Regulations of Dalian Municipality on Urban Greening Management (revised in 2020)

Chapter I General Provisions Article 1 In order to promote the development of urban greening, improve the urban ecological environment, beautify the living environment, improve people's physical and mental health, and strengthen the planning, construction and management of urban green space, these Regulations are formulated in accordance with relevant state laws and regulations. Article 2 These Regulations shall apply to the planning, construction and management of urban greening such as public green space, attached green space, residential green space, protective green space, scenic woodlands and scenic spots in urban planning areas and towns of Dalian. Article 3 The people's governments of cities, districts (cities), counties and towns shall incorporate urban greening into the overall urban planning and national economic and social development plans, and implement unified leadership and be responsible at different levels.

All units in this Municipality and citizens of school age who have the ability to work should fulfill the obligation of planting trees and greening the city. Any unit or individual has the right to report and accuse the damage and destruction of green space and greening facilities. Fourth to encourage and strengthen the scientific and technological research of urban landscaping. Urban greening should reflect national style and local characteristics, learn from advanced experience at home and abroad, actively popularize and apply advanced technology, and strive to improve the scientific, technical and artistic level of urban landscaping. Fifth city and district (city) county urban management department is the administrative department of urban greening of the people's government at the same level, responsible for the planning, construction and management of urban greening in this area. Chapter II Urban Greening Planning and Construction Article 6 Urban greening shall conform to the overall urban planning and urban construction and development planning. Urban greening planning shall, according to local characteristics, make use of natural and human conditions such as original topography, landforms, water bodies, vegetation and historical and cultural sites, adhere to the principle of integrating social benefits, economic benefits and environmental benefits, rationally plan urban green space system, pay attention to purifying urban environment, beautify city appearance and street view, coordinate urban colors, and improve urban greening coverage and greening level. Article 7 The urban green space system planning and phased implementation plan shall be prepared by the urban management department in conjunction with the natural resources, ecological environment and other departments according to the overall urban planning, and shall be implemented by the urban management department or in conjunction with relevant departments after being approved in accordance with the prescribed examination and approval authority.

The planning, construction and management of all kinds of urban green space should establish a complete urban greening file. Article 8 The urban management department of the city shall strictly manage the park green space, protective green space, attached green space and other green space control lines (Green Line) delineated in the Dalian Green Space System Planning, and the land within the Green Line shall not be occupied without authorization. Article 9 The proportion of green land for urban construction projects to the total land area of the project shall meet the following requirements: no less than 35% for newly built residential areas and no less than 30% for rebuilt residential areas; Institutions of higher learning and nursing homes are not less than 45%; Industrial, commercial, urban roads and other construction projects shall be implemented in proportion to the relevant provisions of the state, province and city.

If the above standards are not met, the urban management department will reduce the area of green construction land, and the required funds will be solved by the project construction unit.

The construction of production green spaces such as urban nurseries, grass nurseries and flower beds should meet the needs of urban greening construction. Article 10 Where there are trees and green spaces in the site selection of urban construction projects, the planning administrative department shall solicit the opinions of the urban management department before making a decision.

If the idle land in the urban planning area is recognized by the land administrative department, the land user shall carry out temporary greening in accordance with the standards and requirements of temporary greening within six months, and the required construction and maintenance costs shall be borne by the land user. If temporary greening is not implemented, it shall be organized and implemented by the competent department of urban management of the district (city) county where it is located, and the required funds shall be borne by the land users. Eleventh urban greening projects that are suitable for construction projects should be planned, designed and completed at the same time as the main project of capital construction. If it cannot be completed due to seasonal reasons, it shall be completed in the next greening season. If it is not completed within the time limit, it shall be organized and implemented by the competent department of urban management of the district (city) county where it is located, and the required funds shall be borne by the construction unit. Article 12 The design of urban greening projects shall be entrusted to design units with corresponding qualification certificates. The design scheme of urban greening project shall be reported to the competent department of urban management for the record. Thirteenth city greening project construction funds, in the following ways:

(a) the urban management department is responsible for the construction and transformation of landscaping projects, and the municipal and district (city) and county governments make overall arrangements;

(two) new construction, expansion and reconstruction of urban landscaping, in addition to the part that should be borne by the urban management department, paid by the construction unit in the investment of basic construction projects;

(three) the greening of the factory area and the hospital area shall be solved by the unit from its own funds;

(four) the greening of residential areas, by the development and construction or property units responsible for investment. Article 14 The ownership of flowers and trees planted in urban green spaces shall be confirmed in accordance with the following provisions: the ownership of flowers and trees planted in national public garden green spaces by urban management departments belongs to the state; The flowers and trees planted by urban residents in the courtyard of their houses are owned by individuals. Chapter III Maintenance and Management of Urban Greening Article 15 The maintenance and management of urban greening shall be divided according to the following provisions:

(a) urban public green space, protective green space, scenic woodland and scenic green space, etc. , maintained and managed by the subordinate institutions of the urban management department;

(two) residential green space, property management has been implemented, the property management unit is responsible for the maintenance and management. Without the implementation of property management, the housing management unit is responsible for maintenance and management. If there is no housing management unit, the district (city) and county government shall determine the unit responsible for maintenance and management according to the actual situation;

(three) the green space in the factory and courtyard of each unit shall be maintained and managed by each unit;

(four) the green space in the military restricted zone and the administrative area shall be determined by the urban management department and the troops through consultation;

(five) the flowers and trees in the courtyard owned by urban residents shall be maintained and managed by the owner or the trustee.

The competent department of urban management is responsible for the supervision and inspection of greening maintenance management and giving technical guidance.
