The responsible unit of the first investigation shall arrive at the scene in time to verify and stop; The preliminary investigation case belongs to the jurisdiction of this department, and shall be handled by the responsible unit of the preliminary investigation according to law; If the preliminary investigation case falls within the jurisdiction of the department and violates other laws and regulations, the responsible unit of the preliminary investigation shall notify other law enforcement departments within 2 working days after on-site verification, and other law enforcement departments shall investigate and deal with it separately according to law.

If the preliminary investigation case does not belong to the jurisdiction of the department, the responsible unit of the preliminary investigation shall transfer the case materials to the law enforcement department with jurisdiction within 2 working days. After receiving the case, the law enforcement department shall file an investigation, investigate and deal with it according to law, and notify the responsible unit of the first investigation in writing within 2 working days after the decision is made.

Law enforcement departments have objections to the responsibility of investigating cases, and should actively negotiate. If negotiation fails, it shall be reported to the joint meeting for study and determination.

Twentieth the establishment of case investigation work lead coordination responsibility system. According to the different stages of illegal land use and illegal construction implementation, the lead responsible departments are determined respectively, taking overall responsibility for the investigation of illegal acts and coordinating to solve related problems. Involving illegal land use, led by the Municipal Bureau of land and resources coordination; Does not involve illegal land use, but involves illegal construction behavior, led by the Municipal Planning Commission; Involved in engineering construction, building quality and safety, property and housing management and other illegal acts, led by the Municipal Housing and Urban-Rural Development Committee to coordinate.

Twenty-first to establish a special joint law enforcement mechanism. The joint meeting may designate a special joint action group to take comprehensive measures to investigate and deal with key issues and major cases in illegal land use and illegal construction, and severely punish illegal acts.

Twenty-second law enforcement departments to stop construction, dismantle the decision, the parties do not stop construction or overdue demolition of illegal buildings (structures), you can inform the planning department, housing and urban construction department in writing. The planning department shall deal with the design units involved in illegal construction according to law, and may suspend the acceptance of other planning declaration matters of the construction unit according to relevant laws and regulations; The housing and urban-rural construction department may order the construction unit to stop construction and deal with it according to law.

Twenty-third municipal public service units in the acceptance of power supply, water supply, gas supply, heating and other related business applications, can not provide planning permits, in accordance with the provisions of relevant laws and regulations shall not handle the relevant procedures; For buildings, structures or other facilities that affect the appearance of the city, the municipal public service units shall not provide services if they cannot provide construction approval procedures such as construction land planning permit, state-owned land use permit and construction project planning permit.

When accepting applications for temporary water, electricity, gas and heat for new projects, municipal public service units should strictly check the planning permission and construction approval (permission) procedures before providing corresponding services and limiting the temporary use period.

Article 24 The working group of the joint meeting shall, according to the seriousness of the social impact of illegal land use and illegal construction and the relevant situation of stopping and investigating, conduct early warning interviews with the responsible persons of relevant districts and counties, township governments, illegal construction units and individuals jointly with the municipal supervision department, give a warning and urge rectification within a time limit.

The units and individuals in the early warning interview shall report the implementation of rectification to the working group of the joint meeting within the prescribed time limit. If it has not been rectified at the expiration of the period, it shall be handled in accordance with relevant regulations.
