Regulations of Taizhou Municipality on Property Management

Chapter I General Provisions Article 1 In order to regulate property management activities, safeguard the legitimate rights and interests of all parties involved in property management, create a good living and working environment and promote the construction of a harmonious community, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Property Management of Zhejiang Province, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management, use, supervision and management within the administrative area of this Municipality.

The term "property management" as mentioned in these Regulations refers to the activities of owners and property service enterprises to maintain, conserve and manage houses, supporting facilities, equipment and related sites by hiring property service enterprises to maintain environmental sanitation and related order in the property management area.

If the owner entrusts other managers to provide property management services, it shall be implemented with reference to the relevant provisions of these regulations. Article 3 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership of property management, incorporate property management into the development planning of modern service industry, community construction and community governance system, establish and improve the linkage mechanism of comprehensive coordination and law enforcement, formulate policies to promote the healthy development of property service industry, and support the adoption of new technologies and methods to improve property management and service level.

The management institution of Taizhou Bay New District shall, in accordance with the duties entrusted by the Municipal People's Government, do a good job in the supervision and management of property management activities within its jurisdiction. Fourth city and county (city, district) property departments are responsible for the supervision and management of property management activities within their respective administrative areas, and perform the following duties:

(a) to formulate policies related to property management and organize their implementation;

(two) to guide and assist the establishment of the owners' congress and the election of the owners' committee;

(three) the implementation of supervision and management of property service enterprises;

(four) to guide and supervise the management of property special maintenance funds and property warranty funds;

(five) to promote the construction of property management information;

(six) to guide the neighborhood offices and township (town) people's governments to supervise and manage the property management activities;

(seven) to guide the work of the property service industry association;

(eight) the organization of property management knowledge training;

(nine) other duties as prescribed by laws, regulations and rules.

Departments of development and reform, public security, civil affairs, judicial administration, finance, natural resources and planning, ecological environment, housing and urban construction, sanitation and health, emergency management, market supervision and management, civil air defense, comprehensive administrative law enforcement and fire rescue institutions shall, according to their respective functions and duties, do a good job in the supervision and management of property management within their respective administrative areas. Article 5 Sub-district offices and township (town) people's governments shall be responsible for guiding and supervising the formation and daily operation of the owners' assembly and owners' committee in their respective jurisdictions, coordinating the relationship between property management and community construction, and assisting the property administrative departments in supervising and managing property management activities. Sub-district offices and township (town) people's governments may entrust social organizations to assist in the related work of property management through the way of government purchasing services. Article 6 The community residents' committee shall guide and assist the establishment of the owners' congress and the election of the owners' committee, strengthen the guidance and supervision of the owners' committee, and assist the relevant government departments, sub-district offices and township (town) people's governments to do a good job in property management. Article 7 This Municipality shall establish a diversified mediation and settlement mechanism for disputes in property management activities, which integrates people's mediation, industry mediation, administrative mediation and judicial mediation, and strengthen the source management of disputes.

Property departments, sub-district offices and township (town) people's governments shall improve the dispute handling mechanism of property management, and coordinate and solve contradictions and disputes arising in property management activities.

Encourage community residents' committees, owners' committees and property service enterprises to establish a deliberation and coordination mechanism to solve problems in property management activities. Article 8 During the emergency response period, the subdistrict offices and township (town) people's governments shall organize and implement various emergency measures taken by the higher-level governments according to law, guide the property service enterprises to carry out the corresponding level of response work, and give material and financial support.

The realty service enterprise shall implement the emergency measures and other management measures taken by the people's government in accordance with the law, actively cooperate with the community residents' committees to carry out their work under the guidance of the neighborhood offices and township (town) people's governments, implement the emergency plan and various emergency measures according to law, and the owners shall cooperate with them according to law. Article 9 Property service industry associations shall strengthen industry self-discipline, formulate property service standards, promote the standardization of property services, carry out training for property service practitioners, release information on the property service market, and promote the healthy development of the industry. Chapter II Property Management Areas Article 10 The division of property management areas shall comply with the provisions of laws and regulations, comprehensively consider the scope of construction plots, facilities and equipment used, the scale and type of buildings, community construction and other factors, and follow the principle of relative concentration and easy management.

Planning for urban roads, urban public green spaces, urban rivers and other public areas, shall not be included in the property management area.

The property management area shall be divided by the local property administrative department in conjunction with the sub-district offices and township (town) people's governments, and the opinions of community residents' committees shall be solicited. Eleventh new property property management area is generally defined by the construction land parcel; If the properties, supporting facilities and related sites developed and constructed by stages can be used independently, they can be divided into different property management areas; Two or more adjacent properties, supporting facilities and equipment and property management houses shall be designated as a property management area.

The competent department of natural resources and planning shall, when reviewing the design scheme of construction projects, solicit the opinions of the competent department of property on the configuration of property facilities and equipment and property management houses.

The construction unit shall, within thirty days from the date of obtaining the construction project planning permit, apply in writing to the property administrative department where the property is located for approval of the property management area. The property administrative department shall, within ten working days from the date of receiving the application, obtain the design scheme, general plan, construction project planning permit and its attachments and drawings of the construction project. By enjoying the government information, verify the property management area and inform the construction unit in writing.

When selling new properties, the construction unit shall clearly indicate the regional scope of property management and the attached drawings in the sales contract.
