When the house is sold, who will bear the arrears of property fees?
Legal analysis: after the second-hand house is sold, if there is no clear agreement in the contract, the property fee owed by the original owner should be borne by the original owner. If the original owner fails to pay the property service fee within the time limit, the property service enterprise may bring a lawsuit to the people's court. According to Article 64 of the Property Management Regulations, if the owner fails to pay the property service fee within the time limit in violation of the property service contract, the owners' committee shall urge him to pay it within a time limit; If it fails to pay within the time limit, the realty service enterprise may bring a lawsuit to the people's court.
Legal basis: Article 728th of the Civil Code of People's Republic of China (PRC). If the lessor fails to notify the lessee or there are other circumstances that prevent the lessee from exercising the preemptive right, the lessee may request the lessor to bear the liability for compensation. But it does not affect the validity of the house sales contract concluded between the lessor and the third party.
