Public maintenance funds must be often heard in the real estate industry. The so-called public * * * maintenance fund is used for the maintenance of public equipment in the community, mainly used for the maintenance, renewal and transformation of residential * * * use parts and facilities after the warranty period expires. Residential * * * use parts include load-bearing walls, roofs and outdoor walls, hallways, staircases, corridors, etc.
Maintenance fund use:
1, general facilities
The public facilities in the community are all used by everyone. If it is used frequently and for a long time, these facilities will be easily damaged. General facilities include elevators, antennas, street lamps, lighting, fire-fighting facilities, green spaces, roads, ditches, pools, wells, non-operating parking garages, public cultural and sports facilities, garbage bins, garbage passages, septic tanks, smoke exhaust passages, pumps, water tanks, mailboxes, lightning protection devices, fire-fighting equipment, fire hydrants, drainage pipes and inspection wells.

According to the relevant provisions of the Measures for the Management of Maintenance Funds for Residential Facilities and Equipment jointly issued by the Ministry of Housing and Urban-Rural Development and the Ministry of Finance:
(1) When selling commercial housing, the buyer and the sales unit shall sign a house maintenance fund payment agreement, and the buyer shall pay the house maintenance fund to the sales unit according to the proportion of 2-3% of the purchase price.
(2) The maintenance fund collected by the selling unit belongs to all owners and is not included in the residential sales income.
(3) The current deposit standards for the first-phase special maintenance funds are: 90 yuan /m2 for high-rise buildings (including multi-storey buildings with elevators) and 50 yuan /m2 for multi-storey buildings (including villas).
Third, the consequences of default on property fees.
If the owner is sued for not paying the property fee, the court will mediate. If the mediation fails, the owner will be sentenced to pay the property fee and refuse to perform. Property companies can apply for compulsory execution.
In practice, the owner will not immediately file a lawsuit against the owner because of the arrears of property fees. Generally speaking, litigation will be considered after the following steps:
1. If the owner defaults on the property fee, the property will generally be urged in time after it is discovered;
2. If the owner fails to pay again within a reasonable time, the property may notify the owners' committee to assist in collection;
3. If the owner still fails to pay within a reasonable time, the property will consider charging the property fee and claim compensation through litigation.
