Generally, the charging time of property fees starts from the second month after the property buyers actually accept the house.

The owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the user of the property agree that the user of the property will pay the property service fee, the owner shall be jointly and severally liable for the completed property that has not been sold or handed over to the property buyer, and the property service fee shall be paid by the construction unit.

I. The items of property management fees are as follows:

4. Expenditure on purchasing or renting necessary machinery and equipment;

6. Other reasonable management expenses.

Two, the legal conditions for not paying property fees are as follows:

1, because the house quality problem is not delivered, the property fee shall be paid by the developer;

2. If the property company fails to perform the service responsibility of the property contract, all the owners can refuse to pay, but there must be strong evidence;

3. The service quality provided by the property management company can't reach the standard stipulated in the property contract;

4. The property company does not have the original approval document of the price management department;

5. The property management company increases the charging items, expands the charging scope and raises the charging standard without authorization.

To sum up, the owner and the property management company are equal civil subjects, and both parties should perform their due obligations in accordance with the contract. If either party breaches the contract, it shall bear corresponding liabilities for breach of contract. If you don't pay the property management fee, the court will mediate, and mediation will not work. If the owner fails to pay the property management fee, he will be sentenced to pay it. If he refuses to perform, the property management company may apply for compulsory execution; If the property company fails to perform the service responsibility of the property contract, all the owners may refuse to pay.

Legal basis:

Article 41 of the Regulations on Property Management: The owner shall pay the property service fee according to the agreement in the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.
