Regulations of Jiangsu Province on Water Search and Rescue

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Emergency Response Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province, in order to respond to emergencies on water in a timely and effective manner, standardize search and rescue activities on water, protect personal safety and water environment, and reduce property losses. Article 2 These Regulations shall apply to the navigable waters within the administrative region of this province and the sea areas designated by the state to be responsible for search and rescue in this province and related activities.

The term "water search and rescue" as mentioned in these Regulations refers to the activities of the water search and rescue center to organize and coordinate the search and rescue forces, search and rescue the people in distress, and control and reduce the harm of water pollution when ships, installations, aircraft and their personnel are in distress on water and engage in above-water and underwater operations or other activities, which cause or may cause casualties, water pollution and other emergencies. Third water search and rescue should adhere to the people-oriented, heal the wounded and rescue the dying principle, and strive to control and reduce the harm.

People in trouble are entitled to free assistance. Article 4 The system of unified leadership, comprehensive coordination, graded responsibility and territorial management shall be implemented in water search and rescue, and the combination of prevention and search and rescue, professional search and rescue and social search and rescue shall be adhered to, and the principle of unified command and quick access shall be followed. Article 5 The local people's governments at or above the county level shall incorporate the cause of water search and rescue into the national economic and social development plan, strengthen the leadership of water search and rescue work, establish a water search and rescue system, improve the water search and rescue mechanism, and strengthen the capacity building of water search and rescue. Article 6 The local people's governments at or above the county level and their water search and rescue centers shall strengthen the publicity and education of water search and rescue, enhance the public's awareness of water risk prevention and rescue, and commend and reward units and individuals that have made remarkable contributions to water search and rescue. Chapter II Institutions and Duties Article 7 Local people's governments at or above the county level shall set up water search and rescue centers according to needs, which shall be responsible for organizing, coordinating and directing water search and rescue work. With the approval of the provincial water search and rescue center, a water search and rescue center can be jointly established according to the waters. The water search and rescue center can set up a search and rescue sub-center.

City, county water search and rescue area by the provincial water search and rescue center proposed delimitation plan, announced after the approval of the provincial people's government, and reported to the National Maritime Search and Rescue Center for the record. Article 8 The main responsibilities of a water search and rescue center include:

(a) the preparation of emergency plans for water search and rescue;

(2) Providing professional guidance to local water search and rescue forces;

(3) Organizing maritime search and rescue training, drills and related training;

(4) Organizing, coordinating and directing the water search and rescue operations;

(five) other duties as prescribed by laws, regulations and rules and determined by the people's government at the corresponding level.

The maritime search and rescue center shall formulate working rules, improve the internal working mechanism, strengthen coordination among member units, and organize member units to perform maritime search and rescue duties. Article 9 A maritime search and rescue center consists of relevant departments and units of local people's governments at or above the county level. All relevant departments and units shall perform corresponding duties in accordance with the following provisions:

(1) The maritime administrative agency shall be responsible for water traffic control at the scene of water search and rescue, organize and coordinate relevant vessels and facilities to participate in water search and rescue operations, and undertake other tasks entrusted or assigned by local people's governments at or above the county level;

(2) The marine and fishery department is responsible for organizing marine water quality, tide and wave monitoring, coordinating fishing boats to participate in water search and rescue operations, and providing necessary technical support for fishing boats in distress;

(three) the transportation department is responsible for organizing ports, highways and other transportation resources to participate in water search and rescue operations;

(4) The public security department is responsible for receiving and transmitting the early warning information of water danger, managing the public security at the search and rescue site, maintaining the land traffic order and road traffic control, and disposing of the remains of the victims. The public security fire control institution is responsible for organizing and directing the fire fighting on the site of ships and facilities;

(five) the supervision and administration department of production safety is responsible for organizing and coordinating the emergency rescue resources of dangerous chemical accidents to participate in water search and rescue operations;

(six) the environmental protection department is responsible for coordinating and organizing water quality monitoring, and providing monitoring data and necessary technical support for environmental protection;

(seven) the communication department and the radio management agency are responsible for coordinating the communication guarantee and technical support for water search and rescue;

(eight) the civil aviation supervision and air traffic control department is responsible for providing water distress information and search and rescue technical support for civil aircraft, and participating in the command and coordination of water search and rescue of civil aircraft;

(nine) meteorological agencies are responsible for providing weather forecasts and disastrous meteorological information in relevant areas, and providing emergency meteorological services required for water search and rescue;

(ten) the water conservancy department is responsible for providing water information needed for the implementation of water search and rescue;

(eleven) the civil affairs department is responsible for coordinating the temporary life assistance of the rescued people from China, and cooperating with the relevant departments to do a good job in handling the remains of the victims from China;

(twelve) the health department is responsible for coordinating the medical treatment of the wounded and the emergency medical rescue work on the water;

(thirteen) the financial department is responsible for providing the necessary funds for water search and rescue work;

(fourteen) the foreign affairs department is responsible for coordinating the aftermath of rescued and killed foreigners;

(fifteen) Hong Kong, Macao and Taiwan affairs departments are responsible for coordinating the aftermath of the rescued and killed Hong Kong, Macao and Taiwan personnel.
