After the establishment of the community owners' congress, the owners' congress can dismiss the pre-realty service enterprises in advance in accordance with legal procedures, and re-hire other realty service enterprises to provide property management services for the community owners. If the realty service enterprise in the early stage fails to comply with the law, refuses to withdraw from the realty management community or hand over the realty management space and related materials, the owners' committee may take the following measures:

(2) Bring a lawsuit to the people's court with jurisdiction, ask it to quit within a time limit, and compensate for the losses caused to the owner. Article 10 of the Supreme People's Court's Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Property Service Disputes clearly stipulates that after the termination of the rights and obligations of the property service contract, the people's court shall support the property service enterprise's request to withdraw from the property service area and hand over the property service place and related facilities, as well as the relevant materials necessary for property service and the special maintenance funds entrusted by it.
