There must be an agreement between the property and the owner. Generally speaking, the property management company will sign a property management contract with the owners' committee, and it is also possible to sign a property management contract with the owners themselves, which is legal. Even if the property management company does not sign a written property management contract with the owner (committee), as long as the property management company serves the owner and provides property management services for the residential property, the de facto contract between the two parties will be established.

If there is a contractual relationship between the owner and the property management company, the property management company can sue the owner when the owner fails to pay the property management fee. At the same time, if the property management company fails to provide qualified services, the owners can also sue the property management company, but they cannot refuse to pay the property management fee.
