Guangdong province elevator use safety regulations

(Adopted at the17th meeting of the Standing Committee of the 12th Guangdong Provincial People's Congress on May 28th)

Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Safety of Special Equipment and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to strengthen the use safety of elevators, prevent elevator accidents, and ensure personal and property safety.

Article 2 These Regulations shall apply to the use of elevators within the administrative area of this province, as well as activities related to elevator safety such as manufacturing, installation, renovation, maintenance, inspection, emergency response, supervision and management.

The range of elevators is determined according to the catalogue approved by the State Council.

These Regulations apply to self-use elevators or single-family public elevators.

Article 3 The elevator safety work shall follow the principles of safety first, prevention first, clear rights and responsibilities, convenience and high efficiency.

Article 4 The special equipment safety supervision and management department of the people's government at or above the county level shall supervise and manage the elevator use safety within their respective administrative areas, and other relevant departments shall do a good job in the supervision and management of elevator use safety according to the division of responsibilities.

Township people's governments and sub-district offices shall assist in the safety supervision and management of elevator use.

Article 5 Encourage social organizations such as special equipment industry associations to participate in elevator safety supervision and management, establish industry self-discipline mechanism, promote the construction of industry credit system, provide elevator safety training, publicity and education, consultation and other services, and improve elevator safety management level.

Sixth special equipment safety supervision and management departments should strengthen elevator safety publicity and education, popularize elevator safety knowledge, and enhance public awareness of elevator safety.

Elevator manufacturing units, installation, renovation and maintenance construction units, maintenance units and inspection and testing institutions shall strengthen the publicity of elevator safety knowledge and guide the public to use elevators correctly.

Kindergartens and schools should take elevator safety knowledge as an important part of safety education, and cultivate the habit of safe and civilized use of elevators for children and students.

The guardian shall perform the guardianship obligation for the ward to use the elevator safely and civilized.

The news media shall publicize elevator safety laws, regulations and related knowledge for public welfare, and supervise by public opinion the acts that violate elevator safety management regulations.

Seventh elevator shaft engineering design, elevator selection and configuration, should comply with the provisions of laws and regulations, safety technical specifications and standards, and adapt to the building structure and use requirements.

Laws, regulations, safety technical specifications and standards have no provisions on elevator shaft engineering design, elevator selection and configuration, or have special requirements on elevator use environment, conditions and actual operation conditions, the construction unit shall put forward elevator selection and configuration requirements, organize and coordinate, conduct risk assessment, and determine the elevator shaft design scheme.

Article 8 Before the elevator is put into use, the use manager shall be designated in accordance with the following provisions:

(a) the newly installed elevator has not been handed over to the owner, and the project construction unit is the user manager;

(two) self management, the owner is the use manager;

(3) If the realty service enterprise or other managers are entrusted for management, the trustee shall be the use manager;

(4) Lease a place equipped with elevators, and an elevator user manager may be agreed upon; If there is no agreement, the elevator use manager shall be determined according to the second and third items of this article.

The elevator that has not been clearly defined by the user manager shall not be put into use.

Article 9 The elevator use manager is the first responsible person for elevator use safety management, responsible for the daily use safety of elevators, and performs the following obligations:

(a) before the elevator is put into use, it shall be registered with the safety supervision and management department of special equipment. If the user is changed, it shall be registered within 30 days from the date of change; The elevator belongs to the property right * * *, and one of them can be registered through consultation;

(two) designated or equipped with elevator safety management personnel, and urge them to standardize the management and use of elevator keys;

(three) improve the elevator accident risk prevention, emergency rescue and other safety management systems;

(four) indicate the use of registration marks, inspection marks, warning signs, safety precautions, service life and service period, complaints and rescue telephone numbers in the obvious position of the elevator;

(five) to ensure the effective use of the elevator emergency alarm device and the personnel on duty during the elevator operation;

(six) regular maintenance and self-inspection of the elevator, and make records; If there is no corresponding qualification, it shall entrust a unit with corresponding manufacturing, installation, renovation and maintenance qualifications to maintain the elevator;

(seven) daily inspection of the use of the elevator, found unsafe elevator behavior, stop in time;

(eight) carrying building materials, construction waste and furniture, household appliances and other items that are easy to damage the elevator, taking effective safety protection technical measures or arranging personnel for on-site management;

(9) When the elevator breaks down or there are potential accidents, stop using it immediately, set a stop sign at a prominent position at the entrance of the elevator, and carry out maintenance in time. If the elevator fails to obtain the relevant maintenance qualification, it shall promptly notify the elevator maintenance unit to carry out maintenance;

(ten) when passengers are trapped, immediately notify the elevator maintenance unit, cooperate with the elevator maintenance unit to carry out rescue, and report to the special equipment safety supervision and management department in a timely manner in accordance with the regulations;

(eleven) the decoration of the elevator car may affect the safety of the elevator, which shall be carried out under the guidance of the elevator manufacturing unit. After the decoration is completed, it shall notify the elevator manufacturing unit to carry out testing and meet the relevant national safety technical specifications before it can be put into use;

(twelve) to assist in the renewal, transformation, maintenance, inspection and risk assessment of elevators;

(13) elevators used in airports, railway stations, passenger terminals, shopping malls, stadiums, exhibition halls, parks, cinemas, theaters and other public gathering places shall be monitored in real time, and the monitoring data shall be kept for a period of not less than one month.

For elevators managed by themselves, the user manager may entrust one or more of the obligations listed in the preceding paragraph to others for management, and the trustee shall perform the safety management obligations for the entrusted matters.

Tenth use managers should establish elevator safety technical files and keep them for a long time. Safety technical files include:

(a) elevator design documents, type test reports, product quality certificates, installation and maintenance instructions, emergency technical guidance documents and other factory documents;

(two) concealed engineering data and elevator installation, renovation and maintenance construction process records, major technical problems handling documents and other construction documents;

(3) Records of maintenance and regular self-inspection, records of regular calibration and overhaul of safety protection devices, and records of operation failures and accidents;

(four) supervision and inspection and regular inspection reports and safety assessment reports.

Elevator manufacturing units, installation, renovation and maintenance construction units, maintenance units and inspection and testing professional service institutions shall provide relevant technical information to the use manager.

If the use manager changes, the original use manager shall hand over the elevator safety technical file to the new elevator use manager completely.

Eleventh before the elevator is put into use, the elevator use manager shall establish safety management systems such as post responsibility, hidden danger management and emergency rescue, improve the elevator accident risk prevention mechanism, and ensure public safety.

Establish the elevator public liability insurance system, encourage and support the elevator public to take out liability insurance in accordance with the relevant provisions of the state and the province.

Twelfth elevator manufacturing units shall ensure that the elevator quality, safety performance and energy efficiency indicators meet the requirements of laws and regulations and safety technical standards, and perform the following obligations:

(a) to provide elevator design documents, type test reports, product quality certificates, installation and maintenance instructions and emergency technical guidance documents;

(two) clear the service life of the whole machine or important parts, and notify the use manager in writing 90 days before the expiration of the service life;

(three) the establishment of the elevator machine, important parts acceptance and traceability system;

(four) to ensure the supply of elevator accessories, provide technical guidance for the safe operation and fault handling of elevators, and assist in the training of professional skills such as emergency rescue;

(5) Conduct regular follow-up investigation on the safe operation of the elevator, and immediately notify the elevator use manager and put forward handling opinions when major accidents occur in the elevator;

(six) to perform warranty obligations for warranty matters during the warranty period;

(seven) the elevator design and manufacturing reasons exist signs that endanger safety defects, immediately stop production, according to the implementation of the recall, timely eliminate safety hazards.

Advocate manufacturing units to adopt modern information management technology to track the safe operation of elevators and provide services.

Where a manufacturing unit has not set up a direct selling agency in China to sell elevators manufactured overseas in this province, it shall designate an agent registered in China, and the agent shall undertake the obligations of the manufacturing unit as stipulated in the first paragraph of this article.

Article 13 The elevator installation, renovation and maintenance construction unit shall carry out the construction in accordance with the requirements of laws, regulations and safety technical specifications, truly record the construction process, and hand over technical data such as supervision and inspection reports, concealed engineering data, construction process records, and handling documents for major technical problems to the elevator owner or its entrusted use manager within 30 days after the completion acceptance.

After the elevator installation, renovation and maintenance projects have passed the supervision and inspection and completed the acceptance, the elevator construction unit will hand over the elevator keys and technical data to the elevator owner or its entrusted use manager, which is the delivery. The elevator construction unit shall take measures to prevent the elevator from being used by others before delivery.

Article 14 When the elevator is moving, the elevator use manager shall entrust the elevator manufacturing unit or professional service institutions such as elevator inspection and testing to conduct safety assessment.

Elevator with incomplete factory documents shall not be moved.

Fifteenth elevator maintenance units shall be responsible for the safety performance of the elevators they maintain, maintain the elevators in accordance with the maintenance contracts, laws and regulations, safety technical specifications and standards, ensure the maintenance quality, and perform the following safety management obligations:

(1) Having a fixed business place in the business place, equipped with corresponding operators, instruments and equipment, and informing the special equipment safety supervision and management department of the local people's government at the prefecture level or above in writing;

(2) During maintenance, there shall be no less than two on-site operators, and make their own safety protection;

(3) Take safety protection measures such as enclosure and warning during maintenance to prevent accidents;

(four) at least once every fifteen days for elevator cleaning, lubrication, adjustment and inspection and other maintenance work, and signed by the use of managers;

(five) to review the quality of maintenance before the end of maintenance;

(six) the recent elevator maintenance records shall be stated in a prominent position in the elevator;

(seven) the establishment of maintenance files, real records of maintenance, file retention period of not less than four years;

(eight) without the consent of the user manager, the maintenance matters shall not be subcontracted or subcontracted to other maintenance units;

(nine) to formulate emergency rescue plans, publish emergency rescue telephone numbers, implement a 24-hour duty system, arrive at the scene within 30 minutes after receiving the failure notice, and take emergency rescue measures quickly;

(10) Organize safety education and skills training for elevator operators in this unit at least once a year, and keep the records of safety education and skills training for at least two years.

Advocate maintenance units to adopt modern information management technology to monitor elevator maintenance quality and behavior.

Elevator maintenance units can entrust other units with emergency rescue capabilities to provide professional and socialized emergency rescue services by signing a joint guarantee agreement.

Sixteenth advocate elevator manufacturing units to maintain the elevators manufactured by their own units. If a manufacturing unit establishes or entrusts a unit to maintain the elevators it manufactures, it may not obtain the corresponding license, but it shall inform the safety supervision and management department of special equipment responsible for registration in writing.

Article 17 If the maintenance unit of the elevator in use is changed, the elevator use manager shall, within 30 days from the date of change, go to the elevator inspection agency to change the relevant contents of the elevator inspection mark with the original contract and other relevant certificates, and the inspection agency shall issue a new inspection mark in time.

The elevator inspection agency shall, within five days from the date of issuing the new inspection mark, submit the updated information of the elevator maintenance unit to the special equipment safety supervision and management department responsible for registration.

Eighteenth elevator maintenance units found that there are hidden dangers in the elevator, it should promptly inform the elevator manager, put forward suggestions and bear the costs; If a major accident hidden danger is found, it shall also report to the local special equipment safety supervision and management department, and the special equipment safety supervision and management department that receives the report of major accident hidden danger shall handle it in time according to law.

Nineteenth people's governments at or above the county level and their special equipment safety supervision and management departments shall organize the formulation of emergency plans for elevator accidents according to law, and after receiving the accident report, start the emergency plans according to law, take emergency measures and organize emergency rescue.

Twentieth elevator users should abide by the elevator occupation norms, the safe use of elevators, shall not have the following acts:

(a) the use of express stop elevator;

(2) using the elevator in excess of the rated load;

(3) frolicking, slapping or jumping in the elevator, or retrograde running escalators and moving sidewalks, or staying at the entrance and exit;

(4) Forcibly open the elevator landing door and car door;

(5) Dismantling or damaging elevator parts, ancillary facilities or signs and signs;

(six) other acts that endanger personal safety or the safe operation of elevators.

When elevator passengers find that the elevator is running abnormally, they shall immediately inform the elevator use manager or other relevant personnel.

The safety standard for elevator passengers is formulated by the provincial special equipment safety supervision and management department.

Article 21 If the elevator is under any of the following circumstances, which may affect the use safety of the elevator, the elevator use manager shall entrust the elevator manufacturing unit or professional service institutions such as inspection and testing to conduct safety assessment, and update, transform and maintain the elevator according to the assessment conclusion:

(a) the service life of the whole machine or important parts is about to expire;

(two) elevator failure caused casualties;

(three) affected by floods, fires, earthquakes and other disasters;
