying on hospitals and community medical and health service institutions.
Encourage and support social forces to set up rehabilitation institutions for the disabled. Twelfth disabled persons' federations at all levels can raise funds through various channels, such as social collection and individual donations, to support rehabilitation services for the disabled. Thirteenth people's governments at or above the county level and relevant departments shall establish and improve the rehabilitation and assistance system for disabled children, and provide free rescue treatment and rehabilitation for disabled children aged 0 to 6. Chapter III Education Guarantee Article 14 The people's governments at or above the county level shall incorporate the education of the disabled into the national education development plan and the evaluation and assessment system of education development, make overall plans and make scientific arrangements, and ensure that the disabled enjoy equal rights to receive education.
The people's governments at or above the county level shall formulate the development plan of special education for the disabled within the administrative area of this province and promote the work of special education for the disabled.
Attach importance to the development of special education for the disabled in ethnic minorities and remote and poor areas. Fifteenth people's governments at all levels advocate the implementation of free education for disabled children in preschool and senior high schools.
The people's governments at or above the county level and their relevant departments shall establish a special funding system for the education of the disabled, and provide financial assistance to disabled students who receive education other than compulsory education and students from poor families of disabled people.
Students with disabilities and students from poor families with disabilities are given priority to enjoy state grants when attending senior high schools in ordinary high schools, secondary vocational schools, technical schools, institutions of higher learning and special education schools. Sixteenth ordinary preschool education institutions should accept disabled children who can adapt to their lives and carry out early education. Article 17 Ordinary senior middle schools, complete middle schools, secondary vocational and technical schools, institutions of higher learning and adult education institutions must recruit disabled candidates who meet the admission requirements stipulated by the state, and may not discriminate against disabled people in enrollment, further studies and degree awarding on the grounds of disability. Eighteenth education administrative departments at all levels, disabled persons' federations and special education institutions for disabled persons shall formulate educational plans according to the physical and mental characteristics and needs of disabled persons.
Special education institutions for the disabled should have places and facilities suitable for learning, rehabilitation and life characteristics of children and adolescents with severe physical, intellectual, visual and hearing disabilities, cerebral palsy and autism.
