Provisions of Zhongshan Municipality on the Administration of Housing Safety

Article 1 In order to strengthen the housing safety management in this Municipality, prevent and reduce the occurrence of housing safety accidents, and protect the life and property safety of natural persons, legal persons and other organizations, these Provisions are formulated in accordance with the provisions of the Regulations on the Administration of Dangerous Houses in Cities, the Regulations on Property Management in Guangdong Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "house safety management" as mentioned in these Provisions refers to the management to ensure the safe use of building structures, including house safety use, house safety appraisal, dangerous house management, house emergency rescue, house termite control, etc.

Housing safety appraisal refers to the activities that the housing safety appraisal unit conducts appraisal and comprehensive evaluation of the housing safety status according to the contract signed with the entrusting party and the current appraisal standards or regulations of the country, industry or place.

Dangerous houses refer to houses that have been appraised by the housing safety appraisal unit and have a safety grade of C or D according to the relevant national standards or industry standards, and may lose structural stability and bearing capacity at any time. Article 3 These Provisions shall apply to the safety management of houses built and registered according to law within the administrative area of this Municipality, houses that have not been registered for ownership but have been recognized as legal buildings, and temporary buildings that have not exceeded the approval period.

Where there are other provisions in laws and regulations on the housing safety management of the army, religious groups, cultural relics protection units, scenic spots and nature reserves, those provisions shall prevail.

The fire safety of houses, the use safety of facilities and equipment, the interior decoration of houses and the safety management in the process of house expropriation shall be implemented in accordance with relevant laws, regulations and rules. Fourth city housing and urban and rural construction departments are the administrative departments in charge of housing safety management, responsible for organizing the implementation of these provisions. Torch Development Zone Management Committee, Cuiheng New District Management Committee, town government and sub-district offices (hereinafter referred to as towns) are specifically responsible for the housing safety management within their respective jurisdictions.

Land and resources, urban and rural planning, finance, public security, safety supervision, justice, industry and commerce, environmental protection, education and sports, health and family planning, urban management and law enforcement, power supply, water supply, gas supply, community neighborhood committees (village committees) and other competent departments and relevant units and organizations shall, according to their respective functions and duties, coordinate the implementation of these Provisions. Fifth housing safety investigation, special inspection, emergency inspection funds should be included in the city, town housing and urban and rural construction institutions work budget.

Housing appraisal, dangerous housing management, requisition, housing emergency rescue and other expenses shall be borne by the township finance, and shall be spent in the special funds for the management of dangerous houses in the towns where the dangerous houses are located, and the municipal finance shall give appropriate subsidies. Specific measures shall be formulated by the municipal housing and urban-rural construction department in conjunction with the municipal finance department. Article 6 Units, individuals, trade associations and other organizations engaged in activities related to housing safety management within the administrative area of this Municipality shall abide by these Provisions. Chapter II Responsibility and Use of House Safety Article 7 The owner of the house is the person responsible for house safety, and the confirmation of the owner of the house shall be subject to the records in the house register. Natural persons, legal persons and other organizations that have not registered the ownership of the house but have legally occupied the house shall be regarded as the owner of the house in any of the following circumstances:

Legal interpretation;

(two) the effective legal documents of the people's court and the Arbitration Commission;

(three) the sale, inheritance, bequest and other legal acts;

(four) the owner of the house as recognized by laws and regulations.

If the owner of the house is missing or the ownership of the house is unclear, the custodian shall be the person responsible for the safety of the house; If there is no custodian, the actual user of the house is the person responsible for housing safety.

The legal representative or principal responsible person of the unit shall be responsible for the housing safety of the unit. Article 8 The person in charge of housing safety shall bear the following safety responsibilities for the building structure and its ancillary facilities and equipment:

(a) regular inspection, maintenance and repair;

(two) the existence of security risks of housing, housing safety appraisal or governance is not timely;

(three) other necessary obligations and measures to ensure the safety of housing use. Ninth property management companies should carry out the following work in the safe use of houses that have been implemented property management:

(a) to carry out publicity on the safe use of houses;

(two) regularly check the safety status of the common parts of the house and the facilities and equipment used in the house. If there are potential safety hazards, organize the appraisal and maintenance according to the agreement of the property service contract;

(three) according to the laws, regulations and rules of the state or Guangdong Province on the management of residential interior decoration, the management of residential interior decoration activities in the property service area;

(four) other necessary obligations and measures to ensure the safety of housing use. Tenth city housing and urban and rural construction departments, towns should be in accordance with their respective responsibilities, to carry out the following housing safety management:

(a) the organization of housing safety inspection, the establishment of housing safety information management system;

(two) the establishment of housing safety management files, and urge the responsible person of housing safety to identify or manage according to the regulations;

(three) to supervise the activities of industry organizations related to housing safety management, and guide industry organizations to give full play to the role of industry management;

(four) to assist the municipal government in organizing and directing the emergency rescue of sudden housing accidents;

(five) to organize housing safety publicity and housing emergency drills;

(six) other housing safety management work as stipulated by laws and regulations.
