Regulations of Hebei Province on the Administration of Talent Market

Chapter I General Provisions Article 1 In order to strengthen the management of the talent market, safeguard the legitimate rights and interests of talents, employers and talent agencies, realize the orderly flow and rational allocation of talents, and promote the healthy development of the talent market, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 The term "talent market" as mentioned in these Regulations refers to the sum total of institutions, places and related activities that use market mechanism to carry out talent exchange, allocate talent resources and provide socialized services to talents.

The term "talent market management" as mentioned in these Regulations refers to the management of recruitment, lease, transfer, individual application and related activities of talent agencies. Article 3 The operation of the talent market shall follow the principles of openness, fairness, equal competition, self-employment and self-employment. Article 4 The people's governments at or above the county level shall incorporate the cultivation and improvement of the talent market into the national economic and social development plan, and establish and improve a talent market system with reasonable layout, sound mechanism, standardized operation, thoughtful service and strong guidance and supervision. Fifth people's governments at or above the county level shall formulate feasible preferential policies to attract talents, create a good environment for the orderly flow and rational allocation of talents, and encourage domestic and foreign talents to take various forms to work or serve in this province. Article 6 The personnel administrative department of the people's government at or above the county level shall be in charge of the talent market within its administrative area.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the management of the talent market. Chapter II Talent Agency Article 7 The establishment of a talent agency shall meet the following conditions:

(1) Having a name marked with the word "talent";

(2) Having sound and feasible working rules and regulations;

(3) It has a fixed place, office facilities and a registered capital of not less than100,000 yuan, which is suitable for its business scale;

(four) there are more than five full-time personnel with college education, who have passed the training by the personnel administrative department of the people's government at or above the county level and obtained the corresponding qualification certificates;

(5) Being able to bear civil liability independently;

(6) Other conditions stipulated by laws and regulations.

Article 8 To establish a talent agency, a written application shall be submitted to the personnel administrative department of the people's government at or above the county level, and the relevant materials specified in Article 7 of these Regulations shall be submitted. After examination and approval, we have obtained the License for Talent Intermediary Service and gone through the relevant registration formalities according to law.

Those who use public media to engage in talent information intermediary services shall apply for a talent intermediary service license.

The personnel administrative department of the people's government at or above the county level shall, within 30 days from the date of receiving the application, conduct an audit, and approve it if it meets the conditions; If it does not meet the requirements, it shall notify the applicant in writing and explain the reasons.

Article 9 Foreign companies, enterprises and other economic organizations engaged in talent agency services in this province must establish joint ventures with talent agencies in China in accordance with relevant state regulations, which shall be approved by the personnel administrative department of the provincial people's government and reported to the personnel administrative department of the State Council for the record.

Investors from Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province shall set up talent agencies in this province with reference to the provisions of the preceding paragraph. Article 10 Where a talent agency establishes a branch in this province, it shall obtain the written consent of the original examination and approval authority. This province is approved by the personnel administrative department of the people's government at or above the county level where the branch is located, and other provinces and cities are approved by the personnel administrative department of the provincial people's government. Eleventh personnel administrative departments of the people's governments at or above the county level shall strengthen the daily supervision and management of talent agencies, and implement the annual inspection system of talent agencies' licenses.

The license for talent intermediary service shall be uniformly printed by the personnel administrative department of the provincial people's government, and no unit or individual may forge, alter, lease, lend or transfer it.

Article 12 Where a talent agency changes its registered items or terminates its business operations, it shall go through the formalities of change or cancellation at the original examination and approval authority. Thirteenth talent agencies can carry out the following business after approval:

(a) the collection, collation, storage, release and related consulting services of talent supply and demand information;

(2) talent post registration;

(three) talent recommendation, recruitment, employment, lease and transfer;

(4) Talent cultivation and talent intelligence development;

(5) Holding talent exchange meetings;

(6) Other businesses specified in the License for Talent Intermediary Service. Article 14 To hold a talent exchange meeting, a written application shall be submitted to the personnel administrative department of the people's government at or above the county level, and relevant materials shall be submitted. The relevant personnel administrative department shall make a written reply within fifteen days from the date of receiving the application.

The organizer of the talent exchange meeting shall examine the qualifications of the talent recruitment units participating in the exchange meeting. The main contents of the review include: a copy of the business license or relevant supporting documents, as well as legal person power of attorney, recruitment brochures and other related materials. At the same time, manage all activities in recruitment.

The organizer of the talent exchange meeting shall submit the approval document of the talent exchange meeting issued by the personnel administrative department of the people's government at or above the county level when publishing the advertisement notice of the exchange meeting in the public media. Without the approval of the talent exchange meeting, the public media shall not publish or broadcast the notice of the talent exchange meeting.
