Chapter 2 Fire Safety Responsibilities

Article 13__ Personnel responsible for fire safety determined by agencies, groups, enterprises, institutions and other units shall perform the following duties:

Article 14__ Municipal and district fire rescue agencies shall determine units that are more likely to have fires and may cause heavy casualties or property losses as fire safety units within their respective administrative regions. High-risk fire units shall be determined by the municipal fire rescue agency in accordance with the law and announced to the public.

Article 16__ Property service enterprises shall perform the following fire safety responsibilities:

Chapter 3 Fire Prevention

Article 19__ The construction of rural roads and buildings shall comply with national fire protection technical standards.

Article 20__ No unit or individual may use fire-fighting water supply facilities without authorization, except for fire-fighting rescue and fire-fighting drills and tests.

The water supply unit shall inspect and maintain the water supply of municipal fire hydrants to ensure its use for fire extinguishing and rescue.

Article 21__ People’s governments at all levels in this city should actively promote the construction of smart fire protection, use modern information technologies such as the Internet of Things and big data to improve fire prevention and control, regional fire risk assessment, fire fighting and rescue and emergency rescue levels.

Article 27__ It is prohibited to smoke or use open flames in places with fire or explosion risks. Article 28__ The decoration of building exterior walls, the use of building roofs and the installation of billboards shall not affect fire prevention, escape and fire fighting and rescue.

Article 29__ Rental houses used for residence shall comply with fire safety requirements.

The lessor is responsible for the fire safety of the rental property. The lessee shall reasonably and safely use the residential building and its ancillary fire protection facilities and equipment, consciously accept and cooperate with the supervision and inspection of relevant departments and the lessor, and avoid behaviors that endanger fire safety.

If a unit rents a house as a collective dormitory for its employees to live in, it must perform fire safety management responsibilities in accordance with regulations.

Article 30__ Places with densely populated areas shall set up videos and warning signs in conspicuous locations or use broadcasts and other forms to remind the public of the following matters:

Article 34__ This city encourages the application of new fire-fighting technologies and products to prevent and eliminate fire hazards.

Article 35__ This city encourages and guides public gathering places other than high-fire-risk units and enterprises that produce, store, transport, and sell flammable and explosive dangerous goods to purchase fire public liability insurance.

This city encourages insurance companies to underwrite fire insurance, establishes a fire risk assessment mechanism, and guides residents to purchase fire insurance.

Chapter 4 Firefighting Organization

Chapter 6 Supervision and Inspection

Article 48__ Township people's governments and sub-district offices should establish and improve work processes such as daily inspections and joint management of fire safety, organize and carry out fire safety inspections, and promptly discover fire truck passages and evacuation passages , safety exits, fire-fighting facilities and other fire safety hazards; verify and deal with fire safety hazards discovered during inspections or reported or complained by the public; and perform fire safety responsibilities stipulated in Article 16 of these Regulations for residential areas where property management is not implemented.

Article 49__ The public security police station shall be responsible for daily fire supervision and inspection and carry out fire protection publicity and education in accordance with the relevant regulations on fire supervision and inspection of the public security department of the State Council.

Article 50__ This city shall establish a fire supervision and management coordination mechanism. Housing and urban-rural development, public security and other departments, fire rescue agencies, township people's governments, and sub-district offices should strengthen cooperation in fire hazard verification, fire accident investigations, penalties for illegal acts, and information sharing.

Article 51__ Relevant departments of the municipal and district people’s governments shall strengthen fire safety credit supervision and share relevant information to the credit information sharing platform in accordance with relevant national and municipal regulations. , implement incentives for trustworthiness and punishment for breach of trust in accordance with the law.

Chapter 7 Legal Responsibilities

Article 52__ If the people's governments at all levels and their relevant departments and fire rescue agencies fail to perform their duties stipulated in these regulations, the people's governments at the same level shall The relevant departments of the government or the people's government at higher levels shall order corrections; if the circumstances are serious, the directly responsible person in charge and other directly responsible persons shall be punished by the competent authority in accordance with the law.

Article 53__ If a property service enterprise fails to perform its fire safety responsibilities, the township people's government or sub-district office shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, the person directly responsible shall be given a warning and punishment.

Article 54__ During the process of fire safety inspection at the construction site, the housing and urban-rural development department found that the construction unit set up employee dormitories in unfinished buildings or allowed employees to stay overnight, etc. It will be handled in accordance with the "Fire Protection Law of the People's Republic of China" and "Construction Project Safety Production Management Regulations".

Article 55__ Anyone who violates the provisions of these regulations and performs construction and maintenance operations with fire hazards such as electric welding, gas welding, gas cutting, painting, grinding wheel cutting, etc. during the operation and use of crowded places shall be punished by The fire rescue agency was ordered to make corrections and the relevant units were fined not less than RMB 5,000 but not more than RMB 50,000.

Article 56__ Anyone who violates the provisions of these Regulations and the rental house used for residence does not meet the fire safety requirements shall be ordered by the township people's government or sub-district office to make corrections within a time limit; if the correction is not made within the time limit, the rental house shall be If the person is a unit, the unit shall be fined not less than 2,000 yuan but not more than 50,000 yuan; if the lessor is an individual, the individual shall be fined not less than 500 yuan but not more than 2,000 yuan.

Article 57__ Anyone who violates the provisions of these regulations and fails to prompt fire safety matters in crowded places shall be ordered by the fire rescue agency to make corrections within a time limit; if the correction is not made within the time limit, a fine of not less than 2,000 yuan and 10,000 yuan shall be imposed A fine of less than RMB 10,000.

Article 58__ Violate the provisions of these regulations by parking electric vehicles in public areas such as walkways, stairwells, and safety exits, charging in prohibited parking areas, or charging electric vehicles If the vehicle charging does not meet the safety requirements for electricity use, the fire rescue agency or the township people's government or the sub-district office will order it to make corrections. If it refuses to make corrections, it will be given a warning or a fine of not more than 1,000 yuan.

Article 59__ If a unit violates the provisions of these Regulations and fails to establish a full-time fire brigade in accordance with the law, the fire rescue agency shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, the principal responsible person shall be punished or punished in accordance with the law.
