According to the definition of China's Labor Law, child labor refers to teenagers and children under the age of 16 who have labor relations with units or individuals and engage in paid labor or individual labor. A young worker is any worker who is over the age of a child but under the age of 18. State organs, social organizations, enterprises and institutions, private non-enterprise units or individual industrial and commercial households (collectively referred to as employers) shall not recruit minors under the age of 16 (recruiting minors under the age of 16 is collectively referred to as using child labor). (1) If the employing unit uses child labor, the administrative department of labor and social security shall impose a fine of 5,000 yuan per child labor per month; Whoever uses child workers in workplaces where toxic substances are used shall be given a heavier punishment according to the fine range stipulated in the Regulations on Labor Protection in Workplaces where toxic substances are used, or according to the standard of a fine of 5,000 yuan per child. The administrative department of labor and social security shall also order the employing unit to send the child workers back to their parents or other guardians within a time limit, and all the transportation and accommodation expenses required shall be borne by the employing unit. (2) If the employing unit is ordered by the administrative department of labor and social security to make corrections within a time limit in accordance with the provisions of the preceding paragraph, and fails to deliver the child labor to its parents or other guardians within the time limit, the administrative department of labor and social security shall impose a fine of RMB 1 000 per child, and the administrative department for industry and commerce shall revoke its business license or the civil affairs department shall cancel the registration of private non-enterprise units; If the employing unit is a state organ or institution, the relevant unit shall give administrative or disciplinary sanctions of demotion or dismissal to the directly responsible person in charge and other directly responsible personnel according to law. (3) If a unit or individual introduces 16 minors to work, the administrative department of labor and social security shall impose a fine of 5,000 yuan per introducer; If an employment agency introduces a job to a minor under the age of 16, the administrative department of labor security shall revoke its employment introduction license. (4) If the employing unit fails to keep the employment registration materials in accordance with Article 4 of the Provisions on Prohibiting the Use of Child Labour, or forges the employment registration materials, the administrative department of labor and social security shall impose a fine of 6,543,800 yuan. (5) Units that have no business license and whose business license has been revoked according to law, as well as units that use child labor or introduce child labor for employment without registration according to law, shall be fined twice the above standards, and illegal units shall be banned by relevant administrative departments. (6) If a child is sick or injured, the employer shall be responsible for sending him to a medical institution for treatment, and bear all medical and living expenses during the treatment. If a child is disabled or killed, the business license of the employing unit shall be revoked by the administrative department for industry and commerce or the registration of private non-enterprise units shall be revoked by the civil affairs department; If the employing unit is a state organ or institution, the relevant unit shall give administrative or disciplinary sanctions of demotion or dismissal to the directly responsible person in charge and other directly responsible personnel according to law; The employing unit shall also give one-time compensation to the immediate family members of disabled child workers or dead child workers, and the amount of compensation shall be calculated in accordance with the relevant provisions of the state industrial injury insurance. (7) Whoever abducts and sells child labor, forces child labor, uses child labor to engage in high altitude, underground, radioactive, highly toxic, flammable and explosive labor with the fourth level of physical labor intensity stipulated by the state, uses child labor under the age of 14, or causes child labor death or serious disability, shall be investigated for criminal responsibility in accordance with the provisions of the Criminal Law on crime of trafficking in children, the crime of forced labor or other crimes. Because there are many local electronics factories and other big factories in Shenzhen that need to recruit a lot of assembly workers at the grass-roots level, some of these grassroots workers may be under 18 years old, but the labor law stipulates that child labor is not under 16 years old, so if the person concerned is over 16 years old in Shenzhen, but under 18 years old, it cannot be regarded as child labor.
