Chapter IV Fire Prevention of Sichuan Fire Protection Regulations

Twenty-second local people's governments at all levels should incorporate fire control planning into urban and rural planning to ensure the unified planning and simultaneous construction of public fire control facilities and other municipal facilities.

Urban and rural fire planning shall determine the following contents as mandatory:

(a) the fire safety layout of the production, storage, loading and unloading places of inflammable and explosive dangerous goods, disaster prevention buffer zones and the driving routes of inflammable and explosive dangerous goods transport vehicles;

(two) the layout of the fire station, fire training base, fire rescue equipment reserve base and fire water intake wharf;

(three) fire water supply, fire communication, fire equipment;

(4) Fire truck passages, emergency evacuation and rescue passages and sites;

(5) Fire control measures for scenic spots and historical and cultural heritage.

Article 23 The planning and construction of public fire control facilities in development zones, industrial and mining areas and tourist resorts shall conform to the relevant fire control technical standards.

Unified planning and construction of rural residential areas should include special fire planning, fire hydrant or fire pool construction, fire truck passage construction and so on.

Outdoor fire hydrants should be set up in rural towns where production and living water supply networks are concentrated; If there is no centralized production and living water supply network, a fire pool shall be set up; Where natural water sources such as rivers and ponds are used as fire fighting water sources, reliable water intake facilities shall be set up to meet the needs of fire fighting. The main roads in rural towns should meet the needs of fire engines.

Twenty-fourth public fire control facilities such as fire stations, fire training bases and fire rescue equipment reserve bases shall be allocated administratively according to law.

No unit or individual may occupy the land for public fire control facilities or change its use without authorization.

Twenty-fifth construction, water supply, power supply, communications and other departments and units responsible for the maintenance and management of public fire control facilities should strengthen the maintenance and management of public fire control facilities such as fire water supply, fire truck passages and fire control communications. , and keep them intact and effective.

Fixed telephone and mobile telephone service business units shall provide users with fire alarm telephone service free of charge. The radio management department shall ensure that the special frequency of fire wireless communication is not disturbed.

Twenty-sixth fire design, construction and supervision units of building projects shall have corresponding qualifications and be responsible for the quality of fire design and construction according to law.

Twenty-seventh construction projects that should be put on record for fire protection design and completion acceptance according to law, the construction unit shall put on record with the fire control institution of the public security organ and truthfully fill in the project information.

For a construction project that does not need to obtain a construction permit according to law, if the construction unit applies to the fire control institution of the public security organ for fire control design filing, the fire control institution of the public security organ shall accept it.

Article 28 If the fire protection design of a building project audited by the fire control institution of the public security organ needs to be changed, the construction unit shall report it to the fire control institution of the public security organ that originally audited it for re-examination.

If the fire protection design of the construction project that has been put on record is changed, the construction unit shall report the changed fire protection design document to the fire control institution of the public security organ that originally accepted it for re-filing.

Twenty-ninth buildings and structures shall meet the national technical standards for fire control. No unit or individual may change the fire prevention conditions of buildings and structures without authorization, and may not set obstacles that affect escape and fire fighting and rescue.

It is suggested that households should be equipped with fire extinguishers and household fire detection alarms.

Thirtieth the construction unit is responsible for the fire safety of the construction site, and shall comply with the following provisions:

(a) to formulate and implement the fire safety system, fire safety operating rules, and clarify the fire safety management personnel;

(two) standardize the management of fire and electricity, and the temporary electrical equipment and wires meet the safety requirements; Welding, gas welding and other operations shall be carried out by trained and qualified personnel according to standard specifications;

(three) set up temporary fire water sources and fire truck passages suitable for the construction progress;

(four) the allocation of fire facilities, equipment, set up fire safety signs;

(five) temporary safety nets, purse seines and building insulation materials meet the technical standards for fire control and management regulations;

(six) no dormitory shall be set up in the construction project.

The construction unit of the high-rise building construction project shall file the fire safety measures and security scheme of the construction site with the fire control institution of the public security organ before the construction starts.

Thirty-first units of cultural relics and ancient buildings and places for religious activities shall establish a fire safety management system, clarify the person responsible for fire safety, equip with fire control facilities and equipment, implement fire safety protection measures, and strengthen the management of fire sources and power sources. Conduct regular fire safety training, fire fighting and emergency evacuation drills.

When holding celebrations, religious activities and other activities in ancient cultural sites and religious sites, corresponding fire safety measures should be taken, and special personnel should be identified for on-site monitoring.

Thirty-second building components, building materials, building insulation materials, indoor and outdoor decoration materials, should comply with national standards, industry standards and relevant state regulations.

Article 33 Units that manage and use high-rise buildings, underground works and public gathering places shall perform the following fire safety duties:

(a) the establishment of fire safety organization or equipped with a person in charge of fire prevention, unified management of fire control work;

(two) in the entrance, elevator, fire door and other eye-catching locations to remind the fire danger, safe escape routes, safety exits, fire control facilities and equipment use obvious signs and warning slogans;

(3) Set up a safety evacuation route guide map;

(four) no building facilities and equipment that hinder the operation of climbing fire engines shall be set around high-rise buildings and above the rescue site;

(five) to report the implementation of fire safety measures and fire safety responsibilities to the public security fire control institutions.

Article 34 Where the same building is used by two or more units, the user shall * * * formulate management measures, set up specialized agencies or entrust property service enterprises to conduct unified management of the evacuation passages, safety exits, building fire control facilities and fire truck passages used by * * *. If there is no unified management, the local village (neighborhood) committee shall urge and guide all parties to determine the fire safety manager and perform fire safety duties.

* * * During the warranty period, the cost of detection, maintenance, renewal and transformation of building fire control facilities shall be borne by the construction unit. After the warranty period expires, it shall be settled by the parties through * * in an agreed way; If there is no agreement or the agreement is not clear, the property owner shall bear it according to the proportion of its total property construction area to the total construction area.

Thirty-fifth property owners in the contract, lease or entrust management, should provide buildings that meet the requirements of fire safety, and the parties should agree on the fire safety responsibilities of all parties.

Thirty-sixth realty service enterprises shall, in accordance with the realty service contract, perform the duties of fire safety management within the scope of entrusted management, provide fire safety prevention services, and fulfill the obligations of fire safety according to law.

Thirty-seventh residential property service enterprises or management units shall perform the following fire safety duties within the scope of management:

(a) to formulate fire safety management system and carry out fire safety publicity and education;

(two) to formulate fire fighting and emergency evacuation plans and conduct regular drills;

(three) to ensure the smooth flow of evacuation routes, safety exits and fire engines;

(four) to maintain and manage the fire control facilities and equipment in the management area to ensure that they are in good condition and effective.

Property service enterprises or management units in residential areas shall carry out fire prevention inspections to eliminate fire hazards; Acts that hinder the fire safety of public security organs should be stopped. If they don't listen, they should report to the fire control institutions of public security organs or police stations in time.

In residential areas where property services or management units are not entrusted, community residents' committees and public security police stations shall strengthen fire safety guidance and coordination.

Thirty-eighth public transport vehicles should be equipped with fire control facilities and equipment such as fire safety protection system in accordance with the regulations, and keep them in good condition and effective.

Urban rail transit operating units shall set up professional fire fighting and rescue equipment and evacuation facilities suitable for urban rail transit fire safety, and establish a fire safety management system for key parts.

Tunnels, expressways and large and medium-sized bridges shall be equipped with necessary facilities and equipment for fire prevention, fire fighting and emergency rescue.

Thirty-ninth fire protection products used by units and places shall meet the national standards or industry standards. Where national standards and industrial standards have not been formulated for new products, applicable local standards may be formulated or passed technical appraisal.

Quality and technical supervision, industrial and commercial administration and fire control institutions of public security organs shall extract a certain proportion of fire protection products every year according to product items and send them to qualified inspection institutions for quality inspection.

The fire control institutions of public security organs shall supervise and inspect the use and maintenance of fire control products, and announce the inspection results to the public in a timely manner.

When the fire control institutions of public security organs conduct fire control acceptance, record spot check and fire control supervision and inspection on construction projects, the construction unit or the user unit shall provide proof of the source of fire control products.

Fortieth automatic fire control facilities shall be regularly maintained and tested by units and personnel with corresponding qualifications. The maintenance situation shall be reported in writing to the fire control institutions of public security organs every six months, and especially important situations shall be reported in time; Conduct a comprehensive inspection at least once every twelve months, and submit the inspection report to the fire control institution of the public security organ.

The fire control room should keep at least two people on duty 24 hours a day.

Forty-first fire technical service institutions engaged in fire product technical appraisal, fire facilities testing, electrical fire technology testing, fire safety monitoring and other services. It shall be audited by the fire department of the provincial public security organ, obtain the corresponding qualification, and be responsible for the quality of the fire technical service entrusted by it.

Fire technical service institutions shall not lease, lend or illegally transfer their qualifications and qualification certificates in other ways, and shall not engage in fire technical service activities beyond the scope of qualifications.

Forty-second fire technical service institutions shall meet the following conditions:

(1) Having the qualification of a legal person;

(2) Having corresponding professional fire detection and monitoring facilities, equipment and places;

(3) Having a corresponding number of professional and technical personnel with professional qualifications;

(4) Having sound enterprise management rules and regulations and a quality assurance system for fire control technical services.

Forty-third to apply for the qualification of fire technical service institutions, it shall submit a written application to the fire control institutions of the provincial public security organs, and submit the following materials:

(a) the legal person qualification certificate and the identity certificate of the legal representative;

(2) List of facilities and equipment required for fire fighting technical services and proof of property rights;

(3) Property right certificates of the office space and the fire-fighting professional testing and monitoring place;

(four) the identity certificate, professional title certificate and professional qualification certificate of professional and technical personnel, as well as the list of personnel and labor contracts;

(five) enterprise management rules and regulations and fire technical service quality assurance system documents.

The fire department of the provincial public security organ shall, after accepting the application for the qualification of the fire technical service institution, conduct an audit and organize the examination within twenty working days. Eligible, issued a qualification certificate; Do not meet the conditions, it shall explain the reasons in writing.

Forty-fourth smoking and the use of open flames in places with fire and explosion hazards are prohibited. If it is necessary to carry out open flame operation due to special circumstances such as construction, it must be approved by the person in charge of fire safety or the fire safety administrator in the hot work place, and the guardianship personnel shall be implemented for on-site supervision. After hot work is completed, clean up the site in time, record and sign it, and file it for future reference.

Fireworks and firecrackers are strictly prohibited in public places of entertainment, and hot work is prohibited during business hours.

Forty-fifth according to public interests and fire safety needs, large public gathering places and gas stations in urban areas should be insured against fire public liability insurance. If the state has provisions, those provisions shall prevail.

Encourage and guide other public gathering places and enterprises that produce, store, transport and sell inflammable and explosive dangerous goods to insure fire public liability insurance.

Forty-sixth fire control institutions of public security organs shall report to the people's government at the same level in writing when they find that there are major fire hazards that affect public safety in fire control supervision and inspection.

The people's government that receives the report shall make a written decision within ten working days from the date of receiving the report, and timely organize relevant departments and units to take measures to eliminate hidden dangers.
