I. Scope of application

1. Civil affairs institutions organized by state organs or other organizations that use state-owned assets to undertake social management and service functions, including those whose funding sources are mainly financial allocations, some of which are financially supported and self-financing, shall implement post setting management. Civil affairs institutions mainly include:

(1) Entities for special care and resettlement: special care hospitals (Honorary Military Rehabilitation Hospital, Demobilized Military Chronic Hospital, Demobilized Military Psychiatric Hospital), Glorious Hospital, martyrs memorial building protection units, military retired cadres service management institutions (military retirement places, military retirement service management centers, military retirement service management stations), military supply stations (military catering supply stations, military drinking water supply stations, military reception transfer stations), etc.

(2) Social welfare institutions: social welfare institutions, children's welfare institutions, mental patients' welfare institutions (welfare hospitals), urban elderly service institutions, welfare lottery issuance management institutions, rehabilitation institutions for the disabled registered as institutions, rural five-guarantee support service institutions, prosthetic assembly service centers that have not yet been transferred to enterprises, etc.

(3) Social affairs management units: adoption registration agencies, funeral management services, marriage registration agencies, etc.

(4) Charitable social assistance units: disaster reduction institutions at all levels, rescue management stations, rescue and protection centers for street children, AIDS orphan rescue and resettlement guidance centers, charities, donation receiving institutions, disaster relief reserve warehouses, resettlement farms, etc.

(5) Community service units: community service centers, marriage and family service institutions, etc.

Second, the post category setting

6. Posts in civil affairs institutions are divided into three categories: management posts, professional and technical posts and ground skills posts (hereinafter referred to as the three types of posts).

7. Management position refers to the work that undertakes leadership responsibility or management tasks. The establishment of management posts should meet the needs of civil affairs institutions to improve operational efficiency, work efficiency and management level.

8. Professional and technical posts refer to posts that are engaged in professional and technical work and have corresponding professional and technical level and ability requirements. The establishment of professional and technical posts should conform to the laws and characteristics of civil affairs work and talent growth, and meet the needs of developing civil affairs and improving professional level.

10. According to the social function, responsibilities and tasks, work nature and personnel structure characteristics of civil affairs institutions, the structural proportion of the total number of three types of posts in civil affairs institutions is comprehensively determined.

1 1. The structural proportion of the three types of posts in public institutions shall be determined by the personnel administrative department of the government and the competent department of public institutions. The control standards are as follows:

(1) Civil affairs institutions that provide public welfare social services mainly with professional skills should ensure that professional and technical posts are the main body, and professional and technical posts are generally not less than 70% of the total number of posts in their own units.

For civil affairs institutions with more functions and more complex nature, the structural proportion among the three types of posts can be verified according to the specific circumstances in accordance with the management authority.

Third, the post level setting

(A) management post level setting

12. Management positions are divided into 8 grades. The highest level and structural proportion of management posts shall be determined according to the specifications, scale and affiliation of civil affairs institutions and the relevant provisions and authority of cadre and personnel management.

13. There are three to ten management positions for the current section chief, deputy section chief, section chief, deputy section chief, section chief, clerk and clerk in civil affairs institutions.

15. 16. Professional and technical posts are divided into 13 grades. Senior professional and technical positions are divided into seven grades, namely grades 1 to 7, among which, senior professional and technical positions include grades 1 to 4 and deputy senior positions include grades 5 to 7; Intermediate posts are divided into three grades, namely, eight to ten grades; Junior posts are divided into three grades, namely 1 1 to 13, of which 13 is a rank post.

17. The structural proportion between high, middle and junior professional posts and between different levels within high, middle and junior professional posts in civil affairs institutions shall be controlled according to the development level of regional economic and social undertakings, as well as the functions, specifications, affiliation and professional and technical level of civil affairs institutions.

According to the overall control target requirements of professional and technical personnel in national institutions, according to the present situation of professional and technical personnel in civil affairs institutions, combined with the development needs of civil affairs, the proportion of professional and technical personnel in high, middle and primary positions is reasonably determined.

With regard to the structural proportion of posts at different levels within senior, middle and junior posts in civil affairs institutions, the overall national control targets are: 1:3:6 for posts at the second, third and fourth levels, 2:4:4 for posts at the fifth, sixth and seventh levels, and 3:4:3 for posts at the eighth, ninth and tenth levels.

18. The personnel administrative departments of governments at all levels and the competent departments of civil affairs institutions should strictly control the proportion of professional and technical posts and the total number of senior professional and technical posts. Civil affairs institutions should strictly implement the approved proportion of professional and technical posts.

(3) Ground handling skill post level setting

19. Skilled jobs include skilled jobs and ordinary jobs, among which skilled jobs are divided into five grades, and ordinary jobs are not divided into grades.

20. The highest level and structural proportion of ground skill posts shall be determined according to post level specifications, skill level and work needs.

22. 23. The total number of first-class and second-class positions in ground work skills should be strictly controlled.

Establishment of ad hoc posts

24. Ad hoc posts are approved jobs based on the characteristics and development laws of civil affairs institutions, such as hiring urgently needed high-level talents, and belong to non-permanent posts in civil affairs institutions. The level of special posts is determined according to actual needs and prescribed procedures.

Ad hoc posts are not limited by the total number of posts, the highest level and the structural proportion of civil affairs institutions. After the work task is completed, it shall be written off according to the management authority.

25. The establishment of special posts in civil affairs institutions shall be audited by the competent civil affairs department and reported to the personnel administrative department of the government at or above the municipal level for approval according to procedures. The specific administrative measures shall be formulated by the provinces (autonomous regions and municipalities directly under the Central Government) according to the actual situation.

Four, professional and technical post name and post level

26. Among the social work posts in civil affairs institutions, the names of intermediate professional and technical posts are social work first-class posts, social work second-class posts and social work third-class posts, corresponding to eight to ten professional and technical posts respectively; The names of junior professional and technical posts are the first-class post of assistant social worker and the second-class post of assistant social worker, which correspond to the professional and technical posts of 1 1 to 12 respectively. The name of senior professional and technical positions shall be stipulated separately after the introduction of specific measures for the evaluation of senior social workers.

27. The names and corresponding grades of other professional and technical posts shall be implemented with reference to relevant industry guidance and standards. In principle, use the existing professional and technical names.

28. The professional and technical first-class posts in civil affairs institutions belong to the special-grade posts established by the state, and the determination of their personnel shall be carried out in accordance with the relevant provisions of the state.

(A) the basic conditions of each post

29. The basic conditions of three types of posts in civil affairs institutions are mainly determined according to the duties, tasks and qualifications of the posts. The basic conditions for three types of posts in civil affairs institutions are:

(3) Basic conditions for professional and technical posts

33. The basic qualifications for professional and technical posts in civil affairs institutions shall be implemented in accordance with the relevant provisions of the current national professional and technical post evaluation and engagement.

34. The basic conditions for professional and technical posts in civil affairs institutions to implement occupation qualification access control shall include the requirements of access control.

35. The provinces (autonomous regions and municipalities directly under the Central Government), relevant departments and civil affairs institutions in the State Council, on the basis of the basic conditions for senior, middle and junior professional and technical posts stipulated by the state, formulate specific conditions for professional and technical posts in their own regions, departments and units according to the Guiding Opinions and the actual situation of different types and levels of professional and technical posts.

36. The post conditions of different grades of high, middle and junior professional posts in civil affairs institutions shall be comprehensively determined by the competent departments and civil affairs institutions according to the Trial Measures, the Implementation Opinions and this guidance, and according to factors such as job responsibilities and tasks, professional and technical level requirements.

(four) the basic conditions for the skills of employees.

37. The basic conditions for grass-roots skill posts in civil affairs institutions are:

(1) Level-1 and Level-2 logistics skill posts must have worked in the next level post of this type of work for 5 years, and passed the technical grade evaluation of senior technicians and technicians respectively.

(2) Level 3 and Level 4 skilled workers should have worked in the post at the next lower level of this type of work for 5 years, and passed the technical grade assessment of senior workers and intermediate workers respectively.

(3) Apprentices (interns) who have completed their studies and apprenticeships can be recognized as five-level geotechnical skills posts after passing the examination of the primary technical level.

38. The post setting of civil affairs institutions shall be subject to the examination and approval system, and the audit shall be conducted in strict accordance with the prescribed procedures and management authority.

39. Civil affairs institutions shall set posts according to the following procedures:

(1) Formulate the post setting scheme and fill in the post setting audit form;

(2) report to the competent department for examination and approval according to the procedure, and the personnel administrative department of the government shall put it on record;

(three) to formulate the implementation plan of post setting within the approved total number of posts, structural proportion and the highest level limit;

(6) Organize the implementation.

40. The post setting scheme of civil affairs institutions directly under the Ministry of Civil Affairs shall be reported to the Ministry of Civil Affairs for review and summary, and then reported to Ministry of Human Resources and Social Security for the record.

The post setting scheme of civil affairs institutions directly under the Civil Affairs Department of provinces (autonomous regions and municipalities directly under the Central Government) shall be reviewed by the Civil Affairs Department (bureau) of provinces (autonomous regions and municipalities directly under the Central Government) and submitted to the personnel administrative department of the government of provinces (autonomous regions and municipalities directly under the Central Government) for approval.

42. The post setting scheme of civil affairs institutions directly under the civil affairs department of the prefecture (city) shall be reported to the personnel administrative department of the local (city) government for approval after being audited by the civil affairs department of the prefecture (city).

43. 44. The total number of posts, structural proportion and the highest level of civil affairs institutions should remain relatively stable. Under any of the following circumstances, the post setting scheme may be changed according to the authority of Article 40, Article 42 and Article 43:

(1) Civil affairs institutions need to reset their posts due to division or merger;

(2) according to the official documents of the superior or the organization department at the same level, increase or decrease the organization establishment;

(3) According to the business development and actual situation, it is really necessary to change the post setting in order to complete the work task.

45. The approved post setting scheme is the basis for hiring personnel, determining post grades, adjusting posts and approving salaries.

Seven, post employment

46. Civil affairs institutions shall, in accordance with the "Trial Measures", "Implementation Opinions", this guidance and the approved post setting scheme, determine specific posts, clarify post grades, hire staff and sign employment contracts in accordance with the principles of setting up posts according to needs, competing for posts and employing by posts.

47. Personnel employed by civil affairs institutions shall be selected in accordance with the principles of open recruitment and competitive recruitment and relevant regulations in case of vacancies.

Civil affairs institutions shall, according to the responsibilities, tasks and qualifications of management posts, professional and technical posts and ground skills posts, employ personnel within the approved structural proportion, and the employment conditions shall not be lower than the basic conditions stipulated by the state.

48. Civil affairs institutions with small grass-roots units, few personnel and scattered posts, which implement centralized regulation and management of the proportion of post structure, can implement centralized employment of personnel according to the actual situation.

49. According to the characteristics and actual needs of talents in the field of civil affairs, those who are truly talented, have made remarkable achievements, have made outstanding contributions to civil affairs institutions, are in urgent need of posts and meet the conditions of abnormality, and can be employed in an abnormal manner according to the relevant provisions with the approval of the competent department at the next higher level.

50. After the probation period of the new staff in civil affairs institutions expires, the management personnel shall determine the corresponding post level in accordance with the provisions of the Implementation Opinions; Professional and technical personnel shall determine the post level according to the requirements of post conditions.

Civil affairs institutions that have not implemented the employment system and post management system should pay close attention to post setting, implement the employment system and organize post employment in accordance with the Notice of the General Office of the State Council on Forwarding the Opinions of the Ministry of Personnel on the Trial Employment System in Institutions (No.35 [2002] of the State Council), the Trial Measures, the Implementation Opinions and the guiding opinions.

Civil affairs institutions that have implemented the employment system and signed an employment contract may, according to the Trial Measures, the Implementation Opinions and this guidance, determine the corresponding positions for their existing personnel and change the relevant contents of the employment contract in accordance with the approved post setting scheme.

52. The personnel administrative departments of governments at all levels, the competent departments of civil affairs institutions and civil affairs institutions shall, in accordance with the relevant provisions of the state, enter the posts of corresponding grades according to the positions or positions currently employed.

All regions, departments, and civil affairs institutions must strictly grasp the policies, and must not break through the existing posts in violation of regulations, and must not assault employees or assault posts. It is necessary to strictly limit the setting of senior positions in high, middle and junior professional and technical positions.

53. In principle, personnel employed by civil affairs institutions shall not hold posts in two types of posts at the same time. According to the working characteristics of civil affairs institutions, if it is really necessary to hold concurrent positions, it shall be examined and approved in accordance with the personnel management authority.

54. Civil affairs institutions set up posts and employment posts for the first time, and the proportion of post structure shall not exceed the proportion of existing personnel. If the proportion of existing personnel structure has exceeded the approved proportion, it shall gradually reach the prescribed structural proportion through natural attrition, transfer, low employment or dismissal. Eight, organize the implementation

55. 57. All regions, departments and civil affairs institutions should strictly implement relevant policies and regulations, adhere to principles and adhere to the mass line in job setting and job recruitment. In violation of the provisions of the abuse of power, take revenge, abuse of power for personal gain, to be held accountable. For civil affairs institutions that do not set posts and employ posts according to the Trial Measures, the Implementation Opinions and this guidance, the personnel administrative department of the government, the civil affairs department and the relevant departments will not confirm the post grade, will not cash the salary, and will not allocate funds. If the circumstances are serious, informed criticism shall be given to the relevant leaders and responsible persons, and corresponding disciplinary action shall be given according to the personnel management authority.
