Regulations of Ningde Municipality on the Administration of Urban Parking Lot Construction

Chapter I General Provisions Article 1 In order to standardize the planning, construction, use and management of parking lots, improve parking conditions and enhance the level of urban traffic management, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Road Traffic Safety Law of the People's Republic of China and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, use and management of parking lots in urban planning areas within the administrative area of this Municipality. Article 3 Parking lots mentioned in these Regulations include public parking lots, special parking lots and on-street parking spaces.

Public parking lot refers to the parking place for motor vehicles located outside the road and serving the public; Special parking lot refers to a place located outside the road for specific groups to park motor vehicles; On-street parking spaces refer to public-oriented motor vehicle parking spaces designated on roads.

The planning, construction, use and management of professional transport vehicles and non-motor vehicle parking lots such as buses, taxis, trucks, dangerous goods and prohibited items shall be implemented in accordance with relevant laws and regulations. Article 4 The planning, construction, use and management of parking lots shall follow the principles of government leading, overall planning, supporting construction, convenient use and management according to law. Article 5 The people's governments of cities and counties (cities, districts) shall establish a joint meeting system led by the government and attended by departments, coordinate and solve major problems such as parking lot planning, construction, use and management, and organize the construction of a unified parking guidance information system.

The competent department of urban and rural planning is responsible for organizing the preparation of special parking lot planning and reviewing the parking lot design scheme;

The housing and construction department is responsible for the supervision and management of parking lot construction, participating in the review of parking lot design scheme, and doing a good job in parking supervision in property communities;

The public security organ is the competent department of parking lot supervision and management, responsible for the supervision and management of parking lot operation and use, and participates in the review of parking lot design scheme. The traffic administrative department of the public security organ shall be responsible for the specific work;

Development and reform, finance, land and resources, urban management administrative law enforcement, civil air defense, price, market supervision and management, fire protection and other functional departments shall do a good job in parking lot management according to law within their respective responsibilities.

Neighborhood offices, township (town) people's governments and community neighborhood committees shall cooperate with the planning, construction and management of parking lots within their respective jurisdictions. Article 6 Encourage and popularize the construction of intelligent parking lots, and manage parking lots through intelligent and informational means such as automatic time charging equipment, basic parking database and mobile terminal parking applications. Seventh city and county (city, district) people's governments shall, according to the demand of parking lot construction, increase the capital investment in urban parking lot construction.

Encourage enterprises and individuals to participate in the investment and construction of public parking lots according to law. City and county (city, district) people's governments shall formulate relevant preferential policies according to law. Chapter II Planning and Construction Article 8 The competent department of urban and rural planning of the people's government of a city or county (city) shall, within six months after the implementation of these Regulations, jointly with relevant departments such as housing and construction, land and resources, and traffic management of public security organs, organize the preparation of special parking lot plans at the corresponding level, and incorporate them into the detailed urban planning in a timely manner, which shall be implemented after being approved by the people's government at the same level and reported to the Standing Committee of the People's Congress at the same level for the record. The parking lot land that has been included in the regulatory detailed planning shall not be changed without the approval of the original examination and approval authority.

In comprehensive transportation hubs, tourist distribution centers and other places where self-driving can transfer to public transportation, public parking lots should be planned and built to encourage and guide drivers to transfer to public transportation. Article 9 The housing construction department shall, according to the planning of special parking lots and the parking demand of motor vehicles, organize the preparation of the annual construction plan of public parking lots in conjunction with the traffic management department of the public security organ and other relevant departments, and report it to the people's government at the same level for approval before implementation. Tenth buildings with parking lots shall be planned, designed, constructed, accepted and delivered at the same time as the main project.

New construction, renovation and expansion of buildings shall conform to the technical specifications of the industry and the standards for the construction of parking lots, and designate appropriate areas for non-motor vehicles and non-motor vehicles to park; Do not meet the technical specifications and construction standards, shall not issue a "construction project planning permit"; Unqualified acceptance shall not be delivered for use.

New construction, renovation and expansion of public parking lots should have more than 20% parking spaces equipped with charging facilities. New residential parking spaces should be equipped with 100% charging facilities or reserved building installation conditions. Article 11 The municipal competent department of urban and rural planning shall, jointly with the municipal housing and construction and the traffic administrative department of the public security organ, evaluate the standard of parking spaces every two years, formulate or timely adjust the standard of parking spaces according to the evaluation results, and implement it after being approved by the municipal government. The adjusted allocation and construction standards shall be announced to the public in a timely manner. The allocation standard of parking spaces in buildings shall not be lower than the standards stipulated in the technical specifications of the industry. Twelfth the use of civil air defense projects in accordance with the law to set up a parking lot should take into account the combination of peacetime and wartime, and shall not affect the emergency hedging and wartime use functions. Undeveloped existing civil air defense facilities can be transformed into public parking lots combining peacetime and wartime, if they have the conditions for transformation; The ex situ construction fee of air defense basement should be given priority to accelerate the construction of civil air defense projects of single buildings with public parking as their usual function.
