Decoration related laws and regulations
First, what are the laws for decoration?
The law of family decoration is mainly "Building Law", and the regulation is mainly "Measures for the Administration of Residential Interior Decoration".
The "Measures for the Administration of Residential Interior Decoration" was discussed and passed at the 53rd executive meeting of the Ministry on February 26th, 2002, and came into force on May 1 2002.
Chapter I General Provisions
Article 1 These Measures are formulated in accordance with relevant laws and regulations in order to strengthen the management of interior decoration of residential buildings, ensure the quality and safety of decoration projects, and safeguard public safety and public interests.
Article 2 The supervision and management of residential interior decoration activities in this Municipality shall abide by these measures. The term "residential interior decoration" as mentioned in these Measures refers to the construction activities of the owner or user of the house (hereinafter referred to as the decoration person) to decorate the residential interior after the house is completed and accepted.
Article 3 The interior decoration of residential buildings shall ensure that the project quality and safety meet the mandatory standards for project construction.
Article 4 The administrative department of construction in the State Council is responsible for the management of residential interior decoration activities throughout the country. The people's construction administrative departments of provinces and autonomous regions shall be responsible for the management of residential interior decoration activities within their respective administrative areas. The people's real estate administrative departments of municipalities directly under the central government and counties shall be responsible for the management of residential interior decoration activities within their respective administrative areas.
Chapter II General Provisions
Fifth residential interior decoration activities prohibit the following acts:
(a) without the consent of the original design unit or the design unit with corresponding qualification grade, the design scheme of changing the main body and load-bearing structure of the building is put forward;
(2) Changing rooms or balconies without waterproof requirements into bathrooms and kitchens;
(3) Enlarge the original size of doors and windows on the load-bearing wall, and dismantle the brick-concrete wall connecting the balcony;
(four) damage to the original energy-saving facilities of the house to reduce the energy-saving effect;
(five) other acts that affect the safety of building structure and use.
The term "building subject" as mentioned in these Measures refers to the structural structure of the building entity, including the beams and columns of the roof Gai Lou cover, and the connection nodes between the load-bearing wall and the foundation. The term "load-bearing structure" as mentioned in these Measures refers to the main structural members that directly transfer their own weight and various external forces to the foundation, and their connection nodes include the suspension cables of the column frame, supporting pier, floor beam and roof truss of the load-bearing wall.
Article 6: Without approval, the decorator shall not engage in the following activities:
(1) Building buildings and structures;
(two) to change the facade of the house and open the doors and windows on the non-load-bearing external wall;
(3) Dismantling heating pipelines and facilities;
Second, what are the legal provisions for the time of house decoration?
House construction and decoration have regular time, and the working hours during the day are: 8: 00- 12: 00, 14: 30- 18: 00.
According to the Notice of the Bureau of Land and Resources [20065438+0] No.488 on Further Strengthening the Management of Residential Property Decoration in this Municipality, property companies should strengthen the daily inspection and supervision of residential decoration activities. When the owner and user move in, they should urge the owner, user or construction unit to observe the construction operation time, from Monday to Friday 18:00 to 08:00 the next morning. Knocking, chiseling, sawing, drilling and other construction activities that produce serious noise are not allowed from noon 12:00 to noon 14:30 and holidays. Especially during the senior high school entrance examination and college entrance examination, except for emergency repairs, it is forbidden to engage in noise-producing decoration activities in areas where noise-sensitive buildings are concentrated. The specific time and regional scope shall be announced by the municipal and county people's governments. Once the citizens encounter the problem of decoration disturbing the people, they can request the owners' committee to deal with it according to the owners' convention, or they can complain to the relevant law enforcement departments or bring a lawsuit to the people's court according to law.

Three, residential housing decoration matters needing attention
(a) decoration must be declared.
1. If the owner (user) needs to decorate the property where he lives, he must first apply to the property management company (the user must hold the owner's power of attorney and lease contract when submitting the application).
2. The property management company shall first confirm the information of the owner (user), and then provide the owner (user) with the decoration guide and related materials (atlas and forms) after confirmation.
3. After receiving the decoration guide and related materials, the owner (user) should ask the relevant design department to carry out decoration design as soon as possible, and select the appropriate construction unit. Then go to the property company to get the relevant forms to fill in the card, and hand over the completed application form and design scheme to the property company.
(2) Examination and approval
After receiving the decoration application, the property management company shall examine and approve it according to the information provided by the owner (user).
1. The owner (user) shall ensure that the decoration scheme does not violate the regulations. If there is any change in violation of laws and regulations, it shall be corrected immediately, and the required expenses shall be borne by the owner (user).
2. Within one month after receiving the submitted decoration scheme, the company must make a reply after deliberation, whether to agree with the scheme submitted by the owner (user) or to propose amendments to the scheme to meet the requirements of the property management company. Any resubmitted plan must still be implemented according to the original prescribed procedures.
3. The property management company charges the professional services provided by the owners (users) in the examination and approval and management of decoration schemes and decoration projects.
4. The renovation plan can only be implemented after it is finally approved by the property company. After the scheme is passed, the owner (user) pays a decoration deposit of several yuan per square meter to the financial department of the property management company and gets the decoration permit.
(3) Construction according to regulations
In order to ensure the quality standard of the residential area (building), the construction team hired by the owner (user) must go to the property management company for the record. The property management company has the right to review the qualification of the decoration contractor, and all construction must be carried out in accordance with the plan approved by the property management company, and there shall be no changes. If there are special circumstances that need to be changed, it must be reported to the property company for approval, and the construction can be started only after a change notice is issued.
(4) Having passed the acceptance.
After the renovation project is completed, the owner (user) will notify the property management company, and the relevant departments of the property management company will send people to check and accept it. If the project is large in scale, it can be completed and accepted as a single project, or it can be carried out separately before the completion of all projects. It should be noted that:
1. The owner (user) shall apply to the fire department for acceptance of the fire control reconstruction project, and provide the property management company with a certificate of conformity after passing, and the property management company shall check whether it meets the general regulations and requirements of the residential area (building).
2. After the completion acceptance, the property management company will issue a completion acceptance form to the owner (user). If the acceptance is unqualified, it shall be corrected within a time limit and re-accepted until it is qualified.
3. After the owner (user) goes through the necessary formalities with the property management company with the completion acceptance form, he/she goes to the financial department to receive the decoration deposit and pay the relevant special expenses.
