Article 5 Civil air defense works have the nature of national defense and should be kept in a good state of readiness in peacetime. No organization or individual may occupy, sell or give away. In wartime or emergency, the government will make unified arrangements for its use. Sixth city and county (District) people's government administrative departments for civil air defense (hereinafter referred to as the competent departments for civil air defense) is responsible for the guidance, supervision and management of the peacetime use and maintenance of civil air defense projects in residential areas.
City, county (District) people's government and other administrative departments and units shall support and cooperate with the competent departments of civil air defense to do a good job in the usual use and maintenance of civil air defense projects in residential areas. Article 7 Sub-district offices (township people's governments) shall assist the competent departments of civil air defense in inspecting and supervising the safe use of civil air defense works, and cooperate with mediation to deal with contradictions and disputes arising from the peacetime use and maintenance management of civil air defense works within their respective jurisdictions. The competent department of civil air defense agrees to use the management unit to use the civil air defense project in the residential area, and shall issue a certificate of peacetime use of the civil air defense project; Do not agree, shall not be issued by the civil air defense project in peacetime use permit, and at the same time explain the reasons in writing and inform the relief way.
In the process of applying for the use of civil air defense projects in residential areas, the competent department of civil air defense can make a commitment to the use, maintenance and management of civil air defense projects in residential areas according to the relevant provisions of credit management and referring to the credit management measures. Eleventh civil air defense departments shall, in accordance with the relevant provisions of the state and the province, announce to the public the relevant requirements for handling the peacetime use certificate of civil air defense projects.
"Civil air defense works in peacetime use certificate" is valid for three years, and will continue to be used after the expiration of the validity period. The use management unit shall, within 30 days before the expiration of the validity period, apply to the competent department for civil air defense for renewal of registration. Twelfth residential civil air defense projects as parking spaces, should be open to all owners, giving priority to meet the parking needs of owners in this area. The lease term of parking spaces shall not exceed three years, and parking spaces shall not be sold or donated. The collection of parking space rent shall be carried out according to the government guidance price.
Parking spaces for civil air defense projects in residential areas are redundant after giving priority to meeting the parking needs of local owners. The use management unit may lease the remaining parking spaces to organizations and individuals outside the property management area, but the lease period shall not exceed six months. Thirteenth the use of management units to transform civil air defense projects in residential areas shall be reported to the competent department of civil air defense for approval; To stop using civil air defense projects in residential areas or change the use of civil air defense projects, we should avoid affecting the normal life and management order of residential areas, and go through the relevant procedures for stopping and changing the use at the civil air defense department.
To stop or change the civil air defense project in residential areas involves the responsibilities of other competent departments, and the competent department of civil air defense shall solicit the opinions of relevant departments.
