How to manage industrial parks
Chapter I General Provisions
Article 1 In order to accelerate the development of the open economy and promote the sound and rapid development of the county economy, these Interim Measures are formulated in accordance with the relevant provisions of national laws, regulations and policies and with the approval of the provincial people's government, the provincial-level industrial park "Yifeng Industrial Park" is established.
Article 2 These Interim Measures shall apply to the units, individuals and registered enterprises within the jurisdiction of Yifeng County Industrial Park Management Committee (hereinafter referred to as the Park Management Committee). The jurisdiction of the Park Management Committee specifically refers to the planning area of Yifeng Industrial Park (hereinafter referred to as the Park) and the newly-added industrial project area with the development of industrial scale.
Article 3 The contents of park management include land use planning management, project planning and construction management, project admission service management, enterprise production standard management, comprehensive management of social security, tax collection management and social affairs management.
Chapter II Management Institutions and Their Duties
Article 4 The county people's government shall set up a park management committee to exercise relevant management functions on behalf of the county people's government.
Article 5 The Park Management Committee shall enjoy and exercise the following functions and powers
(1) The park management authority and development and construction authority granted by the county people's government in accordance with laws and regulations. Specifically, it includes: exercising all or part of the functions and powers of finance, taxation, industry and commerce, land, investment promotion, planning, construction, environmental protection, justice, labor, safety, health, education and social affairs in the park; The right of park development and construction; In accordance with the laws of the socialist market economy, the park construction investment company shall be established according to law, and the supervision of the company shall be strengthened to ensure the preservation and appreciation of state-owned assets.
(2) The Park Management Committee shall, according to its own duties and tasks, set up corresponding internal functional institutions to exercise the corresponding or related management authority entrusted by the district and county people's governments, but accept the guidance and supervision of the corresponding functional departments in business. Branches set up by relevant departments in the park are under the dual management of the competent department and the park management Committee.
(three) to supervise and manage the units and enterprises in the park according to law.

Article 6 The administrative committee of the park shall undertake the following main responsibilities
(a) according to the relevant laws and regulations and national, provincial, municipal and county policies on the work of the park, combined with the development needs of the park in different periods, study and formulate relevant measures and opinions applicable to the construction and development of the park, and be responsible for organizing the implementation;
(two) to study and formulate the economic and social development plan of the park, and organize the implementation after the approval of the county people's government;
(3) Explore the establishment of a modern management system that is compatible with the socialist market economic system and connected with international practices, and study the development ideas and planning layout of the park in the new period;
(four) responsible for the construction of related supporting infrastructure and the safety, environmental protection and social stability of the park;
(five) responsible for coordinating, communicating and handling the relationship between enterprises in the park and the government and departments, and doing a good job in service to ensure that enterprises operate independently according to law;
(six) according to the planning requirements and industrial positioning, actively do a good job in business selection, capital selection and business security;
(seven) to coordinate and manage the service institutions in the park;
(eight) regularly submit the annual work report and the economic evaluation report of the park development to the county party committee and the county government;
Chapter III Land Use Planning and Management
Article 7 The land use planning of the park strictly follows the relevant national policies, and gradually develops and expands the industrial park according to the principle of land conservation.
Article 8 The overall land use planning of the park must be connected with the overall land use planning of the county and the overall planning of the county, and the operation shall be carried out in accordance with the requirements of industrial orientation and functional zoning of the park and the regulatory detailed planning of Yifeng County Industrial Park.
Ninth in conjunction with the county land resources bureau to do a good job in the planning, collection, approval, transfer, certification and management of land in the park.
Tenth park land is divided into industrial land, commercial land, public facilities land and administrative living land. Its uses are divided into land transfer, land lease and administrative allocation. Land transfer should be carried out by bidding, auction and hanging, and the transfer price should not be lower than the minimum transfer standard of industrial land in Yifeng County stipulated in the National Minimum Standards for Industrial Land Transfer. Land acquired through "bidding, auction and hanging" can be transferred, leased, mortgaged, inherited or invested in cooperation or joint venture with other enterprises according to law. The land use right of industrial land is 50 years (counting from the date of signing the land transfer contract).
Article 11 The land use planning in the park is mainly used to resettle industrial enterprises, accounting for more than 65% of the total land area of the park, and other land is arranged as municipal public facilities land, administrative living land and commercial land respectively.
Twelfth strictly control the land management in the planning of the park, and the construction of roads, water conservancy facilities and farmers' houses around the park must conform to the overall land use planning of the park. The above-mentioned construction of surrounding villagers' groups must be reported to the park for approval before being reported to the land and construction departments for approval.
Thirteenth park enterprises land planning control indicators:
(1) The building density of industrial enterprise land shall be controlled above 43%, the floor area ratio shall be controlled between 0.6- 1.0, the greening rate shall be controlled between 23% and 30%, and the office and living land shall be controlled below 7% of the total land of the enterprise.
(B) industrial enterprises land investment intensity control. The investment intensity of fixed assets of enterprises entering the park must reach more than 800,000 yuan per mu, and the output density should pay an annual tax of more than 20,000 yuan per mu. At the same time, land transfer is divided into different levels according to the scale of investment, that is, 20 million to 50 million yuan is the first level, and 500 1 10,000 yuan to 1 10,000 yuan is the first level; For projects with an investment of more than 654.38 billion yuan, one project is discussed (foreign capital is converted into RMB at real-time foreign exchange rate, the same below). Before the implementation of the "National Minimum Standards for the Transfer of Industrial Land", if the land acquired by zero transfer needs to be transferred or mortgaged, the transfer fee must be paid according to the existing minimum standards.
(three) the enterprise land to implement the deposit system. According to the size of the area, the enterprise pays the land deposit to the park: 6,543,800 yuan for the land below 30 mu (including 30 mu), 200,000 yuan for 365.438+0-50 mu, and 300,000 yuan for 565.438+0-65.438+0-200 mu. The land use deposit is managed by the county finance, and will be refunded in full without interest within 7 working days after the project is completed and accepted.
Fourteenth to prevent idle land in the park.
(1) If the project entering the park fails to start construction one year after the commencement date agreed in the contract, the park management committee shall, jointly with the land department, levy land idle fees according to the standard of 12 yuan/m2; If the construction has not started for two years, the land use right will be recovered free of charge according to law (the idle fees collected will not be returned).
(two) the project construction density, investment intensity, average annual tax per mu (three years after production) can not meet the requirements, according to the idle land area. If many items fail to meet the requirements, the idle land area shall be calculated according to the highest item, and the idle land fee shall be charged according to the relevant provisions.
(three) the responsibility of investment service units in controlling idle land. Implement the mechanism that whoever introduces services and who is responsible for investment projects. If the contracted project fails to start construction on schedule, fails to put into production on schedule or fails to meet the requirements in terms of building density, investment intensity and average annual tax revenue per mu within three years after it is put into production, the investment service unit shall assist the relevant departments to recover the land free of charge or levy land idle fees according to regulations. If the land cannot be recovered or the land idle fee is paid according to the regulations, the county finance shall withhold it from the available financial resources or funds of the investment service unit as appropriate.
Chapter IV Project Planning and Construction Management
Fifteenth all engineering planning and construction in the park must meet the overall requirements of regulatory detailed planning.
Article 16 The corresponding internal organs of the Park Management Committee are the functional departments of the park project construction management, responsible for the planning, budget and final accounts, bidding and construction management of all infrastructure projects in the park, as well as the design review (approval), safety supervision, quality supervision, construction team management and project completion acceptance of enterprise construction projects in the park.
Seventeenth infrastructure projects implemented by the park management committee shall be implemented in strict accordance with the relevant provisions of the higher authorities and the park project construction system. Where the project budget cost is more than 300,000 yuan (including 300,000 yuan), all projects will be invited for public bidding; Projects with a budget cost of less than 300,000 yuan can be negotiated through bidding. All project bidding (discussion) targets should be run in the sun and the bidding affairs should be handled fairly.
Eighteenth pipeline projects undertaken by various functional departments shall abide by the unified planning of the park and carry out planning and construction under the unified guidance of the park management Committee.
Nineteenth enterprise planning and construction shall comply with the following provisions:
(a) enterprise planning and construction must be effective according to law. The planning and construction of enterprise factories must employ qualified units to prevent "three noes" units from entering the planning and construction of park enterprises.
(2) When planning and constructing the factory area of an enterprise, the land use planning map and the factory area construction effect map designed according to the specified requirements shall be provided, which shall be submitted to the leaders in charge of the county government for examination and approval after being audited by the park management committee. After approval, the administrative committee of the park will demarcate the red line of land use and implement it in strict accordance with the design scheme.
(three) the construction of enterprise factories must apply for approval according to the prescribed procedures. After obtaining the construction land planning permit, the construction project planning permit and the construction permit, the construction can only be started after the planning and construction inspection are qualified. Unauthorized forced construction projects, the park management committee can stop its construction, and dismantle illegal buildings according to law.
(4) The layout design of enterprise factories must conform to the overall planning of the park, maintain the overall image of the park, obey the planning and management of the park, and meet the following requirements:
1, the factory building should be standardized, and it must be light steel structure or steel-concrete structure. The simple factory building with steel pipes as raw materials should be eliminated, and the appearance decoration should meet the overall layout requirements of the factory building in the park. In principle, the office building should be built with more than three floors, with novel design and beautiful appearance;
2. The factory fence in * * * area of Gong Lin must be built as required, and it is forbidden to use the factory fence as a fence or use the fence as a fence to build ancillary buildings;
3. The workshop should be beautiful and tidy. Enterprise entrances and exits must obey the overall planning. Pipes, cables, etc. It shall not be laid on the wall near the road, and can only be placed inside or on the side and back. The external wall painting of the factory building should be neat and beautiful, in harmony with the overall image of the park;
4, the factory construction must be carried out in strict accordance with the provisions of the concession building red line, any buildings and structures are not allowed to extend to the road red line. The land within the concession distance shall be afforested and hardened by the enterprise according to the overall planning of the park;
5. Accessory buildings and concealed works must conform to the unified planning of the park, so as to be built after the first batch. Any destructive construction project of public facilities in the park needs to be declared and approved first, and the construction can only be started after paying 2-5 times the restoration cost.
(five) construction, construction units should take the initiative to accept the quality and safety supervision and fire control review, to ensure the quality and safety of the project. After the completion of the project, relevant information should be issued to the park management Committee in time to apply for acceptance. The management committee of the park organizes relevant departments to issue an acceptance report after acceptance, and qualified projects can be put into use.
Twentieth road construction according to the detailed planning control. When the land use planning changes, the branch roads can be increased or decreased according to the situation. Roads and public facilities are planned and constructed according to the regulatory details, and municipal public facilities are laid along the roads.
Twenty-first squares and public green spaces are built according to the plan, and their areas are determined according to their functions.
Twenty-second park infrastructure must comply with relevant laws, regulations and industry norms.
Chapter V Project Access Service Management
Article 23 The park will focus on introducing projects that conform to the national industrial policy and have fixed assets investment of more than 20 million yuan, as well as high-tech industrial projects approved by departments at or above the provincial level, leading industries in the park and their supporting projects.
Twenty-fourth the implementation of environmental protection approval authority, the project must first pass the environmental impact assessment and environmental protection approval.
Article 25 regulate investment agreements. When signing a project investment agreement with investors, investment service units must abide by relevant laws and regulations and abide by the provisions of these Interim Measures.
Article 26 Standard admission procedures. After the signing of the investment agreement, investors shall submit the investment agreement, project feasibility report, preliminary evaluation opinions and project approval to the park management committee, put forward an application for land use for the project, and sign a formal admission contract with the park management committee after being approved by the park project access leading group. The land department signs a land use agreement with the scope of the project land specified in the admission contract, and the investor will go through the land use formalities after paying all the land transfer fees and land use deposits in one lump sum. The choice of land should be determined according to the industrial orientation and functional zoning requirements of the park planning.
Article 27 The formal contract for admission to the park shall specify the investment intensity, building density, plot ratio, annual average per mu tax, annual main business income, commencement date, production time, etc.
Article 28 The construction period of the project shall be within 1 year in principle. Projects with an investment scale of more than 654.38 billion yuan may be appropriately relaxed and agreed in the contract.
Twenty-ninth strengthen the management of the transfer, inheritance, auction, lease and change of existing enterprises entering the park, and prevent enterprises from taking preferential policies in the process of change. Enterprises belonging to the same land, the same kind of products and the same production scale can only enjoy preferential policies once. If the existing enterprises entering the park need to be transferred, inherited, auctioned, leased or changed, the administrative committee of the park will take the lead in organizing relevant units to participate in coordination, and it is strictly forbidden for enterprises to operate privately.
Thirtieth factories and living facilities can be designed and constructed by qualified design, construction and supervision units independently selected by investors, or by entrusting the park construction investment company to design and construct, or by purchasing or leasing idle factories of enterprises in the park.
Article 31 The administrative committee of the park shall track the whole process of the projects entering the park, perform the service functions and supervise the project construction according to the contract, and investigate the liability for breach of contract of the projects in breach of contract according to law. Investment service units should strengthen contact with enterprises, help enterprises solve difficulties encountered in production and life, and assist relevant departments in tax collection and management, employee recruitment and other work.
Chapter VI Standardization Management of Enterprise Production
Article 32 Strengthen contract management and maintain the legality and seriousness of contracts; Manage enterprises according to law, improve the operating rate, output rate, production compliance rate and contribution rate of enterprises; Standardize the management of enterprises and formulate reward and punishment measures; Establish a credit assessment mechanism, strengthen enterprise informatization, and timely and truthfully report all kinds of statistical data according to law.
Thirty-third to strengthen the supervision of enterprise safety production. For projects entering the park, the safety production access system shall be implemented according to law, the "three simultaneities" system of safety production shall be strictly implemented, and the safety production law enforcement inspection system shall be implemented to urge enterprises to rectify the existing safety hazards within a time limit. Enterprises with major safety hazards shall be disposed of by the relevant departments according to law, and those that cause major safety accidents shall be investigated for responsibility according to law.
Thirty-fourth to strengthen the environmental protection of parks. Strictly implement the "three simultaneities" system of environmental protection, that is, environmental protection facilities and the main project are designed, constructed and accepted at the same time. Strengthen environmental supervision, implement environmental protection policies, urge enterprises to strengthen environmental management, improve pollution control facilities, carry out pollution prevention and control work of air, water, noise and soil in the park, and protect the ecological environment of the park.
Thirty-fifth park labor security office is responsible for enterprise recruitment, skills training, employment expansion and social security, labor security supervision, arbitration and other coordination services. Enterprises should strengthen the management of labor and employment, sign labor contracts with employees in accordance with the Labor Law and other laws and regulations, consciously accept labor security supervision, standardize employment behavior, and earnestly safeguard the legitimate rights and interests of employees. Enterprises in the park to expand employment and social security business, the park labor security office in conjunction with the relevant departments to apply, reported to the higher authorities for approval.
Thirty-sixth park management committee is responsible for the statistics, analysis, scheduling and reporting of the main economic indicators of enterprises; To be responsible for consulting, guiding, inspecting, evaluating, examining and rectifying enterprise management; Responsible for guiding and coordinating the technological transformation, scientific and technological innovation, brand innovation and product Excellence of enterprises.
Thirty-seventh timely set up a credit guarantee center for small and medium-sized enterprises in the park to provide credit guarantee support for enterprises in the park.
Chapter VII Administration of Tax Collection
Article 38 The finance department of the park is responsible for the tax collection and management in the park.
Thirty-ninth taxes in the park include all taxes generated by infrastructure construction, factory building construction, enterprise production and operation, commercial services and other activities in the park. According to the principle of territorial management, tax collection and management shall be uniformly collected and managed by the tax authorities in the park. No unit or individual may collect taxes in the park, so as to prevent the loss of tax revenue in the park and ensure the integrity of tax management in the park and the enthusiasm of investment units.
Article 40 An enterprise shall conduct accounting according to law, report on time and pay taxes according to regulations. The financial incentive policy for enterprises shall be implemented according to the relevant provisions of the county government.
Forty-first park enterprises to build their own factories and facilities, involving national, provincial and municipal regulations must charge fees, according to the minimum standards; All administrative fees at the county level shall be exempted (except fees), and the fees for administrative fees and services shall be halved according to the national minimum standards. After paying off the construction business tax, urban construction tax, deed tax, education surcharge and construction enterprise income tax, the enterprise can apply for the enterprise housing property certificate only with the tax payment certificate issued by the local tax department. Encourage enterprises to build multi-storey factories. Where a factory building with more than two floors is built, and the building density reaches more than 43%, the county government will reward the area with more than two floors (including two floors) per square meter 10 yuan.
Chapter VIII Comprehensive Management of Social Security
Article 42 The corresponding internal organs of the park management committee shall, jointly with the park police station, be responsible for studying and formulating the work plan and scheme for comprehensive management of social security in the park, establishing a network for prevention and treatment by groups, and implementing comprehensive management measures. Responsible for receiving letters and visits, registration of foreign personnel, household administration management in the park and mediation of contradictions and disputes; Responsible for coordinating the comprehensive management of the surrounding social environment and maintaining the normal work and life order of the park; Responsible for organizing patrols, handling emergencies, cracking down on illegal activities and eliminating hidden dangers of public security; Responsible for inspecting the production site, rectifying potential safety hazards, and strengthening the safety management and supervision of inflammable, explosive, fire and gas prevention.
Article 43 An enterprise shall establish an internal security grid with strict organization and clear division of labor, and divide the responsibility for maintaining stability into workshops, teams and employees step by step.
Chapter IX Management of Social Public Affairs
Forty-fourth park management committee is responsible for the management of social affairs in the park.
Forty-fifth park management committee is responsible for the park property management, logistics, park information, commercial land management and other work.
Chapter X Supplementary Provisions
Forty-sixth these Interim Measures shall be interpreted by the Park Management Committee authorized by the county people's government.
Article 47 These Interim Measures shall be implemented as of today.
