Regulations of Hunan Province on Comprehensive Urban Management

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this province in order to strengthen the comprehensive urban management, standardize the comprehensive law enforcement behavior and build a civilized and livable city. Article 2 These Regulations shall apply to the implementation of comprehensive urban management in cities, built-up areas and other areas determined by the people's governments of cities, autonomous prefectures and counties (cities, districts) divided into districts within the administrative region of this province. Article 3 The scope of comprehensive urban management includes: city appearance and environmental sanitation management, landscaping construction and maintenance management, operation management of municipal public facilities, other management matters determined by the people's governments of cities, autonomous prefectures and counties (cities, districts) according to law, and comprehensive law enforcement. Article 4 Comprehensive urban management adheres to the principles of people-oriented, governance according to law, source governance, consistency of rights and responsibilities, and collaborative innovation. Article 5 The people's governments at or above the county level shall strengthen their leadership over the comprehensive urban management, establish and improve the coordination mechanism, and rationally divide the responsibilities of relevant government departments in the comprehensive urban management.

The people's government of a city shall incorporate the funds for comprehensive urban management into the fiscal budget at the same level, and adapt to the speed and scale of urban development. The competent department of urban management of the sixth provincial people's government is responsible for the business guidance, organization and coordination, supervision and inspection of the comprehensive urban management in the province.

The people's governments of cities, autonomous prefectures and counties (cities, districts) with districts shall integrate the functions related to urban management, such as municipal utilities, city appearance and sanitation, landscaping, urban management and law enforcement, and set up a comprehensive law enforcement department for urban management (hereinafter referred to as the urban management department).

The urban management departments of cities divided into districts and autonomous prefectures are responsible for the guidance, coordination and supervision of comprehensive urban management within their respective jurisdictions, as well as the investigation and handling of major and complex illegal cases across regions.

The specific management contents, law enforcement matters and areas of the urban management departments of cities divided into districts and municipal districts shall be determined by the municipal people's government divided into districts.

The urban management department of the Municipal People's Government may send law enforcement agencies or law enforcement personnel to the streets (towns). Article 7 Special plans for municipal public facilities such as city appearance and environmental sanitation, landscaping, underground pipelines, urban lighting, water supply and drainage, gas supply, sewage treatment, urban roads and bridges, refueling and charging facilities, public toilets, public parking lots, etc. shall be formulated by the planning departments of the people's governments of cities, autonomous prefectures and counties (cities) with districts in conjunction with relevant departments according to law and implemented after being approved by the people's governments at the same level. Eighth districts of the city and county (city, district) people's government should establish and improve the digital city comprehensive management platform, improve the level of city comprehensive management information. Article 9 The people's governments of cities and counties (cities, districts) divided into districts may promote the market-oriented operation of urban municipal infrastructure and municipal public utilities by purchasing services or franchising. Article 10 Community residents' committees shall improve community public service facilities, formulate and implement community residents' conventions, etc. , enhance the autonomy function of the community in the comprehensive urban management, and guide community residents to participate in the comprehensive urban management activities. Community residents, owners' committees, property service units and community residents' committees have the right to discourage acts that violate the laws, regulations and rules of urban comprehensive management; If dissuasion is ineffective, the realty service unit and the community residents' committee shall report to the urban management department in a timely manner and assist in handling it.

Citizens, legal persons or other organizations can participate in urban comprehensive management activities by participating in voluntary service activities of urban comprehensive management and fulfilling the responsibility of city appearance and environmental sanitation in front of street shops, and make criticisms and suggestions on urban comprehensive management in various ways. Article 11 The people's governments of cities, autonomous prefectures and counties (cities, districts) divided into districts and their relevant departments shall carry out education on urban civilization, publicize the construction of social integrity, promote social morality, guide citizens to consciously abide by the laws, regulations and rules on comprehensive urban management, and improve the degree of urban civilization. Chapter II Administration of City Appearance and Environmental Sanitation Article 12 The administration of city appearance and environmental sanitation adopts the system of responsibility area. The urban management department shall reasonably delimit the area of responsibility, and clarify the responsible person, responsible matters and supervision units. Thirteenth city roads should be cleaned in time and kept clean and smooth.

It is forbidden to build buildings (structures), set up stalls and engage in other encroachments in violation of regulations on non-motor vehicle lanes and sidewalks of urban roads.

Street shop operators are not allowed to pile up, operate and operate outside the shop. Fourteenth city street buildings (structures) facade and roof should meet the standards of city appearance, regular maintenance and cleaning. Fifteenth outdoor advertising should meet the standards of advertising planning and city appearance, and the person in charge of management should strengthen management, regular maintenance and cleaning.

No unit or individual may hang, post, scribble, depict or distribute advertisements in outdoor public places such as roads and squares that affect the city appearance and environmental sanitation. Sixteenth districts of the city and county (city, district) people's government should build a sound garbage collection and treatment facilities, garbage treatment and recycling.

Citizens and property services and other units shall put domestic garbage in accordance with the standards and requirements of garbage classification. Dining halls (canteens) of catering business units, organs, enterprises and institutions shall deliver the kitchen waste to qualified units for transportation and disposal.

Medical, health, electronic, radioactive and other wastes that need special treatment shall be treated in accordance with the provisions of relevant laws, regulations and rules.
