Property companies charge community parking fees.

Property management companies have no right to collect parking fees without authorization.

At present, parking fees in public places in residential areas range from tens of yuan to one or two hundred yuan. The reason for this is that the former only collects vehicle management fees, while the latter also includes venue rental fees, resulting in many disputes. There is nothing wrong with property companies charging vehicle management fees for vehicles, and the competent price department also has corresponding regulations on this charging standard. However, it is obviously inappropriate for the property company to charge the venue rental fee, because the ownership of public places does not belong to the property company. The problem is that the relevant laws (including the State Council's "Property Management Regulations") have no provisions on this.

Article 43 of the draft stipulates that the parking, charging and management of vehicles in public places within the property management area shall be decided by the owners' meeting. If the owners' congress decides to charge for parking vehicles, the charging standard shall be determined with reference to the provisions of the competent price department.

This provision, together with the provision in Article 30 that "the right to use public green spaces, roads and other public places built according to the plan in the property management area belongs to all owners", then, since these public places belong to all owners, the property management company has no right to charge the owners for the venue rental fee.

Some insiders believe that the more feasible operation mode is that part of the management fee belongs to the property company and the venue rental fee belongs to all owners. These fees are collected by the property management company, and the latter fees are transferred to the owners' committee by the property management company. However, due to the lack of corresponding provisions in the draft, disputes may arise due to the conflicts of interests of various interest groups. This may be where the draft is not done enough.
