Measures of Wuhan Municipality on the Administration of Security Service Industry

Article 1 In order to strengthen the management of the security service industry, maintain social order and standardize the service behavior of the security service industry, these Measures are formulated in accordance with the relevant provisions of the state and the actual situation of this Municipality. Article 2 The term "security service industry" as mentioned in these Measures refers to service enterprises engaged in social security prevention, including municipal security service companies and their branches (hereinafter referred to as security companies) and units that produce and sell security uniforms, equipment and signs.

Security companies provide services to customers in the society, with paid services, independent operation, independent accounting and self-financing. Article 3 The public security organ is the competent department of the security service industry. The security service management institution of the public security organ is responsible for the daily management of the security service industry. Article 4 The establishment of a security company shall be reported to the public security organ for approval and registered with the industrial and commercial and tax authorities.

The establishment of security teams and departments within the unit shall go through the registration formalities with the municipal public security organ. Article 5 Security companies may engage in the following security services:

(a) guarding and patrolling organs, organizations, enterprises, institutions, banks, warehouses, bazaars, commercial blocks and public places of entertainment;

(two) currency, valuables and inflammable, explosive, dangerous chemicals and other goods escort or valuables storage;

(three) the security of business exhibitions, exhibitions and entertainment, sports and tourism activities;

(four) fire engineering technical inspection;

(five) the design, construction and maintenance of safety technical prevention facilities, equipment and projects;

(6) Security consultation;

(seven) sales of security equipment such as anti-theft, fire prevention, explosion prevention, alarm and security communication;

(eight) other security services as stipulated by the relevant provisions of the state.

Security companies engaged in the service business specified in the preceding paragraph shall go through the examination and approval procedures in accordance with the relevant provisions of the state. Article 6 Securities companies are prohibited from selling the following items:

(a) Military and police firearms, ammunition and police equipment;

(2) Steel ball guns, simulated pistols, daggers, controlled knives and other instruments;

(3) uniforms and signs of the army, public security organs and other state organs;

(4) Other articles prohibited by the state. Article 7 Where a customer entrusts a security company to provide security services or employs security guards from the security company, both parties shall sign a contract, and perform their obligations and assume responsibilities according to the contract. Eighth security companies to provide security services to implement the principle of voluntariness, and its charging standard is proposed by the municipal security service company and approved by the municipal price department. Article 9 Security companies, security teams and security departments shall not exercise the functions and powers of public security organs and other state organs, and shall not handle public security, criminal cases and economic disputes. Article 10 Security companies shall assist public security organs to stop illegal and criminal acts, strengthen internal management and improve service quality. Article 11 If a securities company violates a contract and causes economic losses to its customers, it shall make compensation in accordance with the contract. Article 12 When recruiting security guards, a security company shall implement the labor contract system and handle social insurance for them according to law. Thirteenth security teams and departments shall accept the professional guidance and supervision of public security organs, and shall not provide security services to the outside world. The appointment of the captain and department of the security team must be approved by the public security organ. Article 14 Security guards should be of good conduct, law-abiding, have a junior high school education or above, be over 18, and be in good health. Security guards must be trained and qualified, and hold a practice license. Fifteenth security guards can carry and use non-lethal defense equipment and communication and alarm equipment in accordance with relevant regulations when performing their duties.

When it is really necessary to use guns, the escort of money, precious materials and personnel guarding banks and important warehouses shall be handled in accordance with the relevant provisions of the Law of People's Republic of China (PRC) on the Control of Guns. Sixteenth security guards in the performance of their duties, found suspicious people, vehicles and articles, you can ask to check the relevant documents. Article 17 If a security guard employed by a security company is injured, disabled or killed in the line of duty, the security company shall handle it in accordance with the relevant provisions of the state on labor protection; Meet the conditions of martyrs, the public security organ shall report to the relevant departments for approval. Eighteenth security guards shall perform the following duties:

(1) Providing security services in accordance with the contract;

(two) found hidden dangers, timely put forward rectification suggestions;

(three) to protect the scene of criminal and public security cases and public security disasters and accidents, and report to the public security organs in a timely manner;

(4) Criminal suspects who are currently handed over to public security organs. Nineteenth security guards must wear uniform security uniforms, signs and security work permits when performing their duties. Twentieth the production and sale of security equipment, uniforms and signs shall be approved by the public security organs. Twenty-first in violation of these measures, the public security organs shall be punished in accordance with the following provisions:

(a) without the approval of the public security organs, unauthorized establishment of security companies, security teams, foreign security services, or unauthorized production and sale of security equipment, uniforms, signs, given a warning, impose a fine of less than 3 times the illegal income, but the maximum does not exceed the fine limit prescribed by the Standing Committee of the provincial people's Congress;

(2) Those who set up a security team or security department without going through the registration formalities with the public security organ, employ the person in charge of the security team or security department without the consent of the public security organ, or employ a person without a security qualification certificate as a security guard shall be given a warning and may be fined 1000 yuan.
