Measures of Chongqing Municipality for the Prevention and Control of Radiation Pollution

Chapter I General Provisions

Article 1 In order to prevent and control dust pollution in the main city, improve the quality of atmospheric environment and protect human health, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and the Regulations of Chongqing Municipality on Environmental Protection.

Article 2 The term "dust pollution" as mentioned in these Measures refers to the pollution of the atmospheric environment by dust, soot and lampblack produced by engineering construction, demolition of buildings, land remediation, landscaping, material stacking, road cleaning, industrial production, stone mining (crushing) production, catering business and other activities.

Article 3 These Measures shall apply to the prevention and control of dust pollution and related management activities within the main urban area of this Municipality.

The main city mentioned in the preceding paragraph refers to the streets and towns of 1 19 in the nine districts of the main city. See the attached table for the specific list.

Article 4 The Municipal People's Government shall implement the annual target responsibility system and accountability system for dust pollution prevention and control.

The people's governments of all districts in the main urban area shall strengthen their leadership in the prevention and control of dust pollution in their respective jurisdictions, formulate plans for the prevention and control of dust pollution in accordance with the unified arrangements of the Municipal People's Government, and take effective measures to ensure the realization of the prevention and control objectives of dust pollution.

Article 5 The competent administrative department of environmental protection shall exercise unified supervision and management over the prevention and control of dust pollution.

Municipal, construction, planning, transportation, water conservancy, land and housing management, gardens and other administrative departments shall do a good job in the prevention and control of dust pollution in accordance with the responsibilities stipulated in these Measures.

Article 6 All units and individuals shall abide by the provisions of the state and this Municipality on the prevention and control of dust pollution, eliminate the equipment and processes with serious dust pollution, and take effective measures to prevent and control dust pollution.

Seventh city, District People's government or the competent administrative department of environmental protection shall commend and reward enterprises, institutions and individuals that have made remarkable achievements in the prevention and control of dust pollution.

Chapter II Pollution Control

Article 8 The municipal environmental protection administrative department shall be responsible for supervising the implementation of the national dust pollutant discharge standards; According to the atmospheric environmental quality standards and the economic and technical conditions of this Municipality, the emission standards of dust pollutants in this Municipality shall be formulated, and the construction of coal-free zones and basic coal-free zones shall be promoted.

Article 9 The owners of engineering construction, building (structure) demolition and land remediation shall include the cost of dust pollution prevention and control in the project budget, and specify the responsibility of the construction unit for dust pollution prevention and control in the construction contract.

Tenth engineering construction shall comply with the following provisions:

(1) A hard closed fence not less than 1.8m should be set around the construction site;

(2) hardening of the entrance and exit roads on the construction site;

(three) set up vehicle cleaning facilities and supporting grit chambers, and the vehicles can be driven out of the construction site after being washed clean;

(four) open-air stacking of cement, mortar, gypsum and other materials scattered by Jerry Liau or construction waste that cannot be removed within 48 hours, shall be sealed with a closed fence not less than the height of the stacked materials;

(five) the construction that produces a large amount of mud shall be equipped with corresponding mud pools and mud ditches to ensure that the mud does not flow out, and the waste mud shall be transported outside by closed tankers;

(six) the construction area of concrete 1000 square meters or more than 500 cubic meters, the use of ready-mixed concrete;

(seven) it is forbidden to throw construction waste or materials scattered in Jerry Liau from a height of more than 3 meters.

Eleventh housing construction in accordance with the provisions of article tenth of these measures, but also should be idle for more than 3 months to cover the site, simple paving or greening; After the completion of the project, the construction waste shall be removed within 10 days from the date of applying for the project completion acceptance.

Twelfth roads, bridges, pipelines, water conservancy and other engineering construction or maintenance, in addition to comply with the relevant provisions of Article 10 of these measures, when digging the ground or cleaning up the construction site, dust suppression measures such as sprinkling water or spraying should be taken.

The new construction, expansion, reconstruction or overhaul of urban roads should be paved with modified asphalt pavement.

Thirteenth buildings (structures) demolition and land consolidation project construction, in addition to comply with the relevant provisions of article tenth of these measures, should also comply with the following provisions:

(a) Take measures such as sprinkling water or spraying to reduce dust;

(two) within 5 days after the completion of the construction waste removal;

(three) covering, simple paving or greening the bare mud that can not be put into use within 3 months after completion.

Fourteenth landscaping construction, in addition to the relevant provisions of Article 10 of these measures, shall also meet the following requirements:

(a) the soil to be used or residual soil that cannot be removed the next day after planting and the tree holes that have not been planted within 48 hours shall be covered;

(two) greening or covering the street tree pool;

(three) the planting soil of green belts and flower beds shall not be higher than the edge of green belts and flower beds.

Fifteenth municipal, construction, planning, transportation, water conservancy, land and housing management, landscape and other administrative departments shall, in accordance with the provisions of Articles 10, 11, 12, 13 and 14 of these measures, formulate technical specifications for the prevention and control of dust pollution in this industry and supervise the implementation.

The construction unit shall, according to the technical specifications for the prevention and control of dust pollution, formulate a plan for the prevention and control of dust pollution, and report it to the municipal administrative department and the administrative department in charge of supervision and management of dust pollution in this project for the record three working days before the project starts.

Sixteenth bare silt suitable for greening, the responsible person shall be within the time limit prescribed by the administrative department of landscaping; Those not suitable for greening should be hardened.

The responsible person is determined as follows:

(a) bare mud within the scope of the unit, which is responsible for;

(two) bare mud in residential areas, responsible for property management companies;

(three) the bare mud on both sides of the road, on both sides of the river and in public areas shall be responsible for the management unit.

Seventeenth open-air storage yards and open-air warehouses that are prone to dust pollution shall comply with the following provisions:

(1) hardened ground;

(two) set up a closed fence not less than the stacking height and cover it;

(three) equipped with dust-proof facilities such as dust collection and spraying in the cargo handling place, and ensure the normal use of dust-proof facilities;

(4) Vehicle washing facilities shall be set at the entrance and exit, and the vehicles can only be driven out after being washed clean;

(5) Remove the scattered materials in time and keep the road clean and tidy.

If the existing open-air storage yard and open-air warehouse do not conform to the provisions of the preceding paragraph, they shall be rectified in accordance with the provisions of the preceding paragraph within the time limit prescribed by the competent administrative department of environmental protection.

Eighteenth road cleaning operations, should abide by the relevant laws and regulations and urban environmental sanitation operation norms.

Article 19 It is forbidden to build or expand boilers that use highly polluting fuels such as coal, heavy oil and residual oil below10t/h (including10t/h, the same below).

The existing boilers with steam capacity less than 10 ton/hour shall, in accordance with the provisions of the municipal and district people's governments, switch to clean energy such as natural gas, liquefied gas, coal-based gas and electricity within a time limit, or build supporting pollution control facilities to ensure discharge standards.

10t/h and above boilers shall not use heavy oil, residual oil and other highly polluting fuels; Where coal is used, pollution control facilities shall be built to ensure that the discharge reaches the standard.

Article 20 It is forbidden to build or expand cement production lines such as coal-fired power plants, mechanical vertical kilns, wet kilns, vertical kilns and dry hollow kilns, and other industrial facilities that seriously pollute the atmospheric environment.

The existing cement production lines such as mechanical shaft kiln, wet kiln, shaft kiln and dry hollow kiln shall meet the standards or be closed within the time limit prescribed by the municipal and district people's governments.

Existing coal-fired power plants and other industrial facilities that seriously pollute the atmospheric environment should be equipped with pollution control facilities within the prescribed time limit to ensure that the discharge reaches the standard.

Twenty-first Municipal People's Government shall not engage in the production of stone mining (crushing) after designating the area where stone mining (crushing) is prohibited.

The Municipal People's Government shall not expand the production scale of the mining (broken) stone yard in the restricted mining (broken) stone area; The existing quarrying (crushing) stone production should support the construction and use of dust pollution control facilities to meet the emission standards.

Twenty-second residential buildings, office buildings and comprehensive commercial and residential buildings without public flues shall not be built or expanded to produce cooking fume and cooking fume pollution.

Organs, enterprises, institutions and individual industrial and commercial households should use clean energy, and control oil smoke pollution in accordance with the provisions of the competent administrative department of environmental protection to ensure that the discharge standards are met.

Twenty-third motor vehicle emissions, vehicle transportation easy to spill substances and burning toxic and harmful substances and other dust pollution behavior, in accordance with the provisions of the relevant laws, regulations and rules of the state and this Municipality.

Chapter III Supervision and Inspection

Twenty-fourth municipal environmental protection administrative department shall strengthen the monitoring of dust pollution, and publish information on dust pollution every day.

Article 25 The competent administrative department of environmental protection and the relevant administrative departments shall set up telephone numbers and e-mail boxes for reporting dust pollution, promptly accept and investigate illegal acts of dust pollution, and inform the whistleblower or complainant of the investigation within 5 days from the date of accepting reports and complaints.

Twenty-sixth environmental protection administrative departments and relevant administrative departments shall, in accordance with their respective responsibilities, strengthen the daily law enforcement inspection of dust pollution; The competent administrative department of environmental protection may, according to the specific circumstances of dust pollution, jointly implement joint law enforcement inspection with relevant administrative departments.

The units or individuals under inspection shall truthfully report the situation and provide relevant information, and shall not refuse or obstruct the inspection.

Construction, planning, transportation, water conservancy, land and housing management, landscaping and other administrative departments in the process of supervision and management found dust pollution violations, should be promptly transferred to the municipal administrative departments to investigate and deal with according to law.

Chapter IV Legal Liability

Twenty-seventh responsible for the supervision and inspection of dust pollution prevention and control of the District People's government and its administrative departments and their staff, one of the following circumstances, shall be given administrative sanctions; Suspected of a crime, transferred to judicial organs according to law:

(a) do not conscientiously perform the duties of supervision and management of dust pollution prevention and control, or refuse to accept and investigate the illegal acts that should be investigated;

(two) favoritism, abuse of power, illegal approval of prohibited construction projects.

Responsible for the supervision and inspection of dust pollution prevention and control of the District People's government and the municipal administrative departments responsible for one of the circumstances specified in the preceding paragraph, resulting in serious consequences, in accordance with the relevant provisions of the "Chongqing municipal government departments chief executive accountability Interim Measures" accountability.

Twenty-eighth in violation of the provisions of article tenth, article eleventh, article twelfth, article thirteenth, article fourteenth, the municipal administrative department shall order it to make corrections within a time limit, and may impose a fine of more than 2000 yuan to 20000 yuan; If no correction is made within the time limit, it may be ordered to stop work for rectification.

Twenty-ninth in violation of the provisions of the second paragraph of article fifteenth of these measures, the municipal administrative department shall order it to make corrections, and may impose a fine of more than 1000 yuan 10000 yuan.

Thirtieth in violation of the provisions of the sixteenth paragraph of these measures, the landscaping administrative department shall order it to make corrections within a time limit; If no correction is made within the time limit, the landscaping administrative department may entrust the relevant units to perform on their behalf, and the expenses shall be borne by the units responsible for greening or hardening.

Thirty-first in violation of the provisions of article seventeenth of these measures, the competent administrative department of environmental protection shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 1000 yuan or more and 10000 yuan or less shall be imposed; If serious dust pollution is caused, a fine ranging from 10000 yuan to 50000 yuan shall be imposed.

Thirty-second in violation of the provisions of article nineteenth of these measures, the competent administrative department of environmental protection shall be punished according to the following provisions:

(a) new construction, expansion and use of 10 tons/hour of high pollution fuel boilers, and put into use, shall be ordered to dismantle, and impose a fine of 10000 yuan and 100000 yuan;

(2) If the existing boilers with steam capacity less than10t/h fail to switch to clean energy on schedule, or pollution control facilities are not built, resulting in excessive discharge, a fine of more than 10000 yuan and less than 10000 yuan shall be imposed;

(three) 10 tons/hour boiler using highly polluting fuels other than coal, a fine of 30 thousand yuan;

(4) If the existing boilers with coal consumption of more than 10 ton/hour are not equipped with pollution control facilities, resulting in excessive discharge, they shall be ordered to stop using them and be fined more than 30,000 yuan/kloc-0.00 million yuan.

Thirty-third in violation of the provisions of article twentieth of these measures, the competent administrative department of environmental protection shall be punished according to the following provisions:

(1) Those who build or expand cement production lines such as coal-fired power plants, mechanical vertical kilns, wet kilns, vertical kilns, dry hollow kilns and other industrial facilities that seriously pollute the atmospheric environment shall be ordered to close down or dismantle within a time limit according to law, and may be fined between 65,438 yuan and 65,438 yuan.

(2) If the existing cement production lines such as mechanical vertical kiln, wet kiln, vertical kiln and dry hollow kiln fail to complete the treatment within the prescribed time limit, and the pollutant discharge exceeds the standard, a fine of 1 10,000 yuan or more and 1 10,000 yuan or less shall be imposed; If it is not closed within the prescribed time limit, it shall apply to the people's court for compulsory closure according to law;

(3) If the existing coal-fired power plants or other industrial facilities that seriously pollute the environment fail to build pollution control facilities within the prescribed time limit, resulting in excessive discharge, a fine of more than 10000 yuan and less than 100000 yuan shall be imposed.

Thirty-fourth in violation of the provisions of the first paragraph of Article 21 of these measures, the competent administrative department of environmental protection shall order it to close down, restore vegetation within a time limit, and impose a fine of 30,000 yuan to 65,438 yuan.

In violation of the provisions of the second paragraph of article twenty-first, the competent administrative department of environmental protection shall order it to make corrections within a time limit and impose a fine of 30,000 yuan to 65,438 yuan.

Thirty-fifth in violation of the provisions of article twenty-second, shall be punished by the competent administrative department of environmental protection according to the following provisions:

(a) in violation of the provisions of the first paragraph, shall be ordered to stop the illegal act, and may be fined 2000 yuan to 20000 yuan;

(two) in violation of the provisions of the second paragraph, within the prescribed time limit did not switch to clean energy or not in accordance with the provisions of governance, shall be ordered to stop the illegal behavior, and may impose a fine of more than 2000 yuan to 20000 yuan.

Article 36 Whoever, in violation of the provisions of the second paragraph of Article 26 of these Measures, refuses or obstructs the inspection shall be fined between 65,438 yuan and 30,000 yuan by the administrative department conducting the inspection.

Chapter V Supplementary Provisions

Article 37 These Measures shall come into force as of June 6, 2005. On March 26th, 2003, the Notice of Chongqing Municipal People's Government on Further Controlling Dust Pollution in the Main City (Chongqing Municipal People's Government Decree No.26) 152) was abolished at the same time.
