If it is necessary to renew the contract, the employer shall apply to the labor administrative department for extending the employment time within 30 days before the expiration of the original contract, and go through the formalities for extending the employment permit after approval. In addition, after the employer terminates the labor contract with the employed foreigner, it shall promptly report to the labor and public security department and return the foreigner's employment certificate and residence certificate. ? If the foreigner is sent to work in China by the headquarters of an overseas employer, it is suggested that the domestic employer and the headquarters clarify the relevant issues of the employee's dispatch, including the dispatch time and salary. Theoretically, the labor contract relationship of foreigners is still established with the headquarters, and it belongs to the labor relationship with the employer. If it is dispatched by the headquarters after consultation with the labor department, the employer does not need to sign a labor contract with the employee, but the overseas dispatching unit will issue corresponding certification materials and indicate the employment period. If the corresponding certification materials are in foreign languages, a Chinese translation shall be provided at the same time, and the translation shall be sealed by the employer. ? Labor disputes between enterprises and employed foreign employees shall be handled in accordance with the Labor Law and the Regulations on Handling Labor Disputes.
