The basic contents of "Xi Construction Waste Management Measures":

Article 1 In order to strengthen the management of construction waste and maintain the city appearance and environmental sanitation, these Measures are formulated in accordance with the relevant provisions of the Regulations on the Administration of City Appearance and Environmental Sanitation in Xi and in combination with the actual situation of this Municipality.

Article 2 The term "construction waste" as mentioned in these Measures refers to muck, waste soil, waste materials, sludge and other wastes generated in the construction process of buildings, structures, landscaping, municipal facilities construction, maintenance and sporadic maintenance.

Article 3 These Measures shall apply to the management of construction waste in the administrative areas of Xincheng, Lianhu, Beilin, Yanta, Weiyang, Baqiao and Chang 'an.

Article 4 The administrative department of city appearance and environmental sanitation of Xi is the competent department of construction waste management in this Municipality. The administrative department of city appearance and environmental sanitation in District 7 is responsible for the management of construction waste within its jurisdiction.

Planning, construction, land, environmental protection, transportation and other departments shall, in accordance with their respective responsibilities, cooperate in the management of construction waste.

Ninth units engaged in construction waste transportation must apply to the municipal administrative department of city appearance and environmental sanitation for the qualification certificate of construction waste transportation. Units applying for the qualification certificate of construction waste transportation shall meet the following conditions:

(a) the unit transport construction waste vehicles must meet the unified standards of construction waste removal vehicles;

(2) The approved deadweight tonnage of the vehicle shall be above100t.

Tenth construction waste transportation qualification examination system. Units that fail to pass the annual examination cancel the qualification of construction waste transportation.

Eleventh units that transport construction waste shall hold the construction waste transport license issued by the municipal administrative department of city appearance and environmental sanitation. Twelfth transport units should do the following when transporting construction waste:

(1) Loading and consumption at the designated place;

(five) vehicles carrying construction waste transport permits;

Thirteenth construction waste disposal sites shall conform to the overall land use planning and urban planning. According to the principle of rational layout, two construction waste disposal sites, 1-2, were set up in Lianhu, Yanta, Weiyang, Baqiao and Chang 'an respectively. The establishment and management of construction waste disposal sites shall be the responsibility of the District People's Government. The established construction waste disposal site shall be filed with the municipal administrative department of city appearance and environmental sanitation.

The construction waste disposal site shall provide paid services, and the charging standards shall be implemented in accordance with the standards approved by the price department.

Fourteenth construction waste disposal sites shall meet the following conditions:

Article 16 Before the construction waste disposal site ceases to be used, the unit that set up the construction waste disposal site shall, in accordance with the urban planning, return farmland, do a good job in greening or building mountains, and report to the municipal administrative department of city appearance and environmental sanitation for the record.

Seventeenth residents due to decoration, construction, maintenance of housing and other sporadic construction waste, according to the property management unit or neighborhood designated place to pile up; Property management units or neighborhood committees are responsible for cleaning up, and entrust qualified transport units to transport construction waste for paid removal.

Eighteenth in violation of the provisions of these measures, the construction site accumulated garbage is not cleaned up in time, shall be ordered to clean up immediately, and impose a fine of 1000 yuan.

Nineteenth in violation of the provisions of these measures, the construction site is not closed in accordance with the provisions, the entrance is not hardened, and there is no corresponding washing facilities, shall be ordered to make corrections, and impose a fine of 2000 yuan.

Twentieth in violation of the provisions of these measures, not in the designated construction waste disposal site discharge of construction waste, shall be ordered to immediately stop the discharge and clean up the garbage, according to the amount of garbage discharged, the discharger shall be fined per cubic meter 100 yuan.

Article 21 Whoever, in violation of the provisions of these measures, entrusts vehicles without construction waste transportation qualification to transport construction waste shall be ordered to make corrections and be fined 1000 yuan.

Twenty-second in violation of the provisions of these measures, without obtaining the qualification to transport construction waste, unauthorized removal of construction waste, shall be ordered to immediately correct, and impose a fine of 2000 yuan.

Twenty-third in violation of the provisions of these measures, not according to the prescribed time and route transportation of construction waste, vehicle tires with mud into urban roads and carrying construction waste is not closed, covered, shall be ordered to make corrections, and impose a fine of more than 2000 yuan in 500 yuan. Twenty-fourth in violation of the provisions of these measures, the unauthorized establishment of construction waste disposal sites, shall be ordered to make corrections within a time limit and impose a fine of 20000 yuan.

Twenty-fifth in violation of the provisions of these measures, in the construction waste dump receiving domestic garbage and toxic and hazardous waste, shall be ordered to make corrections. If no correction is made within the time limit, a fine of 5000 yuan will be imposed, and the qualification of the construction waste disposal site will be revoked.

Article 26 Whoever, in violation of the provisions of these measures, alters, forges, lends, rents or buys or sells special vehicle signs or construction waste removal certificates shall be fined 1 0,000 yuan.

Twenty-seventh staff members of administrative authorities who neglect their duties, abuse their powers, engage in malpractices for selfish ends and accept bribes shall be investigated for administrative responsibility according to law; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.

Twenty-eighth hinder administrative staff and law enforcement officers to perform official duties, if the circumstances are serious, shall be investigated for responsibility according to law.

Twenty-ninth citizens have the right to stop acts in violation of these provisions, and have the right to report acts in violation of these provisions to the relevant administrative departments. If the report is true, the relevant administrative departments shall reward it.
