Measures of Changzhou Municipality on the Administration of Delivery and Use of Commercial Housing
Rule number one In order to strengthen the management of the delivery and use of commercial housing and safeguard the legitimate rights and interests of both parties to the commercial housing transaction, these measures are formulated according to the Regulations of the State Council Municipality on the Management of Urban Real Estate Development and Operation, the Regulations of the State Council Municipality on the Quality Management of Construction Projects and relevant laws and regulations, and combined with the actual situation of this Municipality.
Rule number two These Measures shall apply to the delivery and use of new commercial housing and related supervision and management activities within the administrative area of this Municipality.
Rule three. The municipal construction administrative department is responsible for the supervision and management of the delivery of commercial housing in this Municipality.
City (District) construction administrative departments shall be responsible for the supervision and management of the delivery of commercial housing within their respective jurisdictions in accordance with the management authority.
The administrative departments of information, education, land, planning, housing management, gardens, urban management, sports, civil defense and postal services of the municipal (District) people's government are responsible for the management of the delivery and use of commercial housing within their respective functions and duties.
Article 4? Real estate development enterprises shall develop, build and deliver commercial housing in accordance with legal procedures, engineering construction standards, land transfer documents and relevant regulations, and deliver supporting infrastructure and major supporting public facilities.

Article 5? Professional business service units of supporting infrastructure projects such as water supply, power supply, gas supply, drainage, lighting, information and cable TV shall complete the construction on schedule in accordance with the contract and relevant regulations, and issue certification documents or put into use opinions to real estate development enterprises.
Article 6? Real estate development enterprises shall, in accordance with the planning requirements, simultaneously build major supporting public facilities such as education, medical and health care, culture and sports, administration, community services, municipal utilities and parking facilities.
Article 7? The delivery of commercial housing shall meet the following basic conditions:
(a) the completion of the completed housing construction project acceptance for the record;

Article 8? The delivery of commercial housing shall meet the following basic conditions in addition to the provisions of Article 7 of these Measures:

Article 9? Real estate development enterprises shall, after the commercial housing has the basic conditions for delivery and use, apply to the construction administrative department for delivery for the record, and submit the following materials:
(a) documents that meet the requirements of Article 7 and Article 8 of these Measures or opinions on putting them into use;
(2) Other documents stipulated by laws, regulations and rules.
Article 10? The construction administrative department shall, within five working days from the date of accepting the application for delivery and use for the record, review the relevant materials submitted by the real estate development enterprise. If the materials are complete and meet the requirements, a notice of delivery of commercial housing shall be issued; If the materials are incomplete or do not meet the requirements, inform the real estate development enterprise in writing and explain the reasons.
Article 11? After the completion and delivery of commercial housing for the record, the construction administrative department shall make an announcement on its website.
Article 12? When the commercial housing is delivered for use, the real estate development enterprise shall express the notice of filing the delivery of the commercial housing to the buyer.
Thirteenth commercial housing sales contract format text should be clearly stated that the real estate development project can be delivered to the buyer after obtaining the notice of commercial housing delivery for the record.
Article 14 When a commercial house is registered for the first time, the real estate registration agency shall check the notice of delivery and use of the commercial house.

Article 18? The staff of the relevant administrative departments who abuse their powers, neglect their duties or engage in malpractices for selfish ends in the supervision and management of the delivery of commercial housing shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
