Provisions of Wuhan Municipality on Fire Control Management

Article 1 In order to strengthen fire control management, prevent and reduce fires, safeguard personal and property safety, and maintain public safety, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Regulations of Hubei Province on Fire Protection and other relevant provisions of the state, and combined with the actual situation of this Municipality.

Article 2 These Provisions shall apply to the fire control management within the administrative area of this Municipality.

Article 3 The Municipal People's Government shall lead the city's fire control work, incorporate the fire control work into the government's annual performance appraisal system, supervise, inspect and assess the performance of the people's government at the next lower level according to law, and ensure that the construction of public fire control facilities, fire control equipment and fire brigade is compatible with the level of economic construction and social development.

The District People's Government (including Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, and East Lake Eco-tourism Scenic Area Management Committee, the same below) is the main body responsible for the fire control work in this area, including the funds for the construction of fire control infrastructure, fire control equipment and fire brigade in this area into the annual financial budget, and organizing fire control work according to the work requirements of the Municipal People's Government.

Article 4 The municipal and district emergency management departments shall supervise and manage the fire control work within their respective jurisdictions, and the daily work shall be carried out by the fire rescue agencies at the same level. Fire rescue institutions shall establish and improve the working cooperation and information sharing mechanism with relevant departments.

Public security, natural resources planning, urban and rural construction, housing management, market supervision, urban management and law enforcement, culture and tourism, education, finance and other relevant departments shall do a good job in fire control management according to their respective responsibilities.

Article 5 Sub-district offices and township people's governments shall establish fire control safety organizations, clarify fire control safety responsibilities, guarantee funds for fire control work, carry out fire control supervision and inspection, organize fire control publicity and education, fire control special projects and fire fighting drills, urge and rectify fire hazards, assist fire rescue agencies to implement fire fighting and rescue, and perform other fire control duties.

Residents' committees and villagers' committees shall determine fire safety administrators and perform fire control duties.

Article 6 This Municipality will incorporate fire safety management into community grid management.

Sub-district offices and Township People's governments shall, under the guidance of fire rescue agencies, organize community workers to carry out basic fire information collection, fire safety inspection, fire safety publicity and other work, and record and report fire incidents in accordance with regulations.

Article 7 Sub-district offices shall set up community miniature fire stations (emergency service stations), set up community volunteer fire brigades, equip them with public fire-fighting equipment such as fire-fighting battery cars and motorcycles, strengthen joint logistics, joint training and joint warfare with fire-fighting and rescue institutions, establish communication and dispatching networks, implement daily maintenance funds, and carry out on-duty inspections, fire fighting and disposal, etc.

Township people's governments should strengthen the construction of village-level volunteer fire fighting teams, equip them with corresponding public fire fighting facilities, and improve the rural fire fighting and fire fighting and rescue capabilities.

Sub-district offices and Township People's governments shall, in accordance with the relevant provisions of voluntary service, give appropriate subsidies to the volunteer firefighters they recruit to participate in fire fighting and rescue, provide corresponding security such as safety, transportation, and eating late, and reward those who have made outstanding contributions.

Article 8 The people's governments at all levels in this Municipality shall establish full-time government fire brigades in accordance with the regulations, and include the construction funds, personnel funds and daily operation funds of the full-time government fire brigade into the fiscal budget at the same level, so as to ensure that the salaries of the full-time government fire brigade personnel are not lower than the average wages of employees in non-private units in cities and towns in the previous year, and establish a dynamic adjustment mechanism according to the economic and social development level of our city.

Ninth district fire rescue agencies should identify the units that may cause fire, heavy casualties or property losses as the key units of fire safety in this area.

The key units of fire safety shall perform the following duties in addition to the fire safety duties stipulated by laws and regulations:

(a) to determine or change the person in charge of fire safety and the manager of fire safety, and report to the local fire rescue agency for the record;

(two) the person in charge of fire safety and the fire safety administrator shall receive fire safety knowledge training at least once a year;

(three) to formulate and improve the fire fighting and emergency evacuation plan, and organize drills at least once every six months;

(four) in accordance with the provisions of the establishment of full-time fire brigade or volunteer fire brigade and other fire control organizations.

Article 10 A small government fire station shall be established in the following places or areas outside the protection radius of the fire rescue station to undertake the fire control work within the specified service area:

(a) crowded places determined by fire rescue agencies;

(2) Construction projects with a construction area of over 500,000 square meters;

(3) Units and industrial parks that produce, store and operate inflammable and explosive dangerous goods.

The special planning and construction standards for small government fire stations shall be formulated by the municipal fire rescue agency in conjunction with the municipal development and reform and natural resources planning department, and shall be implemented after being approved by the Municipal People's government. Special planning should be incorporated into the land and space planning in accordance with the regulations. Small government fire stations shall be built by the municipal fire rescue agencies in accordance with the special fire planning and construction standards, and the special funds for construction shall be included in the municipal and district financial budgets.

Eleventh the following key units of fire safety shall establish small fire stations in accordance with the construction standards to undertake the fire control work of their own units:

(1) A commercial complex with a total construction area of over 200,000 square meters;

(two) production and processing enterprises with a total construction area of more than 500 thousand square meters, which produce and store flammable and combustible materials;

(3) The logistics park covers an area of 6.5438+0.5 million square meters;

(4) The school area is more than 6,543,800 square meters;

(five) the fire risk is great, and it is considered necessary to build it after evaluation and demonstration by fire rescue institutions.

The unit small fire station shall carry out fire inspection, initial fire fighting and other fire fighting work; Accept the dispatching command and business guidance of fire rescue institutions. The construction standards of small fire stations shall be formulated by the municipal fire rescue institutions and announced to the public.

Twelfth fire rescue institutions in this Municipality shall establish a remote monitoring network platform for urban fire protection, and implement real-time monitoring of key units of fire safety.

The key units of fire safety with automatic fire alarm system shall be connected with the network platform of urban fire remote monitoring, and shall not be closed or dismantled without authorization.

Encourage other units to use the Internet of Things technology to improve the efficiency of self-management of fire safety and access the urban fire remote monitoring network platform.

Thirteenth urban rail transit operating units shall abide by the following provisions in addition to performing the duties of key units of fire safety:

(a) the establishment of fire control institutions, the establishment of fire safety management system, the construction unit of fire rescue team, equipped with fire equipment and personnel to adapt to the development of urban rail transit;

(two) the construction of rail transit fire rescue digital wireless communication system, and gradually access to the city's fire rescue digital wireless communication system, and accept the guidance and management of fire rescue agencies;

(3) Keep the entrances and exits, evacuation passages and fire truck passages unblocked, and do not set up shops or temporary stalls in the station halls and platforms without authorization;

(four) to discourage and stop passengers from carrying inflammable and explosive dangerous goods into rail transit facilities such as trains and stations or storing inflammable and explosive dangerous goods in stations;

(five) by radio, television, newspapers, brochures and other means. , to publicize the common sense of fire control, the use of fire control facilities (equipment) and the way to escape;

(six) regularly check the ventilation, smoke exhaust and other fire control facilities to ensure that they are in good condition and effective;

(seven) the operating facilities and advertising facilities in the underground space of rail transit shall use non-combustible materials.

Fourteenth in accordance with the relevant provisions of the state and the province identified as high-risk units of fire, fire safety assessment should be carried out regularly. The fire safety assessment of high-risk fire units shall be conducted by institutions that meet the requirements of employment, and the assessment shall be conducted once a year. The evaluation results shall be made public and reported to the local fire rescue agencies for the record.

Fire risk units should strengthen civil air defense, physical defense and technical defense measures, implement strict fire safety management, and take out fire public liability insurance in accordance with the relevant provisions of the state and the province.

Fire rescue institutions shall, in view of the fire safety assessment of high-risk fire units, urge them to strengthen fire safety work.

Fifteenth property service enterprises shall, in accordance with the provisions of laws, regulations and rules and the provisions of the property service contract, perform the following fire safety duties:

(a) establish and improve the fire safety system, clear fire safety responsible person and manager;

(two) to carry out regular fire safety inspections to eliminate fire hazards;

(three) to formulate fire fighting and emergency evacuation plans and organize drills at least once a year;

(four) to carry out regular publicity and education on fire safety;

(five) the designated parking spaces shall not occupy the passage of fire engines;

(six) other fire duties as prescribed by laws and regulations.

In residential areas without property services, neighborhood offices shall urge and guide residents' committees to organize owners or property users to conduct self-management and implement fire safety responsibilities.

Sixteenth schools and kindergartens should strengthen the management of fire safety, improve fire safety facilities, set up fire safety signs, prompt and carry out fire safety education in a planned way, and carry out self-help and emergency evacuation drills every academic year.

Fire rescue institutions shall guide schools and kindergartens within their jurisdiction to carry out fire safety education and assist in fire safety drills.

Seventeenth construction units shall store, keep and use building materials in accordance with fire safety regulations, and set up temporary fire-fighting facilities such as fire extinguishers, temporary fire water supply systems and emergency lighting in accordance with state regulations.

Construction projects and temporary buildings shall not use building materials whose fire performance does not meet the fire safety requirements. Encourage the use of external wall insulation materials and internal decoration materials higher than the national standards in construction projects.
