Does the typhoon damage the car and the property compensate?

Legal analysis: the typhoon blows down trees and hits cars. The trees broken by the typhoon are force majeure, and the owners or managers of the trees are not liable for compensation. However, if the tree owner or manager fails to fulfill his safety management obligations, he still needs to bear certain responsibilities. If before the arrival of the typhoon, the trees that may fall down are not fixed properly, and the fallen trees are not cleaned up in time, resulting in damage.

If the contract cannot be performed due to force majeure, the liability shall be exempted in part or in whole according to the influence of force majeure, unless otherwise stipulated by law. If force majeure occurs after the delay in performance, the parties concerned cannot be exempted from their responsibilities. Force majeure as mentioned in this Law refers to unforeseeable, unavoidable and insurmountable objective circumstances.

Legal basis: Regulations on Property Management

Seventh owners in the property management activities, fulfill the following obligations: (1) in accordance with the relevant provisions of the state to pay special maintenance funds; (2) Pay the property service fee on time; (3) Other obligations stipulated by laws and regulations.

Forty-fifth property management area, water supply, power supply, gas supply, heating, communications, cable television and other units should charge the relevant fees to the end users. If the owner signs a contract with the water supply and power supply company and pays the corresponding fees to the water supply and power supply company, the water supply and power supply company shall supply water and power. The property company is not a party to the water supply and power supply contract and has no right to interrupt the water supply and power supply to the owner without authorization.

Sixty-fifth violation of the property service contract, the owner fails to pay the property service fee, the owners' committee shall urge them to pay within a time limit, and the property service enterprise may bring a lawsuit to the people's court.
