Can the property refuse to pay the property management fee?

Legal analysis: the property cannot refuse to pay the property management fee. You can refuse to pay the property fee under the following circumstances:

1, the house has not been delivered due to the quality problem of the house;

2. The lease contract indicates that the property fee shall be paid by the tenant;

3. The property management company fails to perform the service responsibilities agreed in the contract;

4. The property management company has not signed a contract with the owner;

5. The service quality provided by the property management company can't reach the standard agreed in the contract.

Legal basis: After the completion of Article 756 of the General Principles of Civil Law of People's Republic of China (PRC), the real estate company failed to send a written notice to the owner as agreed in the contract, and set the prepaid property fee as the key condition for the delivery of the house when the owner asked for the delivery, which eventually led to the inability to deliver the house. The real estate company shall bear the liability for breach of contract for overdue delivery, and the liquidated damages for overdue delivery shall be calculated from the day after delivery.
