What procedures and materials are needed for marriage registration

The marriage registration process is mainly composed of application, review and registration.

(1) Couples who apply for

marriage registration can bring relevant certificates, supporting materials and registration photos, apply for marriage registration at the marriage registration office where one party is located, and fill in the declaration required to apply for marriage registration on the spot.

The preparation materials for marriage registration application depend on the specific circumstances. For example, China citizens who apply for marriage registration in China must bring their valid ID card, household registration book, marriage examination certificate, single spouse certificate and signed statement that they are not related by blood with the other party. If they are divorced and apply for remarriage, they must also bring divorce documents.

To apply for marriage registration in China, foreigners, such as foreigners who are resident in China and Chinese foreigners, must hold their valid passports or other identities, nationality certificates, Alien Residence Permit issued by public security organs or valid temporary residence certificates in China, and marriage status certificates issued by domestic notary offices certified by the Ministry of Foreign Affairs (or authorized organs of the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country.

(II) Examination

The application of the party concerned will be examined by the marriage registration authority to find out whether the marriage application submitted is within the scope of conditions. In case of any ambiguity, the marriage registration authority shall ask the party concerned and ask the party concerned to provide relevant materials for the marriage registration application if necessary.

(3) Registration and obtaining a certificate

For those who meet the conditions for marriage, the marriage registration authority will register them and then issue a marriage certificate; For divorced people, the marriage registration office will cancel their divorce certificates; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents are needed for divorce

The divorce registration process is as follows:

(1) If both husband and wife apply for

a voluntary divorce, both parties who need a divorce shall sign a divorce agreement as required, submit the application to the marriage registration office with jurisdiction, and provide the following documents and supporting materials:

1. A marriage certificate issued by the mainland marriage registration authority or the China embassy (consulate) abroad;

2. Valid identification documents that meet the requirements for divorce registration, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc.;

3. An Application for Divorce Registration filled in at the marriage registration office.

(II) Acceptance

The marriage registrar conducts the initial examination of the above-mentioned materials submitted by the parties in accordance with relevant regulations. After the documents and certification materials submitted by the parties are correct in the first instance, a receipt for accepting the divorce registration application will be issued. If there are differences with the conditions of divorce registration application, it will not be accepted, and if necessary, a Notice of Rejection of Divorce Registration Application will be issued at the request of the parties.

(III) Cooling-off Period

Within 3 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, if either party does not want to divorce, he can withdraw it from the divorce registration office that accepted the application for divorce registration with relevant materials, such as his valid ID card and the Receipt for Accepting the Application for Divorce Registration (the receipt is not required, but a written explanation is required). After being verified by the marriage registration authority, the parties concerned shall be issued with the Confirmation of Withdrawal of Divorce Registration, and the Application for Divorce Registration, the Application for Withdrawal of Divorce Registration and the Confirmation of Withdrawal of Divorce Registration (stub) shall be filed together. Within 3 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration office for issuing a divorce certificate together, it shall be deemed that the parties are unwilling to divorce and withdraw their application for divorce registration.

(IV) Examination

Within 3 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday shall be the date of the expiration of the period), both parties shall hold relevant certificates and materials, such as photos, marriage certificates, identity cards or passports, divorce agreements, etc., and * * * apply to the marriage registration authority to issue divorce certificates according to regulations. The marriage registration authority shall carry out and review according to the provisions of the Code for Marriage Registration. Those who do not meet the requirements for divorce registration will not be provided with divorce registration procedures. If the parties request to issue a notice of divorce registration that will not be handled, the marriage registration authority shall issue it.

(V) Registration (certification)

The marriage registration office shall make relevant registration and issue divorce certificates to the parties according to the provisions of the Work and Standards for Marriage Registration.
