What is the charging basis of property decoration management fee?

Legal analysis: Property management fees are charged in full for the following reasons:

1. In general, the renovation management fees incurred during the renovation period should be included in the renovation expenses. Although the decoration expenses of the decoration company are not accounted for, it does not hinder the accounting of decoration management fees. If the invoice is issued, it will include management fee and decoration fee. If you don't pay the decoration fee, that part can't be recorded. The Property Management Ordinance does not stipulate that this fee can be charged, so this fee has no legal basis. However, the property company can charge a certain decoration deposit. If the owner does not violate the regulations after renovation, it should be refunded in full.

2. According to the relevant regulations, if the owner or user leaves the house vacant and both the property management enterprise and the user confirm that the water, electricity and gas meters have not moved, the owner or user shall pay 50% of the property service fee. During the renovation, three watches have been moved, which does not belong to the scope of vacant houses. Therefore, the property service fee should be paid in full.

Legal basis: Article 40 of the Regulations on Property Management should follow the principles of reasonableness, openness, and adaptation of fees and service levels, and distinguish the nature and characteristics of different properties. Owners and property service enterprises shall, according to the measures for charging property services formulated by the competent price department of the State Council in conjunction with the competent construction administrative department of the State Council, stipulate in the property service contract.
