Overhaul fund needs to be handed over to developers, and many developers will have accounts. But now all localities are basically managed by the Housing Authority, or owners' committees are established. The owners' committee shall set up a special account in the designated bank, transfer the maintenance funds to the special account and use them according to the regulations, and the relevant departments of the Housing Authority shall implement them. Overhaul fund must pay it. The first housing maintenance fund is a special housing maintenance fund, and the owner needs to pay the maintenance fund before handing over the house. The owner can choose to deposit directly into the special maintenance fund account of the house, or entrust the developer to deliver it on his behalf. If it is for the developer to pay, then the developer needs to deposit the money into the special housing maintenance fund account within one month after receiving the maintenance fund. According to the law, if you don't pay the housing maintenance fund, you can't go through the normal handover procedures, and buyers can't hand over the house. The housing maintenance fund is mainly used for the maintenance and conservation of public parts, facilities and equipment in the community, and is supervised by the community property and owners' committee. If it is to be used, it must be approved by two-thirds of the owners.

Article 22

Before the special maintenance funds for houses are handed over to the owners' congress for management, if the special maintenance funds for houses need to be used, it shall be handled in accordance with the following procedures:

(a) the realty service enterprise puts forward suggestions according to the maintenance and renovation projects;

If there is no property service enterprise, the relevant owners will put forward suggestions for use;

(two) the exclusive part accounts for more than two-thirds of the total construction area and accounts for more than two-thirds of the total number of owners within the scope of the use of residential special maintenance funds;

(three) the realty service enterprise or the relevant owners organize the implementation of the use plan;

(four) the realty service enterprise or the host of the relevant industry holds the relevant materials and applies for the fee to the competent construction department of the local city or county people's government;

Among them, the use of public housing residential special maintenance funds, to the department responsible for the management of public housing residential special maintenance funds for expenses;

(5) The competent construction department of the people's government of a municipality directly under the Central Government, a city or a county or the competent department in charge of managing special maintenance funds for public housing shall, after examination and approval, issue a Notice on the Transfer of Special Maintenance Funds for Residential Buildings to the special account management bank.
