Measures of Nanjing Municipality on Management and Protection of Water Conservancy Projects (revised on 20 17)

Chapter I General Provisions Article 1 In order to strengthen the management and protection of water conservancy projects, ensure the safe operation of water conservancy projects, and give full play to the functions and benefits of water conservancy projects, these measures are formulated in accordance with the People's Republic of China (PRC) Water Law, the Regulations on River Management in People's Republic of China (PRC), the Regulations on the Management of Water Conservancy Projects in Jiangsu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management and protection of water conservancy projects within the administrative area of this Municipality.

The term "water conservancy project" as mentioned in these Measures refers to various projects for the development, utilization, control, deployment and protection of rivers, lakes and underground water sources, including rivers, lakes, dikes, reservoirs, culverts, pumping stations, irrigation areas, ponds, ditches and other projects and their ancillary facilities.

Urban flood control, drainage, water supply and other facilities management, in accordance with the provisions of relevant laws and regulations. Article 3 People's governments at all levels shall strengthen the leadership over the management and protection of water conservancy projects, implement the responsibility system for the safety management of water conservancy projects, ensure the safe operation of water conservancy projects, organize the popularization and application of advanced science and technology, and improve the scientific management level of water conservancy projects. Article 4 The water administrative department of the municipal and district people's governments (hereinafter referred to as the water administrative department) shall be responsible for the management and protection of water conservancy projects within their respective administrative areas.

The water conservancy project management institution established according to law is specifically responsible for the management and protection of water conservancy projects.

The relevant administrative departments shall, in accordance with their respective responsibilities, cooperate with the water administrative departments to do a good job in the management and protection of water conservancy projects. Fifth town people's government, street offices set up grass-roots water conservancy project management institutions, specifically responsible for the town (street) water conservancy project construction, management and protection. Article 6 All units and individuals have the obligation to protect water conservancy projects, and have the right to stop, report and accuse acts that damage water conservancy projects. Operators and managers of water conservancy projects shall accept the supervision and guidance of the water administrative department and be responsible for the safety of water conservancy projects. Chapter II Project Protection Article 7 In addition to the provisions of the Regulations of Nanjing Municipality on the Protection and Management of Flood Embankments, the management scope of the following state-owned water conservancy projects is:

(1) The flood diversion channels of Tongjiang River and Chuhe River, the primary tributaries of Qinhuai River, and their primary tributaries: backwater toe10-20m; Lake approach channel: backwater toe10m. The reach without dike is determined according to the extension of estuary line 12m or the design flood level and the highest flood level in history.

(2) Medium-sized culverts and pumping stations: the upstream and downstream rivers are 200-500m each, and the outer edge of the building is 50-200m each.

(3) Small (1) reservoir: 50- 100 meters from the toe of dam backwater slope, and 30-50 meters from both ends of dam. If the spillway gate is not within the above range, the top of the spillway is at both sides15m.

(4) Irrigation area: 3-5m outside the backwater slope toe of the main canal and 1-3m outside the backwater slope toe of the branch canal.

On the premise of ensuring the safety of flood control, the scope of river management across the urban reach as stipulated in Item (1) of the preceding paragraph is 5 meters outside the backwater slope foot; The river without dike is outside the estuary line12m. Article 8 The scope of protection of state-owned water conservancy projects as stipulated in Article 7 of these Measures is:

(1) River course: 40 meters outside the management scope;

(2) Medium-sized culverts and pumping stations: 50 meters outside the management scope;

(3) Small (1) reservoir: 300m beyond the management scope;

(4) Irrigation area: beyond the management scope10m. Ninth other rivers, ditches, small (2) reservoirs, small culverts, pumping stations and other state-owned water conservancy projects and non-state-owned water conservancy projects management and protection scope, by the District People's government according to the actual situation in accordance with the law. Article 10 The water administrative department shall set up a unified sign in the scope of management and protection of water conservancy projects, and clarify the requirements for management and protection.

It is forbidden to destroy and move the management and protection signs of water conservancy projects without authorization. Article 11 The municipal and district people's governments shall go through the formalities of confirmation and certification for the land requisitioned or allocated within the management scope of water conservancy projects. Twelfth water conservancy project management within the scope of the following acts are prohibited:

(1) Blasting, well drilling and excavation;

(two) unauthorized stacking, earth, sand, buried pipelines or the construction of buildings and structures that affect the safety of water conservancy projects;

(3) Reclamation or planting on slopes, platforms and internal slopes of ditches that affect the safety of dikes;

(four) damage to water conservancy projects and their ancillary facilities;

(5) Driving crawler-type machinery, hard-wheeled vehicles or overweight vehicles on the dam crest, dike crest and traffic bridge of the sluice station, and driving motor vehicles on the dam crest and dike crest without considering the traffic function in the engineering design;

(six) in rivers, lakes, reservoirs, channels and waters to fry fish, poisonous fish and discharge toxic and harmful pollutants;

(seven) dumping earth and stone, waste residue, garbage and other wastes;

(eight) other laws and regulations that endanger the safety of water conservancy projects. Thirteenth in the scope of protection of water conservancy projects, shall not engage in blasting, drilling, quarrying, mining and other activities that endanger the safety of water conservancy projects. Article 14 Water conservancy projects listed in drinking water source protection areas and quasi-protection areas shall be protected in accordance with the Decision of the Standing Committee of Jiangsu Provincial People's Congress on Strengthening the Protection of Drinking Water Sources, the Regulations of Nanjing Municipality on the Protection of Water Resources and other relevant laws and regulations.
