What qualifications does a company need to hire foreigners?

Enterprises with foreign investment can apply directly to the labor department for a license to hire foreigners; State-owned enterprises must be approved by the competent department of industry; A limited liability company needs a registered capital of more than 5 million yuan to hire foreigners.

The Ministry of Labor stipulates that the recruitment of ordinary posts below the deputy general manager will give priority to Chinese people. Therefore, when recruiting such positions, enterprises should choose one of the following two aspects. If they fail to recruit suitable China people, they should recruit foreigners.

One is to publish job advertisements in influential media at least three times, and collect resumes of China people within one month after the last time. If you can't find a suitable candidate, you should submit a recruitment report signed by the general manager to the labor department when applying for hiring foreigners, and provide newspaper samples and resumes of China people with job advertisements.

Second, in the large-scale job fairs above the municipal level recognized by the labor department, no suitable China people can be recruited. When applying for recruiting foreigners, the labor department shall issue the participation certificate, the resume of China people collected at the job fair, and the recruitment report stamped by the organizer of the job fair and signed by the general manager.

Provisions on the Administration of Employment of Foreigners in China Article 9 Foreigners who meet one of the following conditions may be exempted from obtaining employment permits and employment permits:

(1) Foreign professional technicians and managers directly funded by the China government, or funded by state organs and institutions, have senior technical titles or special skills qualification certificates confirmed by authoritative technical management departments or industry associations at home and abroad, and hold the Foreign Expert Certificate issued by the Bureau of Foreign Experts Affairs;
