Regulations of Guangzhou Municipality on the Protection of Historical and Cultural Cities (revised in 2020)

Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical and cultural cities in this Municipality, inherit excellent historical and cultural heritage, and promote the coordinated development of urban and rural construction and social culture, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on the Protection of Historical and Cultural Cities, the Regulations on Urban and Rural Planning of Guangdong Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, protection, utilization and management of historical and cultural cities in this Municipality.

The protection objects of historical and cultural cities include the natural pattern and traditional features of historical cities, historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical buildings, historical and cultural features, traditional villages, ancient and famous trees, traditional place names, cultural relics and intangible cultural heritage.

The protection of historical and cultural cities involves the protection of cultural relics, ancient and famous trees, traditional place names and intangible cultural heritage, which shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The protection of historical and cultural cities shall follow the principles of scientific planning, classified management, strict protection and rational utilization, safeguard the authenticity and integrity of historical and cultural heritage, protect the natural and cultural landscapes that are interdependent with it, and maintain and continue the traditional pattern and style of historical and cultural cities. Article 4 The Municipal People's Government shall be responsible for the protection, supervision and management of the historical and cultural city of this Municipality.

District and Town People's governments are responsible for the protection, supervision and management of historical and cultural cities within their respective jurisdictions.

Sub-district offices shall perform their duties related to the protection of historical and cultural cities in accordance with the provisions of these regulations. Article 5 The competent department of urban and rural planning administration shall be responsible for organizing the preparation of protection plans for historical and cultural cities, historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical buildings and historical features in this Municipality, and organizing the implementation of these Regulations.

The administrative department of cultural relics shall be responsible for the protection, supervision and management of historical and cultural cities as stipulated by laws, regulations and these Regulations.

The housing administrative department is responsible for the supervision and management of the structural safety, use and repair of buildings, structures and historical buildings within the core protection scope of historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical areas and traditional villages.

Urban management comprehensive law enforcement organs shall exercise the power of administrative punishment in accordance with the provisions of these regulations.

The relevant administrative departments of finance, land, construction, urban management, public security, fire protection, ecological environment, water affairs, transportation, forestry and gardens, tourism, market supervision and management, civil affairs, agriculture, religion, ports, civil defense, earthquake and so on shall, according to their respective functions and duties, do a good job in the protection of historical and cultural cities. Article 6 The municipal and district people's governments can carry out daily protection and management of historical and cultural blocks, historical and cultural towns, historical and cultural villages, historical buildings, historical areas and traditional villages by purchasing services and setting up district protection and management organizations. Article 7 The municipal and district people's governments shall set up historical and cultural city protection committees to perform the following duties:

(a) to review the protection planning of historical and cultural cities and major policies and measures for historical and cultural cities, and supervise their implementation;

(two) to consider the contents of the protection list of historical and cultural cities and the adjustment plan;

(three) to guide, coordinate and supervise the work related to the protection of historical and cultural cities;

(four) to guide and coordinate the handling of major emergencies in the protection of historical and cultural cities, and to consider solutions to major problems in the protection of historical and cultural cities;

(five) other major issues that the people's government at the corresponding level considers relevant to the protection of historical and cultural cities.

The Committee for the Protection of Historical and Cultural Cities is composed of the responsible persons of the people's government at the same level and its relevant functional departments, and its mode of production, term of office and rules of procedure are formulated by the people's government at the same level. When the Committee for the Protection of Historical and Cultural Cities holds a meeting, it may invite relevant experts, deputies to the National People's Congress, members of the Chinese People's Political Consultative Conference and public representatives to attend as nonvoting delegates and fully listen to opinions from all quarters. Article 8 The municipal and district people's governments shall incorporate the protection of historical and cultural cities into the national economic and social development plan and annual plan at the corresponding level, and the funds needed for the protection of historical and cultural cities shall be included in the fiscal budget at the corresponding level to ensure the investment.

The Municipal People's Government shall, according to the actual needs of the protection of historical and cultural cities in various districts, highlight the key points and make overall arrangements for the transfer payment of funds from the municipal finance to the district finance.

The funds for the protection of historical and cultural cities are used for census, measurement, identification, emergency rescue, academic research, planning, repair subsidies, funding, awards, etc. Article 9 The municipal and district people's governments shall strengthen publicity and education on the protection of famous historical and cultural cities and enhance citizens' awareness of protection. Can authorize or entrust qualified enterprises, institutions, research institutions, industry associations and other social organizations to carry out basic research and professional training related to the protection of historical and cultural cities. Tenth units and individuals are encouraged to participate in the protection of historical and cultural cities in accordance with the law through donations, funding, investment, the establishment of public welfare organizations, and the provision of technical or voluntary services. Chapter II Protection List Article 11 The Municipal People's Government shall establish a protection list system for historical and cultural cities, and include the following protected objects in the protection list:

(a) historical and cultural blocks, historical and cultural towns, historical and cultural villages and historical buildings;

(2) Historical sites;

(3) traditional villages;

(four) other protected objects as prescribed by laws and regulations.

The protection list shall specify the name, location, completion time and historical value of the protected object.
