Regulations of Huzhou Municipality on Property Management
According to the authorization and entrustment, the Management Committee of Nantaihu New District performs the duties of the district and county people's governments within its jurisdiction. Article 5 The municipal administrative department of housing and urban-rural construction (hereinafter referred to as the municipal administrative department of property) shall be responsible for the guidance, supervision and management of the city's property management activities, formulate relevant policies and model texts on property management, issue the grade standards of property services, and guide the property service industry associations to carry out industry self-discipline.
County housing and urban and rural construction administrative departments (hereinafter referred to as county property administrative departments) shall be responsible for the supervision and management of property management activities within their respective jurisdictions, guide neighborhood offices and township people's governments to carry out related work, and jointly with neighborhood offices and township people's governments, regularly carry out training for members of owners' committees.
Development and reform, public security, judicial administration, finance, natural resources and planning, ecological environment, emergency management, market supervision and management, civil air defense, big data, comprehensive administrative law enforcement and other departments shall, according to their respective responsibilities, do a good job in relevant supervision and management. Article 6 Sub-district offices and township people's governments shall regard property management as an important part of grass-roots governance, and be responsible for guiding the establishment of owners' meetings and the election of owners' committees, coordinating the relationship between property management and community governance and community construction, and mediating and resolving contradictions and disputes in property management.
Neighborhood (village) committees shall guide and supervise the owners' autonomy, assist neighborhood offices and township people's governments to supervise and manage property management, and promote community governance. Article 7 Establish and improve the deliberation and coordination mechanism of neighborhood (village) committees, owners' committees and property service providers under the leadership of community and village party organizations, give full play to the enthusiasm of enterprises, institutions, social organizations and relevant departments in the community to participate in property management activities, and promote the construction of harmonious communities.
National public officials, deputies to the National People's Congress, CPPCC members and advanced models should take the lead in observing the relevant provisions of property management and give full play to the leading role of demonstration. Eighth property service industry associations should strengthen industry self-discipline, standardize service behavior, promote the honest operation of property service enterprises, carry out industry trustworthy incentives and disciplinary action, and promote the healthy and orderly development of the industry. Ninth owners' committee, property service providers, owners and relevant organizations and individuals to participate in grassroots governance, civilized construction and other activities outstanding performance, the city, district and county people's government should give praise and reward.
The district and county people's governments shall give necessary material and financial support to property service providers who implement emergency measures and other management measures implemented by the government according to law. Article 10 Encourage the development and adoption of new technologies and methods, promote the integration of Internet, Internet of Things and other technologies with property management, improve the intelligent level of property management and services, and protect personal information security according to law.
The municipal property administrative department shall build a unified digital information platform for property management. Chapter II Owners and Owners' Organizations Article 11 Owners shall enjoy the rights stipulated by laws and regulations in property management activities and shall perform the obligations stipulated by laws and regulations. The preparatory group consists of owners and construction units, street offices, township people's governments and neighborhood committees. The head of the preparatory group shall be a member of the sub-district office, the Township People's Government or the neighborhood (village) committee.
The preparatory group consists of an odd number of five to eleven people, of which the number of owners is not less than 50% of the total number of the preparatory group. Owners participating in the preparatory group are recommended by the sub-district offices, township people's governments or neighborhood (village) committees. Owners under any of the circumstances listed in Article 17 of this Ordinance shall not participate in the preparatory group.
The preparatory group shall, within three days from the date of its establishment, publicize the list of members in a prominent position in the property management area for not less than seven days, or inform all owners by means of electronic information technology. Owners have objections to the list of members, which shall be settled by the neighborhood offices and the Township People's governments through coordination. Thirteenth preparatory group is responsible for the following work:
(a) to confirm the identity of the owners, determine the number of owners, exclusive part of the area;
(two) to determine the time, place, form and content of the first owners' meeting;
(three) to draft the management statute and the rules of procedure of the owners' meeting;
(four) to determine the voting rules for the first meeting of the owners' congress;
(five) to formulate the methods for the selection of candidates for members of the owners' committee and determine the list of candidates for members of the owners' committee;
(six) to formulate measures for the election of the owners' committee;
(seven) other preparations for the first meeting of the owners' congress.
The preparatory group shall notify all owners of the meeting time, place, topics and agenda fifteen days before the first owners' meeting. If the owner has any objection, the preparatory group shall record it and give a reply.
Within three months after the establishment of the preparatory group, the first owners' meeting shall be organized. After the establishment of the owners' meeting, the preparatory group will be dissolved automatically.
