Provisions on the administration of peacetime use and maintenance of civil air defense works in Suqian residential areas

Article 1 In order to standardize the peacetime use and maintenance management of civil air defense works in residential areas in our city, and promote the combat readiness and social and economic benefits of civil air defense works, these Provisions are formulated in accordance with the People's Republic of China (PRC) Civil Air Defense Law, the Measures for the Implementation of the People's Republic of China (PRC) Civil Air Defense Law in Jiangsu Province and other laws and regulations. Article 2 These Provisions shall apply to the daily use, maintenance and management of civil air defense works in residential areas within the administrative area of this Municipality.

Where there are other provisions of the state and province on the peacetime use and maintenance management of civil air defense works in residential areas, those provisions shall prevail. Article 3 Civil air defense works in residential areas as mentioned in these Provisions (hereinafter referred to as civil air defense works in residential areas) refer to basements that can be used for air defense for security personnel, material storage, professional team shelter, medical rescue, etc. in wartime. Combined with the ground buildings in residential areas. Article 4 The peacetime use, maintenance and management of civil air defense works in residential areas shall ensure the wartime protection efficiency and emergency evacuation function, and adhere to the principle of combining use with maintenance and management. Article 5 Civil air defense works have the nature of national defense and should be kept in a good state of readiness in peacetime. No organization or individual may occupy, sell or give away. In wartime or emergency, the government will make unified arrangements for its use. Sixth city and county (District) people's government administrative departments for civil air defense (hereinafter referred to as the competent departments for civil air defense) is responsible for the guidance, supervision and management of the peacetime use and maintenance of civil air defense projects in residential areas.

City, county (District) people's government and other administrative departments and units shall support and cooperate with the competent departments of civil air defense to do a good job in the usual use and maintenance of civil air defense projects in residential areas. Article 7 Sub-district offices (township people's governments) shall assist the competent departments of civil air defense in inspecting and supervising the safe use of civil air defense works, and cooperate with mediation to deal with contradictions and disputes arising from the peacetime use and maintenance management of civil air defense works within their respective jurisdictions. Eighth the following units (hereinafter referred to as the use of management units) can be based on the planning and design purposes of civil air defense projects, without affecting the air defense efficiency, to the competent departments of civil air defense for the use of residential civil air defense projects:

(a) the construction unit;

(two) the owners' committee or the property management committee;

(3) Sub-district offices (township people's governments) where civil air defense projects are located in residential areas;

(four) other subjects as prescribed by laws and regulations. Ninth use management units can apply for the use of civil air defense projects in residential areas in accordance with the following provisions:

(a) before the establishment of the owners' committee or the property management committee, the construction unit shall apply for the use;

(two) after the establishment of the owners' committee or the property management committee, the owners' committee or the property management committee shall apply for use;

(three) during the period of property services, if the owners' committee and the property management committee are not established, and the first paragraph of this article cannot be applied, the subdistrict office (Township People's Government) where the civil air defense works in residential areas are located may apply for use.

Change management units, civil air defense departments, property management administrative departments and neighborhood offices (Township People's governments) should do a good job in guidance and coordination. Article 10 The use of civil air defense works in residential areas by management units shall be approved by the competent department of civil air defense and can only be used after obtaining the Civil Air Defense Works peacetime Use Certificate.

"Civil air defense works in peacetime use certificate" is the legal certificate that the competent department of civil air defense agrees to use civil air defense works. After accepting the application for the use of civil air defense projects, the competent department of civil air defense shall make a decision on whether or not to agree within three working days. The competent department of civil air defense agrees to use the management unit to use the civil air defense project in the residential area, and shall issue a certificate of peacetime use of the civil air defense project; Do not agree, shall not be issued by the civil air defense project in peacetime use permit, and at the same time explain the reasons in writing and inform the relief way.

In the process of applying for the use of civil air defense projects in residential areas, the competent department of civil air defense can make a commitment to the use, maintenance and management of civil air defense projects in residential areas according to the relevant provisions of credit management and referring to the credit management measures. Eleventh civil air defense departments shall, in accordance with the relevant provisions of the state and the province, announce to the public the relevant requirements for handling the peacetime use certificate of civil air defense projects.

"Civil air defense works in peacetime use certificate" is valid for three years, and will continue to be used after the expiration of the validity period. The use management unit shall, within 30 days before the expiration of the validity period, apply to the competent department for civil air defense for renewal of registration. Twelfth residential civil air defense projects as parking spaces, should be open to all owners, giving priority to meet the parking needs of owners in this area. The lease term of parking spaces shall not exceed three years, and parking spaces shall not be sold or donated. The collection of parking space rent shall be carried out according to the government guidance price.

Parking spaces for civil air defense projects in residential areas are redundant after giving priority to meeting the parking needs of local owners. The use management unit may lease the remaining parking spaces to organizations and individuals outside the property management area, but the lease period shall not exceed six months. Thirteenth the use of management units to transform civil air defense projects in residential areas shall be reported to the competent department of civil air defense for approval; To stop using civil air defense projects in residential areas or change the use of civil air defense projects, we should avoid affecting the normal life and management order of residential areas, and go through the relevant procedures for stopping and changing the use at the civil air defense department.

To stop or change the civil air defense project in residential areas involves the responsibilities of other competent departments, and the competent department of civil air defense shall solicit the opinions of relevant departments.
