Interim Measures of Jilin Municipality on Property Management of Residential Quarters

Chapter I General Provisions Article 1 In order to strengthen the management of urban residential quarters, improve the overall management level of residential quarters, and create a clean, civilized, safe and convenient living environment for residents, these measures are formulated in accordance with the relevant provisions of the state and the province and combined with the actual situation of our city. Second where the new residential areas in this city must implement property management according to these measures. Before the implementation of these measures, residential quarters that have been accepted and delivered for use shall actively create conditions in accordance with these measures and gradually implement property management. Article 3 The term "residential area" as mentioned in these Measures refers to a residential area with a building area of more than 20,000 square meters formed through unified planning, rational layout, comprehensive development and supporting construction.

The term "residential property management" as mentioned in these Measures refers to the maintenance of all kinds of houses and ancillary facilities in residential areas, the unified management of cleanliness, safety, public greening and roads in residential areas, and the provision of comprehensive services to housing property owners and users. Article 4 The management mode of property management in residential quarters is the combination of democratic autonomy and professional services, and the combination of territorial management and industry management. Fifth City Real Estate Management Bureau is the administrative department in charge of residential property management, and its main responsibilities are:

(a) to publicize and implement the laws, regulations and policies related to property management;

(two) to participate in the demonstration and completion acceptance of the development and construction scheme of new residential quarters;

(three) responsible for the qualification examination of property management enterprises, issuing the "Property Management Enterprise Qualification Certificate" and the training of property management personnel;

(four) to participate in the establishment of residential area management committee;

(5) Organizing, coordinating, guiding, inspecting and assessing the property management of residential quarters;

(six) the development of residential management system and management standards;

(seven) responsible for the collection, management and use of special funds for property management in residential quarters;

(eight) to investigate and deal with violations of property management laws and regulations.

The daily work of property management is the responsibility of the property management office.

City urban construction, land, environmental protection, public security, health, civil affairs, posts and telecommunications, electric power and other departments and the district people's government where the residential area is located shall cooperate with the property management of the residential area in accordance with the division of responsibilities. Sixth residential housing property owners and users have the right to participate in and supervise property management, and have the obligation to abide by these measures and various rules and regulations. Chapter II Management Committee of Residential Quarters Article 7 The Management Committee of Residential Quarters (hereinafter referred to as the Management Committee) is a democratic and autonomous organization that represents and safeguards the legitimate rights and interests of owners and users of residential quarters and implements property management. Eighth residential areas after delivery, when the occupancy rate reached more than 60%, the property management administrative department shall, in conjunction with the street offices, development and construction units, convene a meeting of owners and users to elect a management committee. Ninth CMC according to the following provisions:

(a) the members of the CMC are generally composed of 5 to 15 people, respectively, composed of property owners, users, police stations, neighborhood committees and other related personnel, of which the proportion of property owners and users in the CMC members shall not be less than 60%;

(two) members of the management committee are enthusiastic about public welfare undertakings, with a strong sense of responsibility and certain working ability;

(three) the CMC has a director and several deputy directors, who are nominated by the property management administrative department and the neighborhood offices and property units where the community is located through consultation among the CMC members and elected by all CMC members;

(4) The CMC has 1 to 2 executive secretaries, who are responsible for handling the daily affairs of the CMC;

(five) the director and executive secretary are full-time and can enjoy appropriate subsidies, and other members are part-time volunteers;

(six) the term of office of the CMC is three years, and members can be re-elected. Article 10 The CMC shall enjoy the following rights:

(a) to formulate the articles of association of the CMC, residential property management objectives and housing conventions;

(2) Deciding to select, renew or dismiss the property management company;

(three) to supervise and inspect the implementation of various management work and the implementation of rules and regulations of the property management company;

(four) to consider the annual management plan formulated by the property management company and the major measures for the management, maintenance and service of residential quarters. Article 11 The CMC shall perform the following obligations:

(a) to safeguard the legitimate rights and interests of the owners and users of houses in the community and accept their supervision;

(two) to assist the property management company to implement the management work;

(three) accept the supervision and guidance of the administrative department of property management;

(four) the organization held a meeting of residential housing property owners and users, and report to the meeting once a year. Article 12 The Central Military Commission decides on issues and implements the principle that the minority is subordinate to the majority. Chapter III Property Management Companies Article 13 A property management company refers to a comprehensive service enterprise engaged in the property management of residential quarters and enjoying the preferential policies of the state for the tertiary industry. Article 14 The establishment of a property management company shall meet the following conditions:

(a) owned or entrusted with the management of housing and ancillary facilities with a construction area of more than 20 thousand square meters;

(2) The registered capital is more than 200,000 yuan;

(3) Having articles of association that meet the requirements;

(4) Having a fixed office space;

(five) there are management institutions and all kinds of managers and technicians that are suitable for the scale of operation and management.
