Can the property be outsourced to security guards?

In practice, in order to save economic costs, property companies will provide security services and cleaning services.

Outsourcing of special services such as greening services is not uncommon. When the property company provides services for all owners of the community, the legal relationship between the two parties is formed. That is, the property management company is the trustee and all the owners are the clients. According to the relevant provisions of the laws of China, with the consent of the principal, the agent may delegate. If an agent entrusts without the consent of the principal, the agent shall bear legal responsibility for the behavior of the entrusted third party.

According to Article 39 of the Property Management Regulations, a property service enterprise may entrust the special service business within the property management area to a professional service enterprise, but may not entrust all the property management within the area to others. It can be seen that the relevant laws do not prohibit property companies from outsourcing special services to others.

1. What are the responsibilities of the property management company's property service scope?

(1) contractual obligations. The residential property company shall provide corresponding services in accordance with the stipulations of the property service contract. If the property service company fails to perform the property service contract, causing personal and property safety damage to the owner, it shall bear corresponding legal responsibilities according to law;

(two) to assist the safety work in the property management area. When a safety accident occurs, the realty service enterprise shall, while taking emergency measures, report to the relevant administrative departments in time to assist in the rescue work. Residential property enterprises violate laws and regulations on public security, environmental protection, property decoration and use in the property management area. The realty service enterprise shall stop it and report to the relevant administrative departments in a timely manner. After receiving the report from the realty service enterprise, the relevant administrative department shall stop the illegal act or deal with it according to law;

(3) Entrusted management obligations of some infrastructure.

Residential property companies provide residential low-voltage power supply facilities, water supply facilities, roads and municipal drainage facilities, heating equipment, facilities and heating pipes, residential greening, fire fighting equipment, etc. ;

(4) Do a good job in greening construction and maintenance in the property management area, and provide a good ecological environment. Especially grassland greening and flowers and trees conservation are very important to create a beautiful and pleasant environment;

(5) Do a good job in traffic management of buildings and communities. The contents include the management of parallel traffic and vertical traffic (elevators and escalators) in the community, as well as the cleaning of passages, roofs and other spaces and the maintenance of street lamps.

(6) Strengthen vehicle management to prevent vehicles from being lost, damaged or causing accidents. It is required to clearly mark the driving routes of residential areas and buildings, drive at a speed limit, park vehicles in the property area uniformly, and keep the roads and corridors in the property area unblocked.

(7) Do a good job in financial management. It is necessary to do a good job in the collection and management of maintenance funds and reserves to ensure the healthy and smooth progress of property management;

(eight) to handle the property insurance of the property and ancillary equipment in time, so as to avoid causing huge property losses to the owners due to natural disasters.

(9) Do a good job in community management, create a healthy and civilized community culture, and strive to establish friendly and harmonious new interpersonal relationships. At the same time, assist the government in social management and promote the civilization and progress of the whole society, such as population statistics, family planning and crime prevention. Strengthen property quality management and improve the quality of life of the community within the scope of the managed property.

(ten) contact with the government and public institutions on matters related to public facilities.

Second, which department should I look for in the property dispute?

There are five channels to reflect the unreasonable charges of property companies:

(1) Complaining to the Price Bureau about the previous property charges must be approved by the Price Bureau, which has the right and obligation to supervise the property company to implement the charging regulations;

(two) to complain to the Housing Authority, which is the industry management department of the property company and has the obligation to deal with the violations of the property company;

(3) Complaining to consumers' associations;
