Chapter I General Provisions

Article 1 In order to strengthen the management of floating population, protect the legitimate rights and interests of floating population, promote economic development and maintain social order, these Provisions are formulated in accordance with relevant national and provincial laws and regulations and combined with the actual situation of our city.

Article 2 The term "floating population" as mentioned in these Provisions refers to those who come to Shenyang temporarily and have no fixed residence. Cross-regional urban agricultural population and temporary population between urban areas and counties (cities) and between counties (cities) shall be managed with reference to these regulations. These Provisions shall apply to all units and individuals that retain and employ floating population within the administrative area of our city, but compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and foreigners enter our city.

Article 3 The management of floating population shall follow the principles of "government leadership, public security work first, participation of all parties and comprehensive management" and "whoever is in charge is responsible", "whoever recruits is responsible" and "whoever stays is responsible".

Fourth Shenyang floating population management coordination group office (hereinafter referred to as the floating population management office) is the competent department of floating population management in our city, responsible for organizing and coordinating relevant departments to do a good job in the management, supervision and inspection of floating population in the city. The floating population management office is located in the Municipal Public Security Bureau.

Public security, labor, industry and commerce, civil affairs, family planning, real estate, health, construction management and other administrative departments at all levels shall, in accordance with their respective functions and powers, cooperate closely to do a good job in the management of floating population in our city.

County (city), district and street (township) floating population management office is responsible for the management of floating population in this area.

Chapter II Household Registration Management

Article 5 The floating population who come to Shenyang to visit relatives, friends, treat diseases, travel, and study for less than 0/5 days shall go through the temporary registration with the residents' (village) committee of the temporary residence within three days of coming to Shenyang. Accommodation hotel, accommodation registration is regarded as temporary registration.

Article 6 To declare temporary residence registration and apply for a temporary residence permit, the following conditions shall be met:

(1) Holding valid identity documents;

(2) Having a legal domicile;

(3) Having a proper source of income.

Article 7 If a reeducation-through-labor worker is released on medical parole or allowed to go home on leave, he or his family members shall report and register at the local police station on the day he comes to live.

Eighth floating population engaged in migrant workers and various business activities in our city, when applying for a temporary residence permit, shall issue a migrant employment registration card issued by the labor department where the household registration is located; Married women of childbearing age, should also be issued by the township (town) people's government or street offices above the family planning management department issued proof of marriage and childbearing, birth control measures.

Article 9 If migrant workers are recruited into the organizational unit, the employing unit shall be responsible for registering the recruited personnel, and uniformly apply for employment permit and temporary residence permit within 5 days after coming to our city/KLOC-0.

Tenth floating population who live in our city for a long time, should apply for a "temporary residence permit".

Who is engaged in business activities in our city, the temporary residence period has exceeded fifteen days, should be required to apply for a "temporary residence permit", "employment permit" and "business license", "health permit".

Eleventh in the hotel room for more than three months, engaged in official business, business and other activities of the floating population, in the signing of the room contract within 15 days, to the temporary residence of the police station to apply for a "temporary residence permit".

Twelfth floating population to apply for a "temporary residence permit", must pay three recent one-inch bareheaded photos; The Temporary Residence Permit is a certificate for one person, valid for one year. If it is necessary to stay temporarily after the expiration of the temporary residence, it shall go through the formalities of extension or renewal before the expiration; When the floating population leaves our city, they must go through the formalities of cancellation of temporary residence at the registration authority and return their temporary residence permits.

Article 13 The floating population engaged in migrant workers and various business activities in our city (including those who have stayed in hotel rooms for a long time) shall pay the floating population management fees in accordance with the Measures for the Administration of the Collection and Use of Management Fees for Floating Population in Liaoning Province, and the payment standards shall be separately stipulated by the Municipal People's Government.

Fourteenth of the floating population without valid identity documents, no fixed source of work and life, no fixed legal residence, to be accommodated and repatriated.

Chapter III Residential Management

Fifteenth units or individuals shall not lease the house to the floating population without legal and valid documents. Floating population in the employer and the construction site centralized accommodation, there should be a person responsible for the management.

Article 16 Where a unit or individual rents a house to a store or warehouse where the floating population lives or operates, catering, service and maintenance, it shall apply to the local police station and real estate department for the Public Security Permit for Rental House and the Rental House Permit on the strength of the real estate license.

Seventeenth units or individuals will be leased to the floating population, shall bear the following responsibilities:

(a) should lead the floating population to apply for registration or apply for a "temporary residence permit" within the specified time;

(2) Basic information of the registered lessee, such as name, gender, age, permanent residence, occupation or main source of income, etc. If the lessee changes, it shall register the change in time and file it with the police station;

(three) found suspicious behavior or illegal and criminal behavior and unplanned pregnancy, should promptly report to the local police station or family planning department;

(four) the rented houses and warehouses must be regularly inspected for safety, so as to find and eliminate unsafe hidden dangers in time, ensure the safety of the floating population in living and keeping, and prevent theft or public security disasters;

(five) accept the management of the floating population management department and assist the relevant departments to do a good job in the management of the floating population.

Eighteenth the following houses shall not be leased to the floating population:

(a) illegal buildings, self-built buildings and dangerous houses identified by the real estate department, and houses or warehouses whose doors and windows do not meet the safety conditions after inspection by the public security department;

(two) the property right or the right to use the house is unclear;

(three) the house is not in the form of a separate room or berth;

(four) the owner is unable to take care of it and has no entrusted manager;

(5) The house is filled with inflammable and explosive dangerous goods and drugs.

Nineteenth floating population to rent other people's houses, shall report to the local police station for registration. Do not sublease or lend the leased house to others without authorization.

Twentieth floating population shall not build houses or temporary sheds, shall not live in public buildings and facilities, and shall not relocate or build vacant houses.

Twenty-first units or individuals to terminate the lease of housing, should hold the "rental housing security permit" and "rental housing permit" to the local police station and the real estate department for cancellation of registration, and return the "rental housing security permit" and "rental housing permit".

Chapter IV Employment Management

Twenty-second migrant workers in the floating population, before going out, must go to the labor administrative department where their account is located to register and receive the Employment Registration Card for Outgoing Persons. After being hired by the employing unit, the employee shall apply to the labor administrative department for an employment permit with the employment registration card of the migrant workers.

Twenty-third floating population engaged in work and business activities in our city or employing units to use foreign personnel, should hold a "temporary residence permit" and "employment permit" in our city employment, and apply to the relevant departments for approval documents before employment. Foreign institutions that come to our city to independently contract construction projects or provide labor services for projects must go through the project contracting and construction procedures with the competent construction department of our city, and then work in our city.

The administrative department shall register and issue employment certificates.

Twenty-fourth municipal labor administrative departments according to the demand of urban and rural labor force in our city, determine the employment of foreign labor industry, scope of work. Recruitment should be based on the principle of "local first, then foreign", and unified approval and management should be implemented.

Twenty-fifth the use of migrant workers and units that come to work in our city and engage in various business activities shall pay employment management fees to the labor department in accordance with relevant regulations.

Chapter V Family Planning and Health Management

Twenty-sixth floating population family planning management by the temporary neighborhood offices, township and town people's government family planning management department is responsible for. Governments at all levels, organs, enterprises, institutions and troops should incorporate the family planning management of floating population into the family planning management of permanent population.

Twenty-seventh floating population engaged in the production and operation of catering service industry, must be inspected by the health department and health examination, no "health permit" and "health inspection certificate", are not allowed to start business and business; Without the approval of the health department, rented houses are not allowed to be used for food processing, production and sales.

Twenty-eighth employed floating population of more than 50 people, should report to the health and epidemic prevention institutions in the temporary residence, and accept the prevention and control measures of infectious diseases taken by the health and epidemic prevention departments.

School-age children of floating population who have lived temporarily for more than three months shall be vaccinated in accordance with the relevant provisions of the state, and the health department may charge vaccination fees in accordance with the relevant provisions.

Twenty-ninth floating population shall not set up medical institutions. To engage in medical activities in medical institutions must be approved by the administrative department of health.

Chapter VI Protection of the Rights and Interests of Floating Population

Article 30 The personal rights, property rights and other lawful rights and interests of floating population shall be protected by law. It is forbidden to insult or discriminate against the floating population.

When the legitimate rights and interests of the floating population are illegally infringed, the relevant departments shall promptly investigate and deal with them and protect them according to law.

Thirty-first floating population management departments shall, according to their respective functions and duties, provide labor, education, health and epidemic prevention, family planning and other services for the floating population, and educate and train the floating population in legal knowledge, vocational skills, labor safety, family planning and social morality.

Thirty-second units that recruit floating population shall sign labor contracts with the floating population, provide necessary working and living conditions, and guarantee the floating population's rights to receive labor remuneration, medical care and rest according to law.

Thirty-third floating population to apply for the relevant licenses, who meet the prescribed conditions, the relevant departments should handle in a timely manner, and shall not make things difficult or delay.

Chapter VII Legal Liability

Thirty-fourth in violation of the provisions of Article 7, Article 9, Article 10, Article 11, Article 17 (1), (2), Article 18 (1), (2), (3), (4), Article 20, Article 22 and Article 23, by the public security, labor, construction management, real estate.

Payment.

Thirty-fifth in violation of the provisions of Article thirteenth, Article nineteenth and Article twenty-fifth, by the administrative departments of public security, labor, real estate, health and other warning, ordered to make corrections, and impose a fine from 200 yuan to 500 yuan.

Article 36 Anyone who violates the provisions of Article 15, Article 16, Item (3) and Item (4) of Article 17, Item (5) of Article 18, Article 28 and Article 29 of this Ordinance shall be given a warning by the administrative departments of public security, real estate, family planning and health, ordered to make corrections, and fined above 500 yuan 1000 yuan.

Thirty-seventh in violation of the provisions of the provisions of article twenty-seventh, the administrative department of health shall be punished in accordance with the relevant provisions of the "food hygiene law" of People's Republic of China (PRC).

Thirty-eighth hinder the floating population management personnel to perform official duties, the public security organs shall be punished in accordance with the relevant provisions of the "Regulations of the people's Republic of China on administrative penalties for public security". If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-ninth administrative punishment of the parties must be carried out in accordance with the procedures stipulated in the Administrative Punishment Law of the People's Republic of China. The fine must be paid in full to the finance at the same level.

Fortieth if a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring a lawsuit to the people's court according to law. If the party concerned fails to apply for reconsideration, bring a suit in a people's court or perform the punishment decision within the time limit, the organ that made the punishment decision shall apply to the people's court for compulsory execution.

Forty-first floating population management staff abuse their powers, neglect their duties, engage in malpractices for selfish ends, and shall be given administrative sanctions by their units or higher authorities; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VIII Supplementary Provisions

Forty-second specific issues in the implementation of these Provisions shall be interpreted by the Municipal Public Security Bureau.

Article 43 These Provisions shall come into force as of the date of promulgation. The Regulations of Shenyang Municipality on the Management of Floating Population (Decree No.3 of the municipal government [1995]) shall be abolished immediately.
