Detailed Rules for the Implementation of Xianyang Property Service Charge Management
Chapter I General Principles
Article 1 In order to regulate the charging behavior of property services, safeguard the legitimate rights and interests of owners or property users (hereinafter referred to as "owners") and property service enterprises, these detailed rules are formulated in accordance with the provisions of the General Principles of the Civil Law of People's Republic of China (PRC), the Price Law of People's Republic of China (PRC), the Regulations on Property Management in Shaanxi Province and the Measures for the Administration of Property Service Charges in Shaanxi Province, and in combination with the actual situation of our city.
Article 2 These Rules shall apply to the charging behavior of property services within the administrative area of Xianyang City and its supervision and management.
Article 3 The term "property service fee" as mentioned in these Detailed Rules refers to the fees charged by the property service enterprise for providing services to the owners according to the contract, including property service fee, motor vehicle parking service fee in the property management area (hereinafter referred to as "parking service fee") and other service fees.
Property service fee refers to the fees charged by the property service enterprise to the owners for providing public and universal services such as daily management, maintenance, greening and maintenance, sanitation and cleaning, order maintenance and safety precautions for the houses, supporting facilities and equipment and related sites in the property management area according to the stipulations of the property service contract.
Parking service fee refers to the fees charged by property service enterprises for orderly management and service of vehicles parked at designated sites (places) according to the parking service contract entrusted by the owners or owners' congress.
Other service fees refer to the corresponding fees charged by the realty service enterprise according to the entrustment of the owner or personal needs to provide services voluntarily selected by the owner other than those agreed in the previous realty service contract or realty service contract.
Article 4 Property service charges shall be managed at different levels in accordance with the unified policy and the principle of territorial management. The Municipal Development and Reform Commission, jointly with the Municipal Housing and Urban-Rural Development Bureau and the Municipal Market Supervision Administration, is responsible for formulating the detailed rules for the implementation of Xianyang's property service charge management and related policies and regulations, and guiding the management and supervision of the city's property service charge. The municipal and county development and reform departments shall, jointly with the housing and urban-rural construction departments and the market supervision and management departments, be responsible for the management and supervision of property service charges within their respective administrative areas according to their respective management authority. The subdistrict office (town people's government) where the property project is located is responsible for the guidance and supervision of property management activities in this region, and timely coordinate and handle property management disputes and contradictions.
Article 5 Charges for property services shall follow the principles of fairness, openness, reasonableness and consistency of quality and price. According to the different nature and characteristics of property services, government-guided prices and market-regulated prices shall be implemented respectively.
The property service fees and parking service fees of residential quarters (multi-storey and high-rise), affordable housing, housing reform housing and old houses without owners' meeting shall be subject to government guidance prices, while those with owners' meeting shall be subject to market adjustment prices.
Commercial, office buildings, villas, apartments and other government pricing outside the scope of property services, parking fees and other service charges to implement market-adjusted prices.
Sixth the implementation of government-guided property service charges by the city and county (city)
The specific work shall be formulated by the municipal, county (city) development and reform department, the housing and urban-rural construction department and the market supervision and management department according to the standard of property service level, taking into account factors such as residential area capacity, site facilities, enterprise cost, and the affordability of the owners. , housing and urban construction departments put forward adjustment applications and opinions, and implement dynamic management.
The Municipal Development and Reform Commission shall, jointly with the Municipal Housing and Urban-Rural Development Bureau and the Municipal Market Supervision Administration, be responsible for formulating and adjusting the charging standards for property service fees and parking service fees that are guided by the government within the main urban area of Xianyang City, and implement them after being reported to the Municipal People's Government for approval.
Counties (cities) can refer to these rules and government-guided property service charges, but also can be formulated according to the actual situation.
Article 7 Property service charges shall be subject to government-guided price management, and the property service enterprises and owners shall agree on the specific standards of property service fees and parking fees in this community through contracts within the scope of government-guided prices.
The charging standard of property services which belongs to the market-regulated price shall be agreed by the owners or owners' assembly of the property services enterprise through the contract.
If the owner changes the house into a business house, in addition to complying with laws, regulations and management regulations, it shall be subject to the consent of the interested owners, and the property service charges shall be subject to market adjustment.
