Reason:

1. Zhongxingzhuang Village belongs to the third phase project of Sanhaizi Country Park. After the demolition, there are no other construction projects except greening. Zhongxing village is outside the country park and will not affect the park construction process.

3. The second relocation will cause mental burden to the villagers' old people and children, and at the same time increase the relocation cost, resulting in a waste of manpower and material resources. Some old people may die before they live in a new house.

4. The rental fee of15 yuan/square meter can't rent a house nearby at all.

5. Advantages of existing house placement: The newly built house can be built in one year, not more than one and a half years at most. The existing housing placement directly reduces the expenditure of zf. There are 3 10 villagers in zhongxing village, and the rent for each household is 8.37 million yuan a year, 2 years 16740 yuan and 3 years, 2,565,438 yuan. The spirit of the villagers will not be greatly affected, and the relocation work will be easy.

4. The land compensation fee of 90,000 yuan per mu is too low, not less than186,000 yuan per mu.

Article 47 of the Land Management Law of the People's Republic of China stipulates:

The compensation fee for requisitioning cultivated land is six to ten times the average annual output value of the cultivated land in the three years before it is requisitioned, and the resettlement subsidy is four to six times the per capita annual output value of the cultivated land in the three years before it is requisitioned, with the maximum resettlement subsidy not exceeding fifteen times.

The cultivated land in Zhongxingzhuang Village is1.20,000 mu, with per capita 1.5 mu.

Calculated according to the above standards:

Land compensation fee, the average annual output value per mu is 6.5438+0.2 million yuan X8 times = 96,000 yuan.

Resettlement subsidy: per capita 1.5 mu x 1.2 million yuan X5 times = 90,000 yuan.

The land compensation fee (including resettlement subsidy) of Zhongxingzhuang cannot be less than186,000 yuan.

5. Claim compensation before the contract expires.

The land contract of Zhongxingzhuang clearly stipulates that if the land contracted by the villagers is expropriated by the state and the contract is terminated, the contractor has the right to receive the corresponding compensation stipulated by the state. Article 132 of the Property Law stipulates that when the contracted land is expropriated, the land contractor has the right to obtain corresponding compensation in accordance with the provisions of this Law. The land management contract certificate of Zhongxingzhuang is issued by Daxing District People's Government and should be protected by law. Most of the contracts have not expired. If we ask the town government to compensate us according to the land acquisition compensation standards of other villages in our town and the remaining years of the contract, we can accept it.

6. In order to ensure that after the relocation of the villagers in Zhongxing Village, the housing area will not be reduced, the living standard will not be lowered, and the buildings will be affordable and affordable, the town government is required to help coordinate and allocate a part of the village collective assets to the villagers (members of economic organizations), and each person will be allocated a building of 50 square meters. In other words, some of the villagers' buildings will be rented, and the rent will be used to support the buildings and people (refer to the practice of jiugong town Nanjie Four Villages).

At present, more than 90% of the villagers in Zhongxing Village live by renting houses, which can be said to be a vulnerable group. With the rental income, the villagers' living standards have been greatly improved, and the society is stable and the family is harmonious. If these people live in the same building and spend the rest of their money after moving for a year or two, and have no money to pay property fees and heating fees, their lives will return to poverty because of the main building, causing trouble and disharmony (for example, Yizhuang Town).

7. Before the reform, the villagers' treatment standard was too low, and 70% of Beijing's minimum wage was unacceptable.

1. Since the town issued a notice, the police station has often sent people to bomb people in the village. Most of the renters in Zhongxingzhuang Village have left, and half of the enterprises have left. The villagers' houses are all vacant, and some are completely vacant. The villagers have no income, and the house still needs to be maintained.

2. Before the restructuring, the salary was too low, the life was not guaranteed, the time was short, and it was difficult to find a job. However, people still have to live, and it is acceptable to give the minimum wage. The reason is still the problem of national park construction and villagers' support.

Eight, Zhongxingzhuang residential housing relocation should be fully compensated according to the existing housing area of each household.

Referring to the compensation method for demolition in Yinghai, some problems are unreasonable. If there is a construction permit, compensation will be given according to the actual area (including two-story building), and if there is no construction permit, compensation will be calculated at 75%. When Zhongxingzhuang Village issued 1997 collective land homestead use certificate, a considerable number of households did not fill in the actual area. 2001-In 2003, all the villagers basically had room extension permits, and in 2005, some of them were also done, and later they closed down. Later, due to population growth, children growing up and other reasons, the villagers expanded their houses, and the town land department closed. According to state regulations, seven items, such as house expansion, industrial and commercial license and house lease, will be stopped from the date of the announcement of demolition. Therefore, the relocation of Zhongxingzhuang should be fully compensated according to the existing housing area of each household.
