Provisions of Shenzhen Special Economic Zone on Implementing the Regulations on the Administration of Medical Institutions

chapter I general provisions article 1 in order to strengthen the management of medical institutions in Shenzhen special economic zone (hereinafter referred to as the special zone), standardize the practice conditions and medical activities of medical institutions, and promote the healthy development of medical and health undertakings, these provisions are formulated in accordance with the basic principles of the State Council's regulations on the administration of medical institutions and relevant laws and regulations, and combined with the actual conditions of the special zone. Article 2 The medical institutions referred to in these Provisions are clinics, out-patient departments, hospitals and other medical institutions that are run by enterprises, institutions, social organizations, troops or individuals independently or jointly in the Special Zone and face the society. Article 3 Medical institutions must abide by national laws and regulations, follow the purpose of saving lives, preventing and treating diseases and serving citizens' health, abide by the medical and health work system and technical operating rules, abide by medical ethics, adhere to civilized medical practice and ensure medical quality. Article 4 The administrative department of health of Shenzhen Municipal People's Government is the competent department of medical institutions in Shenzhen. The health administrative departments of the municipal and district people's governments shall be responsible for the management and supervision of medical institutions within their respective administrative areas in accordance with relevant administrative regulations and these Provisions.

Chapter II Qualification for Practice Article 5 The Special Zone shall, in principle, implement the qualification examination system for health technicians in medical institutions. Article 6 Health technicians with permanent residence in Shenzhen can take the qualification examination if they meet the above conditions:

(1) They are engaged in medical professional work, and have a college degree or above in medicine or a technical qualification of a doctor or above;

(2) Engaged in auxiliary medical professional work, with technical secondary school education or above in medicine or with technical qualifications such as midwife, pharmacist and technician;

(3) Self-taught to engage in the professional work of traditional Chinese medicine through ancestral teachers, with college degree or above in traditional Chinese medicine or technical qualification above in traditional Chinese medicine. Article 7 Health technicians who do not have permanent residence in Shenzhen can also take the qualification examination if they meet the following conditions:

(1) They are engaged in medical professional work, have a college degree or above in medicine and pharmacy, and have been engaged in medical work in medical institutions established in countries above the city (region) level for more than five years before being employed;

(2) Engaged in auxiliary medical professional work, with technical qualifications such as technical secondary school degree or above in medicine or midwife, pharmacist and technician, and engaged in similar professional work in a medical institution established in a country above the city (region) level for more than one year before employment;

(3) Engaged in the professional work of traditional Chinese medicine through the ancestral teacher's teaching and self-study, with a college degree or above in traditional Chinese medicine or a technical qualification above in traditional Chinese medicine, and engaged in medical work for more than five years before being employed. Article 8 The measures for practicing qualification examination shall be formulated by the municipal public health administrative department, and implemented by the practicing qualification examination committee organized by the municipal public health administrative department.

those who pass the practice qualification examination shall be issued the "Practice Qualification Certificate of Medical Institutions" (hereinafter referred to as "Practice Qualification Certificate") by the municipal health administrative department.

For health technicians with senior health technical titles and legal technical title certificates and those with expertise confirmed by medical practice certificates, the municipal health administrative department may dispense with the qualification examination and directly issue the Qualification Certificate after examination and approval according to their professional counterparts. Article 9 A health technician who has obtained the Qualification Certificate must have a certificate of consent from the original unit, a certificate of retirement, or a certificate of unemployment when practicing in a medical institution. Article 1 Health technicians with medical qualifications in Hongkong, Macao and Taiwan Province who are invited or hired by medical institutions to practice medicine in the Special Zone shall take the qualification examination and obtain the "Practice Qualification Certificate" after being examined and registered by the municipal health administrative department before they can engage in medical work in medical institutions.

Chapter III Examination, Approval and Practice Registration Article 11 Units and individuals that set up medical institutions shall apply to the municipal or district health administrative department in advance, go through the relevant procedures such as practice registration, and obtain the Practice License for Medical Institutions before engaging in medical treatment activities. Article 12 Units and individuals that plan to establish medical institutions must apply to the administrative department of health in advance and submit the following materials: < P > (1) Application;

(2) feasibility analysis report;

(3) site selection, building plan and department setting plan. Article 13 The administrative department of health shall, within 3 days from the date of accepting the application, examine and make a decision on the application for the establishment of hospitals, out-patient departments and clinics according to the regional medical setup planning and regional health development planning, as well as the principles of reasonable layout and appropriate regulation.

For those who meet the requirements, an Approval Letter for the Establishment of Medical Institutions will be issued; If it is not approved, the reasons shall be explained in writing. Fourteenth units or individuals that have obtained the Approval Letter for the Establishment of Medical Institutions may apply to the administrative department of health for practice registration after completing the work of establishing medical institutions.

those who have not obtained the approval for the establishment of medical institutions will not be accepted. Article 15 To apply for the practice registration of a medical institution, the requirements and relevant certification materials to be submitted to the administrative department of health should be:

(1) Conforming to the basic standards of a medical institution and submitting the Approval Letter for the Establishment of a Medical Institution and the certification materials of the basic information of the main person in charge;

(2) Having a suitable name, organization and place, and submitting the property right certificate or legal lease contract of the business premises;

(3) It has funds, facilities, equipment and professional health technicians suitable for its business, and submits a capital verification report, proof of the quality identification and source of facilities and equipment, and relevant certification materials for the qualification of health technicians;

(4) having corresponding rules and regulations;

(5) Being able to bear civil liability independently.

where a citizen partnership or a legal person or a legal person and a citizen jointly establish various medical institutions, a contract and articles of association agreed by all parties shall also be submitted.
