In order to ensure epidemic prevention and control and economic development, and give full play to the role of natural resources and planning services, according to the Notice of the General Office of the Ministry of Natural Resources on Doing a Good Job in Land Guarantee for Epidemic Prevention and Control Construction Projects and related regulations, combined with the actual situation of our city, the Municipal Bureau of Natural Resources and Planning has formulated 15 safeguard measures to fully cope with the epidemic and support the development of enterprises.
First, strengthen land services and security.
1. Protect the land for epidemic prevention and control. Medical and health land and public facilities land needed for epidemic prevention and control can be given priority as needed; If there are special requirements for site selection and it is really necessary to occupy permanent basic farmland and ecological protection red line, it should be regarded as a major project to allow occupation, and the use and occupation should be filed with the local natural resources department. If the land does not need to be converted into permanent construction land after the expiration of the land use period, it will be restored to its original state after use and handed over to the land users, and no land use procedures will be handled. Need to be converted into permanent construction land, it should be timely to improve the procedures for land use after the end of the epidemic. 2. Guarantee land for key projects. 5. The signing of the land transfer contract can be postponed. If the land has been sold and a land transaction confirmation letter or a land transfer contract is signed within the epidemic prevention and control period according to regulations, the bidder may apply for an extension of the contract. If the land transaction confirmation letter is signed, the extension of the signing time shall be within 3 working days after the epidemic situation is eliminated; If the land transfer contract is signed, the extension of signing time is 10 working days after the epidemic situation is eliminated.
6. Land transfer fees can be paid in installments. During the epidemic prevention and control period, the newly sold land for real estate development (including commercial service land and commercial residential land) can, in principle, determine the bid bond at 50% of the starting price and pay the bond at 20% of the transaction price; In principle, the bid bond for other land can be determined by 20% of the starting price, and paid to 50% of the land transfer price within one month after the signing of the transfer contract. After the land unit issues the letter of commitment, the balance can be paid in installments according to the contract, with the payment period not exceeding one year and the corresponding interest paid. For the non-real estate development land that has been sold before the issuance of this notice, the land-using unit may issue a letter of commitment, and directly agree to pay the land transfer price in installments when signing the transfer contract, paying 50% within one month, and paying the rest in installments, with the longest payment period not exceeding one year, and paying corresponding interest.
7. Land transfer fees can be deferred. During the epidemic prevention and control period, newly sold land, land that has been sold but has not signed a land transfer contract, and land that has signed a land transfer contract but has not paid the land transfer fee may not be included in the land transfer fee collection period. For the land that has signed the land transfer contract, an agreement on the change of the land transfer contract may be signed according to the application of the land bidder.
All kinds of land shall not be sold before the land transfer fee is paid in full, but relevant procedures such as planning approval can be handled through simulated approval.
8. Adjust the way of performance supervision. According to the notification requirements of the general office of the Ministry and the epidemic prevention and control requirements, the performance supervision mode can be appropriately adjusted, and the on-site performance inspection will not be carried out temporarily. After the epidemic is eliminated, normal performance supervision will be resumed in time. Affected by the epidemic, if the land is not delivered, started or completed on schedule, the epidemic prevention and control period will not be included in the default period.
Three, strengthen the administrative examination and approval services
9. Extend the time limit for approval. During the epidemic prevention and control period, if the approved planning permission items are within the validity period, they will be automatically extended for 3 months on the basis of the original approval period, and no extension procedures will be handled. The epidemic prevention and control period may not be included in the validity period stipulated in the planning, land procedures, land price assessment report, government approval and other elements.
10. Optimize the planning permission process. The first is to expand the scope of the notification commitment authority. For general enterprise investment projects and government investment projects that need to be started during the epidemic prevention and control period, the notification commitment system shall be implemented for the approval of construction project planning permission. After the construction unit issues a written commitment that meets the requirements of relevant laws and mandatory standards, it will change the prior review to the post-event review. Among them, industrial projects, public service facilities and infrastructure projects should be reported immediately. Second, if medical and health facilities for epidemic prevention and control are newly built, the project plan can be built first after being examined and approved by the competent department of industry; Newly built municipal facilities related to epidemic prevention and control medical supplies, medical device production and epidemic prevention and control projects can be built first on the premise of meeting standards and ensuring safety. After the epidemic situation is eliminated, if it meets the requirements after assessment, the relevant formalities shall be handled. Third, if the enterprise converts the existing land into the land needed for epidemic prevention and control, or reconstructs or transforms the existing building into epidemic prevention and control facilities, it may not go through the planning and land procedures for the time being. If it needs to be used for a long time after the epidemic, if it meets the requirements after assessment, the relevant formalities shall be handled.
