Provisions of Sichuan Province on Safety Management of Small Coal Mines

Article 1 In order to strengthen the safety production management of small coal mines and promote the healthy development of small coal mines, these Provisions are formulated in accordance with People's Republic of China (PRC) Coal Law, People's Republic of China (PRC) Mine Safety Law, the State Council Regulations on the Administration of Township Coal Mines, Measures for the Administration of Coal Production Licenses and other laws and regulations, combined with the actual situation in Sichuan. Article 2 These Provisions shall apply to the safety management of small coal mines within the administrative area of Sichuan Province.

The implementation of safety supervision of small coal mines shall be carried out in accordance with the Regulations of the State Council on Coal Mine Safety Supervision.

The term "small coal mines" as mentioned in these Provisions refers to coal mines with an annual production capacity of less than 60,000 tons. Article 3 People's governments at all levels shall strengthen the safety management of small coal mines, urge relevant departments and small coal mines to implement coal mine safety laws and regulations, and support and assist coal mine safety supervision institutions to carry out safety supervision of small coal mines according to law.

The competent departments of coal industry of the people's governments at all levels shall be responsible for the safety management of small coal mines within their respective administrative areas, and other relevant departments shall perform corresponding management duties within the prescribed scope of duties. Article 4 Small coal mining enterprises shall, in accordance with relevant state laws, regulations and coal mine safety regulations, establish and improve safety production rules and regulations and safety production responsibility system.

The legal representative and mine manager of small coal mines are the first responsible persons for safe production. Article 5 The establishment of small coal mines shall conform to the industrial policies of the state and the technical requirements of the coal industry, and go through the relevant examination and approval procedures according to law. Mines must hold mining licenses and coal production licenses. Mines with irregular licenses are prohibited from engaging in coal production and business activities. Sixth small coal mine production must meet the following basic conditions for safe production:

(a) the mine must have at least two safety exits that can make people pass through the ground smoothly;

(two) the mine must adopt mechanical ventilation, with a complete and independent ventilation system, the main ventilator must be installed on the ground, and the standby motor must be installed to ensure sufficient air volume underground;

(three) mine drainage system should be established to ensure safety in production;

(4) The management and use of mine explosives must comply with the relevant regulations, the permissible explosives and detonators of coal mines that have obtained production licenses must be used for underground blasting, and the mine explosion-proof blaster must be used for underground blasting;

(five) the selection of underground electrical equipment should comply with the relevant provisions of the national coal mine safety regulations, underground electrical equipment must be explosion-proof, lighting must use coal mine explosion-proof lighting;

(6) The selection of hoisting transportation equipment should be reasonable, and the main equipment must be equipped with reliable safety protection devices;

(seven) the mine must be equipped with a sufficient number of gas detectors, oxygen detectors, anemometers and other testing instruments that meet the verification requirements of measuring instruments and a sufficient number of full-time gas inspectors;

(eight) the mine must have a timely reflection of the actual situation of the mining project plan, ventilation system diagram, underground power supply and distribution system diagram and underground control diagram;

(nine) in and out of the mine communication should be smooth;

(ten) small coal mines must be equipped with a technical director with a technical title of technician or above and a certain practical work experience;

(eleven) small coal mines must handle personal accident insurance for underground workers according to law;

(twelve) other conditions stipulated by laws, regulations and state secrecy regulations. Seventh small coal mines that do not have the basic conditions for safe production as stipulated in the preceding article shall be ordered by the coal management department to suspend production for rectification within a time limit. Production can only be resumed after inspection. Overdue rectification, cancellation of coal production license according to law. Article 8 When a small coal mine is closed, closed or scrapped, it shall promptly apply to the competent department of coal industry that originally reviewed the conditions for running the mine, and submit relevant materials and feasible safety shut-in plans according to regulations, which shall be implemented after examination and approval. Article 9 Small coal mines must be mined within the mining scope approved according to law, and sufficient security pillars shall be left in accordance with regulations. Illegal super-layer cross-border mining is prohibited, and mining and destruction of security coal pillars are prohibited. Tenth small coal mines in accordance with the law to extract the special expenses of coal mine safety technical measures, must be earmarked, and shall not be transferred or misappropriated. Eleventh small coal mines must establish safety management institutions, or equipped with a certain number of full-time safety management personnel with on-site experience and safety technical knowledge. Twelfth small coal mines must carry out gas grade appraisal every year; The gas inspection system, gas management system and gas daily report system must be established; Comprehensive measures such as outburst prediction, outburst prevention, effect inspection and safety protection must be taken when mining outburst coal seams. Thirteenth small coal mine managers, special operators and employees must go through the training and examination of qualified coal mine safety training institutions and hold relevant certificates. Fourteenth small coal mines must prepare disaster prevention and treatment plans, and clarify the responsibilities and tasks of relevant personnel in disaster prevention. The disaster prevention plan shall be reported to the administrative department of coal industry of the people's government at the county level for the record. Small coal mine managers must organize mine workers to learn disaster prevention and treatment plans, and ensure that mine workers are familiar with disaster avoidance routes and emergency rescue and self-help measures. Fifteenth small coal mines must sign an ambulance agreement with the mine rescue team and pay the ambulance fee according to the regulations. The mine rescue team shall provide accident rescue, preventive inspection and technical services to small coal mines in accordance with the agreement.
