Interim Measures of Hefei Municipality on Social Endowment Insurance for Temporary Workers in Enterprises

Chapter I General Provisions Article 1 In order to further establish and improve the social labor insurance system and relieve the worries of temporary workers in enterprises, these measures are formulated in accordance with the Interim Provisions of the State Council on the Administration of Temporary Workers in Enterprises Owned by the Whole People. Provisions on the Employment of Farmers' Contract Workers in Enterprises Owned by the Whole People and Detailed Rules for the Implementation of Temporary Workers Management in Enterprises Owned by the Whole People in Anhui Province, combined with the actual situation of this Municipality. Article 2 Temporary workers recruited from towns by enterprises owned by the whole people, collective enterprises (excluding township enterprises), foreign-invested enterprises and private enterprises within the administrative area of this Municipality (including cities and counties under its jurisdiction), and contract workers, rotation workers, seasonal workers and temporary workers (hereinafter referred to as temporary workers) recruited from rural areas with the approval of the municipal and county labor administrative departments shall participate in social endowment insurance. Article 3 The municipal and county labor administrative departments shall be in charge of the social endowment insurance for temporary workers in enterprises within their respective administrative areas. The social labor insurance management institution affiliated to the labor administrative department (hereinafter referred to as the social labor insurance management institution) specifically handles the social endowment insurance business of enterprise temporary workers.

The departments in charge of finance, taxation, banks and enterprises should assist the labor administrative departments in doing a good job in social endowment insurance for temporary workers. Chapter II Raising of Endowment Insurance Fund Article 4 Enterprises shall employ temporary workers from cities and towns on the basis of employment certificates and labor contracts; Enterprises from rural areas to recruit temporary workers, should be based on the city and county labor administrative departments of the letter of introduction or work permit, to the enterprise's local social labor insurance management institutions for temporary workers social endowment insurance procedures, and in accordance with the provisions of the payment of endowment insurance premiums. Article 5 The collection standard of temporary workers' old-age insurance in enterprises owned by the whole people and collectively owned enterprises shall be 18% of the total monthly salary of temporary workers for enterprises, and 3% of the basic monthly salary for individual temporary workers. Article 6 The collection standard of China temporary workers' old-age insurance premiums employed by foreign-invested enterprises shall be implemented in accordance with the provisions of Document No.6. Cai (90) No.545 Provincial Department of Finance and Provincial Labor Bureau.

The collection standard of temporary workers' old-age insurance money employed by private enterprises shall be paid by the enterprise according to 18% of the wage standard included in the cost (expense) stipulated by the tax department, and temporary workers shall be paid according to 3% of their actual monthly salary. Article 7 The endowment insurance premiums paid by enterprises shall be withdrawn before tax and charged out of business. The endowment insurance premium paid by temporary workers shall be withheld and remitted by the unit from the personal salary. Article 8 The social endowment insurance fund shall be paid by the enterprise to the social labor insurance management institution on a monthly basis. When necessary, the social labor insurance management institution may also entrust the enterprise's account-opening bank to collect on a monthly basis in the form of entrusted collection. If the payment is not made within the time limit, a late payment fee of 1‰ will be charged on a daily basis. Chapter III Social Pension Insurance Benefits Article 9 The pension insurance items enjoyed by enterprises during the period of temporary workers' pension include:

(1) Living expenses;

(2) Medicaid;

(3) Death and funeral expenses. Tenth urban temporary workers reach the retirement age stipulated by the state, with the "old-age insurance manual" to the social labor insurance management institutions to receive a retirement certificate, with the retirement certificate to receive pension living expenses, enjoy pension insurance benefits. Eleventh urban temporary workers living expenses after retirement, by the social labor insurance management agencies, according to their participation in old-age insurance, monthly or one-time payment:

Twelfth urban temporary workers' medical expenses after retirement are paid by the social labor insurance management institutions according to the following standards:

(a) the monthly pension living expenses, according to the number of years to participate in the old-age insurance, the approved medical expenses are used in a lump sum, and the monthly pension living expenses are paid together.

(two) to receive a one-time pension subsidy, according to the actual number of years to participate in pension insurance, every full year to a month's basic salary, as a one-time medical subsidy. Thirteenth monthly pension living expenses of urban temporary workers died, by the social labor insurance management institutions, a one-time payment to their relatives funeral expenses 500 yuan. Fourteenth temporary workers recruited by enterprises from rural areas shall be dismissed and returned to rural areas after the expiration of the contract. According to the total pension (including interest) paid by the employing enterprises and individuals, the social labor insurance management institution shall give the social endowment insurance fund of the social insurance management institution where the temporary worker's account is located, as a production and living allowance for returning home. Fifteenth temporary workers in the contract period due to work-related and non-work-related deaths, the old-age insurance premium paid by the employer will not be refunded and transferred to the social old-age insurance fund. The endowment insurance money paid by individuals can be returned to the immediate family members of the deceased. Sixteenth temporary workers who enjoy the monthly pension benefits are reeducation through labor or criminal punishment, and the social labor insurance management institution shall stop issuing pension living expenses from the date of reeducation through labor decision or judgment. After the reeducation through labor is released or the sentence is released, the retirement living expenses will continue to be paid. Seventeenth temporary workers in the post by reeducation through labor or criminal punishment, the social endowment insurance premiums paid by their units and individuals will not be refunded and transferred to the social endowment insurance fund.

If a person is still employed as a temporary worker after being released from reeducation through labor or after serving his sentence, the number of years of participating in endowment insurance before and after can be calculated cumulatively, and he can enjoy social endowment insurance benefits according to regulations.
